  1  1    Amend House File 732 as follows:
  1  2    #1.  Page 34, by inserting after line 23 the
  1  3 following:
  1  4    "   .  The department may adopt emergency rules to
  1  5 modify the qualifications for rehabilitative treatment
  1  6 service providers to allow an individual with a
  1  7 bachelor's degree in social work to provide therapy
  1  8 and counseling and to implement other recommendations
  1  9 of the committee made up of department staff and
  1 10 providers of child welfare services that is charged
  1 11 with the development of proposals for regulatory
  1 12 improvements.  The pertinent recommendations may
  1 13 include but are not limited to implementing "deemed"
  1 14 certification status for providers; addressing
  1 15 requirements for staff qualifications, ratios, and
  1 16 supervision; revising requirements for treatment plan
  1 17 development, review, and revision, and for treatment
  1 18 records; applying shared risk or loss provisions for
  1 19 retroactive audits; and access to the department's
  1 20 service review organization."
  1 21    #2.  Page 54, by inserting after line 13 the
  1 22 following:
  1 23    "Sec. ___.  Section 135H.6, subsection 2, Code
  1 24 2001, is amended to read as follows:
  1 25    2.  The proposed psychiatric institution is
  1 26 accredited by the joint commission on the
  1 27 accreditation of health care organizations, the
  1 28 commission on accreditation of rehabilitation
  1 29 facilities, the council on accreditation of services
  1 30 for families and children, or by any other federally
  1 31 recognized accrediting organization with comparable
  1 32 standards acceptable under federal regulation."
  1 33    #3.  Page 55, by inserting after line 22 the
  1 34 following:
  1 35    "Sec.    .  Section 235A.16, subsection 2, Code
  1 36 2001, is amended to read as follows:
  1 37    2.  a.  Requests for child abuse information may be
  1 38 made orally by telephone where a person making such a
  1 39 request believes that the information is needed
  1 40 immediately and where information sufficient to
  1 41 demonstrate authorized access is provided.  In the
  1 42 event that a request is made orally by telephone, a
  1 43 written request form shall nevertheless be filed
  1 44 within seventy-two hours.
  1 45    b.  The department of human services, in
  1 46 conjunction with other departments and agencies of
  1 47 state government involved with criminal history and
  1 48 abuse registry information, may implement a single
  1 49 contact repository to allow employers and other
  1 50 persons authorized access to child abuse information
  2  1 under section 235A.15 to have electronic access to
  2  2 such information in order to perform background checks
  2  3 for purposes of employment."
