To 1 7 provide, through the science and technology advisor 1 8 appointed by the governor pursuant to section 15E.65, 1 9 advice to state governmental entities, academia, the 1 10 business community, and other constituencies regarding 1 11 science and technology issues." 1 12 #2. Page 4, by inserting after line 9 the 1 13 following: 1 14 "Sec. . NEW SECTION. 15E.61 SHORT TITLE. 1 15 This division shall be known and may be cited as 1 16 the "Iowa New Economy Act". 1 17 Sec. . NEW SECTION. 15E.62 PURPOSE. 1 18 The purpose of the Iowa new economy Act is to 1 19 establish a structure for coordinating the development 1 20 and implementation of a technology-led economic 1 21 development strategic plan to competitively position 1 22 Iowa as a world leader in the new economy and create 1 23 high-wage, high-growth jobs in targeted industry 1 24 clusters. The Iowa new economy council shall work 1 25 with the board and the state board of regents to 1 26 create regional technology innovation networks in 1 27 areas of the state with a high concentration of 1 28 technology-intensive businesses within the targeted 1 29 industry clusters. 1 30 Sec. . NEW SECTION. 15E.63 DEFINITIONS. 1 31 As used in this division, unless the context 1 32 otherwise requires: 1 33 1. "Board" means the Iowa economic development 1 34 board created in section 15.103. 1 35 2. "Department" means the Iowa department of 1 36 economic development created in chapter 15. 1 37 3. "Industry clusters" means a group of companies 1 38 that operate in the same or a related field, are 1 39 linked by buyer-seller relationships, common 1 40 customers, or other relationships, and rely on an 1 41 active set of relationships among themselves for 1 42 individual efficiency and competitiveness. 1 43 Sec. . NEW SECTION. 15E.64 INDUSTRY CLUSTERS. 1 44 The Iowa new economy council shall define industry 1 45 clusters identified in section 15.329. 1 46 Sec. . NEW SECTION. 15E.65 IOWA NEW ECONOMY 1 47 COUNCIL. 1 48 1. An Iowa new economy council is created. 1 49 2. A science and technology advisor shall be 1 50 appointed by the governor and employed by the 2 1 department of economic development. The advisor shall 2 2 have significant, extensive expertise in the fields of 2 3 science and technology. The advisor shall advise 2 4 state governmental entities, academia, the business 2 5 community, and other constituencies regarding science 2 6 and technology issues. 2 7 3. The council shall initially consist of eleven 2 8 senior-level decision makers, who are voting members, 2 9 and five ex officio, nonvoting members. With the 2 10 exception of the member designated in paragraph "f", 2 11 the eleven senior-level decision makers shall be 2 12 appointed by the governor. The eleven senior-level 2 13 decision makers include all of the following: 2 14 a. One representative from each of the industry 2 15 leadership councils identified by the council pursuant 2 16 to section 15E.67. 2 17 b. Three additional representatives of the 2 18 business community. Representation under this 2 19 paragraph shall be from various size companies and 2 20 from different geographic areas of the state. 2 21 c. One representative of the university of Iowa, 2 22 the university of northern Iowa, or Iowa state 2 23 university of science and technology designated by the 2 24 state board of regents on a rotating basis. 2 25 d. One representative from the community college 2 26 system. 2 27 e. One representative of a labor union. 2 28 f. The director of the department of economic 2 29 development. 2 30 g. The science and technology advisor appointed 2 31 pursuant to subsection 2. 2 32 4. The ex officio members of the council shall 2 33 include all of the following: 2 34 a. One representative of the primary and secondary 2 35 educational system appointed by the governor. 2 36 b. The president of the senate, or a member of the 2 37 senate appointed by the president. 2 38 c. The minority leader of the senate, or a member 2 39 of the senate appointed by the minority leader. 2 40 d. The speaker of the house of representatives, or 2 41 a member of the house of representatives appointed by 2 42 the speaker. 2 43 e. The minority leader of the house of 2 44 representatives, or a member of the house of 2 45 representatives appointed by the minority leader. 2 46 5. Appointees to the council shall be senior-level 2 47 decision makers within their organizations. Any 2 48 designee serving on the council shall also be a 2 49 senior-level decision maker who has the ability to 2 50 make a decision on behalf of the appointee. The 3 1 appointee or designee shall not designate a substitute 3 2 to participate in council meetings and activities. 3 3 6. The administration of the council shall be 3 4 coordinated by the science and technology advisor 3 5 appointed pursuant to subsection 2. 3 6 7. The initial appointments to the council made 3 7 pursuant to subsection 3, paragraph "a", shall be made 3 8 after the Iowa leadership councils are established 3 9 pursuant to section 15E.67. 3 10 8. The Iowa new economy council shall annually 3 11 elect a chairperson from among its members. 3 12 9. If more than three industry leadership councils 3 13 are established pursuant to section 15E.67, the voting 3 14 membership of the council shall be expanded to allow 3 15 one representative of each industry leadership council 3 16 to serve on the council. 3 17 10. The council shall be subject to the open 3 18 meetings law in chapter 21 and all meetings of the 3 19 council shall be conducted in the presence of a 3 20 representative of the department. 3 21 Sec. . NEW SECTION. 15E.66 STRATEGIC FOCUS 3 22 AND ACTIVITIES. 3 23 1. The strategic focus of the Iowa new economy 3 24 council shall be to support and strengthen the 3 25 competitiveness of Iowa businesses within each of the 3 26 industry clusters. At a minimum, the council shall 3 27 perform all of the following duties: 3 28 a. Develop collaborative industry-led projects in 3 29 the industry clusters. 3 30 b. Lead efforts to improve Iowa's competitive 3 31 position in the industry cluster areas. 3 32 c. Facilitate activities designed to strengthen 3 33 relationships and advocate collaboration among Iowa 3 34 research institutions and Iowa's technology intensive 3 35 businesses. 3 36 d. Develop a three-year strategic plan with an 3 37 annual operating plan to share with the board for 3 38 consideration in developing the department-wide 3 39 strategic plan. 3 40 2. The Iowa new economy council shall develop and 3 41 implement activities addressing all of the following 3 42 economic foundation issues of the new economy: 3 43 a. Skilled and adaptable human resources. 3 44 b. Access to technologies on which new products 3 45 and processes are based. 3 46 c. Availability of financial capital to support 3 47 new ventures, expansion of existing companies, and 3 48 reinvestment in transition industries. 3 49 d. Support of advanced physical infrastructure for 3 50 transportation, communications, energy and water, and 4 1 waste handling. 4 2 e. A review of the regulatory and taxation 4 3 environment and business climate resulting in 4 4 recommendations to balance competitiveness. 4 5 3. The council shall focus on nondiscriminatory 4 6 market expansion and shall foster a competitive and 4 7 open environment. The council shall not be a 4 8 mechanism to allocate markets, fix prices, or stifle 4 9 competition. 4 10 Sec. . NEW SECTION. 15E.67 INDUSTRY 4 11 LEADERSHIP COUNCILS. 4 12 In conjunction with the creation of the Iowa new 4 13 economy council, leadership councils shall be 4 14 established in the advanced manufacturing, information 4 15 solutions, and life science industry clusters as well 4 16 as other industry clusters identified by the Iowa new 4 17 economy council. The leadership councils shall be 4 18 comprised of representatives of business and industry, 4 19 academia, government, and other representatives 4 20 identified by the Iowa new economy council. The 4 21 leadership councils shall be established to address 4 22 issues specific to the industry clusters. The ongoing 4 23 structure, membership, and operational objectives of 4 24 the industry leadership councils shall be determined 4 25 by the Iowa new economy council. 4 26 Sec. . NEW SECTION. 15E.68 FUNDING. 4 27 The Iowa new economy council and the industry 4 28 leadership councils shall not receive a direct 4 29 appropriation from the state. The department may 4 30 allocate to the council moneys that have been 4 31 appropriated to the department for purposes identified 4 32 by the council to support council activities. Public 4 33 resources allocated for the operation of the Iowa new 4 34 economy council and the industry leadership councils 4 35 or for specific projects sponsored by the Iowa new 4 36 economy council and the industry leadership councils 4 37 shall be received through appropriate performance 4 38 agreements administered by the department or other 4 39 appropriate public entities. Private moneys secured 4 40 through contributions, contracts, or other means would 4 41 be administered and accounted for as determined by the 4 42 Iowa new economy council. 4 43 Sec. . NEW SECTION. 15E.69 REPORTS. 4 44 The Iowa new economy council shall annually submit 4 45 a report to the governor and the general assembly 4 46 concerning the use of resources and the results 4 47 derived from investments in the activities sponsored 4 48 by the council. Copies of status reports provided 4 49 under any performance agreement with the department or 4 50 other public entity shall be provided to the governor 5 1 and the general assembly. 5 2 Sec. . NEW SECTION. 15E.70 COUNCIL 5 3 COORDINATION. 5 4 The council shall work with the board and state 5 5 board of regents to review, evaluate, and monitor 5 6 business outreach and assistance programs, including 5 7 university technology transfer programs on an ongoing 5 8 basis. In reviewing, evaluating, and monitoring 5 9 programs and activities, the council shall seek input 5 10 from business, academia, government, and other 5 11 constituencies. The council shall make 5 12 recommendations to the board and state board of 5 13 regents with respect to each of the following: 5 14 1. Strengthening collaboration among business and 5 15 industry and Iowa's research institutions. 5 16 2. Coordinating activities to facilitate the 5 17 growth of the industry clusters." 5 18 #3.
