  1  1    Amend House File 2539 as follows:
  1  2    #1.  Page 2, line 25, by inserting after the word
  1  3 "disclaimant" the following:  "and may disclaim on
  1  4 behalf of the personal representative's decedent".
  1  5    #2.  Page 9, by striking lines 9 through 23, and
  1  6 inserting the following:
  1  7    "2.  Shall allocate an amount to trust income, not
  1  8 in excess of the annual unitrust payout amount, in the
  1  9 following order:
  1 10    a.  The amount derived from net income, as
  1 11 determined if the trust were other than a total return
  1 12 unitrust.
  1 13    b.  The amount derived from other ordinary income
  1 14 as determined for federal income tax purposes.
  1 15    c.  The amount derived from net realized short-term
  1 16 capital gains as determined for federal income tax
  1 17 purposes.
  1 18    d.  The amount derived from net realized long-term
  1 19 capital gains as determined for federal income tax
  1 20 purposes.
  1 21    e.  The amount derived from trust principal."
