  1  1    Amend House File 2532 as follows:
  1  2    #1.  Page 1, by inserting after line 9 the
  1  3 following:
  1  4    "Sec.    .  Section 97A.6, subsection 5, paragraph
  1  5 c, Code 2001, is amended to read as follows:
  1  6    c.  Disease under this section shall mean heart
  1  7 disease, or any disease of the lungs or respiratory
  1  8 tract, infectious disease, or cancer, and shall be
  1  9 presumed to have been contracted while on active duty
  1 10 as a result of strain, exposure, or the inhalation of
  1 11 noxious fumes, poison, or gases.  For purposes of this
  1 12 paragraph, "infectious disease" includes, but is not
  1 13 limited to, hepatitis in any form, tuberculosis, and
  1 14 HIV or AIDS as defined in section 141A.1.  However, if
  1 15 a person's membership in the system first commenced on
  1 16 or after July 1, 1992, and the heart disease, or
  1 17 disease of the lungs or respiratory tract, infectious
  1 18 disease, or cancer, would not exist, but for a medical
  1 19 condition that was known to exist on the date that
  1 20 membership commenced, the presumption established in
  1 21 this paragraph shall not apply."
  1 22    #2.  Page 6, by inserting after line 21 the
  1 23 following:
  1 24    "Sec.    .  IMPLEMENTATION PROVISION.  The board of
  1 25 trustees shall implement the amendment to section
  1 26 97A.6, subsection 5, paragraph "c", by this Act, on
  1 27 July 1, 2002, or on the date that the board determines
  1 28 that the most recent annual actuarial valuation of the
  1 29 system indicates that the minimum employer and
  1 30 employee contribution rates in effect under section
  1 31 97A.8 can absorb the costs of the amendment to section
  1 32 97A.6, subsection 5, paragraph "c", by this Act,
  1 33 whichever is later."
  1 34    #3.  Page 15, by inserting after line 34 the
  1 35 following:
  1 36    "Sec.    .  Section 97B.50A, subsection 2,
  1 37 paragraph c, Code 2001, is amended to read as follows:
  1 38    c.  Disease under this subsection shall mean heart
  1 39 disease, or any disease of the lungs or respiratory
  1 40 tract, infectious disease, or cancer, and shall be
  1 41 presumed to have been contracted while on active duty
  1 42 as a result of strain, exposure, or the inhalation of
  1 43 noxious fumes, poison, or gases.  For purposes of this
  1 44 paragraph, "infectious disease" includes, but is not
  1 45 limited to, hepatitis in any form, tuberculosis, and
  1 46 HIV or AIDS as defined in section 141A.1.  However, if
  1 47 a person's special service membership in the system
  1 48 first commenced on or after July 1, 2000, and the
  1 49 heart disease, or disease of the lungs or respiratory
  1 50 tract, infectious disease, or cancer, would not exist,
  2  1 but for a medical condition that was known to exist on
  2  2 the date that special service membership commenced,
  2  3 the presumption established in this paragraph shall
  2  4 not apply."
  2  5    #4.  Page 28, by inserting after line 5 the
  2  6 following:
  2  7    "Sec.    .  Section 411.6, subsection 5, paragraph
  2  8 c, Code 2001, is amended to read as follows:
  2  9    c.  Disease under this section shall mean heart
  2 10 disease, or any disease of the lungs or respiratory
  2 11 tract, infectious disease, or cancer, and shall be
  2 12 presumed to have been contracted while on active duty
  2 13 as a result of strain or the inhalation of noxious
  2 14 fumes, poison or gases.  For purposes of this
  2 15 paragraph, "infectious disease" includes, but is not
  2 16 limited to, hepatitis in any form, tuberculosis, and
  2 17 HIV or AIDS as defined in section 141A.1.  However, if
  2 18 a person's membership in the system first commenced on
  2 19 or after July 1, 1992, and the heart disease, or
  2 20 disease of the lungs or respiratory tract, infectious
  2 21 disease, or cancer, would not exist, but for a medical
  2 22 condition that was known to exist on the date that
  2 23 membership commenced, the presumption established in
  2 24 this paragraph shall not apply."
  2 25    #5.  Page 29, by inserting after line 32 the
  2 26 following:
  2 27    "Sec.    .  Section 411.6, subsection 9, paragraph
  2 28 a, Code 2001, is amended to read as follows:
  2 29    a.  If, upon the receipt of evidence and proof from
  2 30 the chief of the police or fire department that the
  2 31 death of a member in service was the natural and
  2 32 proximate result of an injury or disease incurred in
  2 33 or aggravated by the actual performance of duty at
  2 34 some definite time and place, or while acting pursuant
  2 35 to order, outside of the city by which the member is
  2 36 regularly employed, the system decides that death was
  2 37 so caused in the performance of duty, there shall be
  2 38 paid, in lieu of the ordinary death benefit provided
  2 39 in subsection 8, an accidental death benefit as set
  2 40 forth in this subsection.  Disease under this
  2 41 subsection shall mean heart disease, or any disease of
  2 42 the lungs or respiratory tract, infectious disease, or
  2 43 cancer, and shall be presumed to have been contracted
  2 44 while on active duty as a result of strain or the
  2 45 inhalation of noxious fumes, poison, or gases.  For
  2 46 purposes of this paragraph, "infectious disease"
  2 47 includes, but is not limited to, hepatitis in any
  2 48 form, tuberculosis, and HIV or AIDS as defined in
  2 49 section 141A.1."
  2 50    #6.  Page 32, by inserting after line 23 the
  3  1 following:
  3  2    "Sec.    .  IMPLEMENTATION PROVISION.  The board of
  3  3 trustees shall implement the amendments to section
  3  4 411.6, subsection 5, paragraph "c", and section 411.6,
  3  5 subsection 9, paragraph "a", by this Act, on July 1,
  3  6 2002, or on the date that the board determines that
  3  7 the most recent annual actuarial valuation of the
  3  8 system indicates that the minimum employer and
  3  9 employee contribution rates in effect under section
  3 10 411.8 can absorb the costs of the amendments to
  3 11 section 411.6, subsection 5, paragraph "c", and
