  1  1    Amend House File 755 as follows:
  1  2    #1.  Page 9, by inserting before line 21, the
  1  3 following:
  1  4    "Sec.    .  Section 8.54, subsection 5, Code 2001,
  1  5 is amended by striking the subsection.
  1  6    Sec.    .  Section 8.55, subsection 2, Code 2001,
  1  7 is amended to read as follows:
  1  8    2.  The maximum balance of the fund is the amount
  1  9 equal to five percent of the adjusted revenue estimate
  1 10 for the fiscal year.  If the amount of moneys in the
  1 11 Iowa economic emergency fund is equal to the maximum
  1 12 balance, moneys in excess of this amount shall be
  1 13 transferred to the general children first fund as
  1 14 created in section 8.57B.
  1 15    Sec.    .  NEW SECTION.  8.57B  CHILDREN FIRST
  1 16 FUND.
  1 17    1.  A children first fund is created in the state
  1 18 treasury.  The children first fund shall be separate
  1 19 from the general fund of the state and shall not be
  1 20 considered part of the general fund of the state
  1 21 except in determining the cash position of the state
  1 22 for payment of state obligations.  The moneys in the
  1 23 children first fund are not subject to section 8.33
  1 24 and shall not be transferred, used, obligated,
  1 25 appropriated, or otherwise encumbered except as
  1 26 provided in this section.  Moneys in the children
  1 27 first fund may be used for cash flow purposes provided
  1 28 that any moneys so allocated are returned to the
  1 29 children first fund by the end of each fiscal year.
  1 30 However, the children first fund shall be considered a
  1 31 special account for the purposes of section 8.53.
  1 32    2.  Notwithstanding section 12C.7, subsection 2,
  1 33 interest or earnings on moneys deposited in the
  1 34 children first fund shall be credited to the children
  1 35 first fund.  Interest or earnings on the moneys
  1 36 deposited in the fund are subject to appropriation for
  1 37 purposes of enhancing preschool and early education
  1 38 programs for young children.  The treasurer of state
  1 39 may invest moneys in the children first fund in
  1 40 investments authorized for the Iowa public employees'
  1 41 retirement system in section 97B.7, subsection 2,
  1 42 paragraph "b", except that investment in common stocks
  1 43 is not permitted.  An appropriation of any other
  1 44 moneys deposited in or credited to the fund shall not
  1 45 be made unless the bill or joint resolution is passed
  1 46 by a vote of at least three-fifths of the members of
  1 47 each house of the general assembly and is approved by
  1 48 the governor.
  1 49    Sec.    .  Section 8.58, unnumbered paragraph 2,
  1 50 Code 2001, is amended to read as follows:
  2  1    To the extent that moneys appropriated under
  2  2 section 8.57 do not result in moneys being credited to
  2  3 the general fund under section 8.55, subsection 2,
  2  4 moneys Moneys appropriated under section 8.57 and
  2  5 moneys contained in the cash reserve fund, rebuild
  2  6 Iowa infrastructure fund, environment first fund, and
  2  7 Iowa economic emergency fund, and the children first
  2  8 fund shall not be considered by an arbitrator or in
  2  9 negotiations under chapter 20."
