  1  1    Amend House File 755 as follows:
  1  2    #1.  Page 9, by inserting after line 20, the
  1  3 following:
  1  4    "Sec.    .  Section 257.6, subsection 3, unnumbered
  1  5 paragraph 1, as amended by 2001 Iowa Acts, House File
  1  6 643, section 6, if enacted, is amended to read as
  1  7 follows:
  1  8    A school district shall determine its additional
  1  9 enrollment because of special education, as defined in
  1 10 this section, on by November 1 of each year and shall
  1 11 certify its additional enrollment because of special
  1 12 education to the department of education by November
  1 13 15 of each year, and the department shall promptly
  1 14 forward the information to the department of
  1 15 management.
  1 16    Sec.    .  Section 257.6, subsection 5, unnumbered
  1 17 paragraph 1, as amended by 2001 Iowa Acts, House File
  1 18 643, section 7, if enacted, is amended to read as
  1 19 follows:
  1 20    Weighted enrollment is the budget enrollment plus
  1 21 the district's additional enrollment because of
  1 22 special education calculated on by November 1 of the
  1 23 base year plus additional pupils added due to the
  1 24 application of the supplementary weighting."
  1 25    #2.  Page 10, by inserting after line 24 the
  1 26 following:
  1 27    "Sec.    .  Section 273.22, subsection 5, as
  1 28 amended by 2001 Iowa Acts, House File 674, section 4,
  1 29 if enacted, is amended to read as follows:
  1 30    5.  The board of directors of a school district
  1 31 that is contiguous to a newly reorganized area
  1 32 education agency may petition the board of directors
  1 33 of a contiguous their current area education agency
  1 34 and the newly reorganized area education agency to
  1 35 join that the newly reorganized area education agency.
  1 36 If the contiguous both area education agency board
  1 37 approves boards approve the petition, the
  1 38 reorganization shall take effect on July 1 of the
  1 39 school year following approval of the petition by the
  1 40 state board.  A school district may appeal to the
  1 41 state board the decision of an area education agency
  1 42 board to deny the school district's petition.
  1 43    Sec.    .  Section 273.22, as amended by 2001 Iowa
  1 44 Acts, House File 674, section 4, if enacted, is
  1 45 amended by adding the following new subsection:
  1 46    NEW SUBSECTION.  6.  The board of directors of a
  1 47 school district that is within a newly reorganized
  1 48 area education agency and whose school district was
  1 49 contiguous to another area education agency prior to
  1 50 the reorganization, may petition the board of
  2  1 directors of the newly reorganized area education
  2  2 agency and the contiguous area education agency to
  2  3 join that area education agency.  If both area
  2  4 education agency boards approve the petition, the
  2  5 reorganization shall take effect on July 1 of the
  2  6 school year following approval of the petition by the
  2  7 state board.  A school district may appeal to the
  2  8 state board the decision of an area education agency
  2  9 board to deny the school district's petition.
  2 10    Sec.    .  Section 299.8, as amended by 2001 Iowa
  2 11 Acts, House File 643, section 16, if enacted, is
  2 12 amended to read as follows:
  2 13    299A.8  DUAL ENROLLMENT.
  2 14    If a parent, guardian, or legal custodian of a
  2 15 child who is receiving competent private instruction
  2 16 under this chapter or a child over compulsory age who
  2 17 is receiving private instruction submits a request,
  2 18 the child shall also be registered in a public school
  2 19 for dual enrollment purposes.  If the child is
  2 20 enrolled in a public school district for dual
  2 21 enrollment purposes, the child shall be permitted to
  2 22 participate in any academic activities in the district
  2 23 and shall also be permitted to participate on the same
  2 24 basis as public school children in any extracurricular
  2 25 activities available to children in the child's grade
  2 26 or group, and the parent, guardian, or legal custodian
  2 27 shall not be required to pay the costs of any annual
  2 28 evaluation under this chapter.  If the child is
  2 29 enrolled for dual enrollment purposes, the child shall
  2 30 be included in the public school's basic enrollment
  2 31 under section 257.6.  A pupil who is participating
  2 32 only in extracurricular activities shall be counted
  2 33 under section 257.6, subsection 1, paragraph "f".  A
  2 34 pupil enrolled in grades nine through twelve under
  2 35 this section shall be counted in the same manner as a
  2 36 shared-time pupil under section 257.6, subsection 1,
  2 37 paragraph "c"."
