  1  1    Amend Senate File 531, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  Page 17, by inserting after line 35 the
  1  4 following:
  1  5    "Sec.    .  2001 Iowa Acts, House File 413, section
  1  6 2, if enacted, is amended to read as follows:
  1  7    SEC. 2.  SURPLUS FUNDS TRANSFERRED TO THE ENDOWMENT
  1  8 FOR IOWA'S HEALTH ACCOUNT.
  1  9    1.  Notwithstanding section 8.55, subsection 2, any
  1 10 moneys in excess of the maximum balance in the
  1 11 economic emergency fund after the distribution of the
  1 12 surplus in the general fund of the state at the
  1 13 conclusion of the fiscal year beginning July 1, 2000,
  1 14 shall not be transferred to the general fund of the
  1 15 state but shall be transferred to the endowment for
  1 16 Iowa's health account of the tobacco settlement trust
  1 17 fund.  The amount transferred under this subsection
  1 18 shall not exceed forty million dollars. in the
  1 19 following order as follows:
  1 20    a.  The first one hundred sixty-three million eight
  1 21 hundred thousand dollars to the general fund of the
  1 22 state.
  1 23    b.  The next forty million dollars to the endowment
  1 24 for Iowa's health account of the tobacco settlement
  1 25 trust fund.
  1 26    c.  The remaining amount to the general fund of the
  1 27 state.
  1 28    2.  Notwithstanding section 8.55, subsection 2, any
  1 29 moneys in excess of the maximum balance in the
  1 30 economic emergency fund after the distribution of the
  1 31 surplus in the general fund of the state at the
  1 32 conclusion of the fiscal year beginning July 1, 2001,
  1 33 shall not be transferred to the general fund of the
  1 34 state but shall be transferred to the endowment for
  1 35 Iowa's health account of the tobacco settlement trust
  1 36 fund.  The amount transferred under this subsection
  1 37 shall not exceed the difference between forty million
  1 38 dollars and the amount transferred to the endowment
  1 39 for Iowa's health account pursuant to subsection 1.
  1 40    3.  This section is contingent upon the
  1 41 establishment of the endowment for Iowa's health
  1 42 account of the tobacco settlement trust fund by 2001
  1 43 Iowa Acts, Senate File 532, if enacted."
