  1  1    Amend House Concurrent Resolution 35 as follows:
  1  2    #1.  By striking page 1, line 3, through page 2,
  1  3 line 21, and inserting the following:  
  1  4 "A Concurrent Resolution requesting the establishment
  1  5    of a committee to study and make recommendations
  1  6    concerning issues related to hazardous material
  1  7    cleanup and mitigation.
  1  8    WHEREAS, hazardous material mitigation is a service
  1  9 local fire departments and hazardous material crews
  1 10 provide in the case of hazardous material spills; and
  1 11    WHEREAS, hazardous material mitigation and training
  1 12 are services provided to residents and commercial
  1 13 services by publicly funded agencies and local
  1 14 governments; and
  1 15    WHEREAS, commercial services and their insurance
  1 16 carriers provide reimbursement for cleanup when needed
  1 17 to the local hazardous material services; and
  1 18    WHEREAS, billing charges by various public services
  1 19 and hazardous material services to insurance carriers
  1 20 for cleanups and mitigation vary; and
  1 21    WHEREAS, commercial services and their insurance
  1 22 carriers need some standardization in billing for
  1 23 cleanup services and mitigation; NOW THEREFORE,
  1 24    BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES, THE
  1 25 SENATE CONCURRING, That the legislative council is
  1 26 requested to establish an interim study committee to
  1 27 study and make recommendations regarding the costs
  1 28 associated with the cleanup and mitigation of
  1 29 hazardous material, the regional system used to
  1 30 provide the service, the billing procedures and
  1 31 standards used in other states, the costs of training
  1 32 and maintaining the hazardous material service in
  1 33 Iowa, the cost of cleanup, mitigation, and disposal of
  1 34 hazardous material spilled in Iowa, and the workers
  1 35 needed at hazardous material spill sites; and
  1 36    BE IT FURTHER RESOLVED, That the interim study
  1 37 committee shall include members of the general
  1 38 assembly, representation of professional and volunteer
  1 39 fire fighters who are trained in hazardous material
  1 40 cleanup, mitigation, and handling, the department of
  1 41 natural resources, members of the trucking industry
  1 42 involved in the interstate and intrastate
  1 43 transportation of hazardous material for the
  1 44 agricultural sector and the industrial sector,
  1 45 railroad companies, the insurance industry involved in
  1 46 insuring hazardous material spills, the state
  1 47 department of transportation, cities, counties, the
  1 48 department of public safety, and the chemical
  1 49 manufacturing industry; and
  1 50    BE IT FURTHER RESOLVED, That the interim study
  2  1 committee shall report its findings and
  2  2 recommendations to the general assembly by January 1,
  2  3 2002."
