1 1 Amend House File 2393 as follows:
1 2 #1. Page 5, by inserting after line 11 the
1 3 following:
1 4 "Sec. . Section 239B.3, Code 2001, is amended
1 5 by adding the following new subsection:
1 6 NEW SUBSECTION. 5. A person who meets the
1 7 conditions of eligibility under section 239B.2 and who
1 8 meets either of the following requirements shall be
1 9 eligible for participation in the family investment
1 10 program:
1 11 a. The person is a conditional resident alien who
1 12 was battered or subjected to extreme cruelty, or whose
1 13 child was battered or subjected to extreme cruelty,
1 14 perpetrated by the person's spouse who is a United
1 15 States citizen or lawful permanent resident as
1 16 described in 8 C.F.R. 216.5(a)(3).
1 17 b. The person's petition has been approved or a
1 18 petition is pending that sets forth a prima facie case
1 19 that the person has noncitizen status under any of the
1 20 following categories:
1 21 (1) Status as a spouse or child of a United States
1 22 citizen or lawful permanent resident under the federal
1 23 Immigration and Nationality Act, } 204(a)(1).
1 24 (2) Classification as a person lawfully admitted
1 25 for permanent residence under the federal Immigration
1 26 and Nationality Act.
1 27 (3) Suspension of deportation and adjustment of
1 28 status under the federal Immigration and Nationality
1 29 Act, } 244(a), as in effect before the date of
1 30 enactment of the federal Illegal Immigration Reform
1 31 and Immigrant Responsibility Act of 1996.
1 32 (4) Cancellation of removal or adjustment of
1 33 status under the federal Immigration and Nationality
1 34 Act, } 240 A.
1 35 (5) Status as an asylee, if asylum is pending."
