Page 4, by striking line 29 and inserting the 1 4 following: "2001, is amended to read as follows: 1 5 a.Yard signs shall not be placed on any property1 6which adjoins a city, county, or state roadway sooner1 7than forty-five days preceding a primary or general1 8election and shall be removed within seven days after1 9the primary or general election in which the name of1 10the particular candidate or ballot issue described on1 11the yard sign appears on the ballot. Yard signs are1 12subject to removal by highway authorities as provided1 13in section 319.13, or by county or city law1 14enforcement authorities in a manner consistent with1 15section 319.13.The placement or erection of yard 1 16 signs shall be exempt from the requirements of chapter 1 17 480.Notice may be provided to the chairperson of the1 18appropriate county central committee if the highway1 19authorities are unable to provide notice to the1 20candidate, candidate's committee, or political1 21committee regarding the yard sign." 1 22 #2. Section 455B.190A, subsection 2, 1 28 paragraphs f and g, Code 2001, are amended to read as 1 29 follows: 1 30 f. The department shall develop continuing 1 31 education requirements for certification of a well 1 32 contractorin consultation with the well contractors'1 33council. 1 34 g. The examination shall be developed by the 1 35 departmentin consultation with the well contractors'1 36council. The examination shall be updated as 1 37 necessary to reflect current groundwater law and well 1 38 construction, maintenance, and abandonment practices." 1 39 #3. Section 546.9, Code 2001, is amended to 2 2 read as follows: 2 3 546.9ALCOHOLIC BEVERAGESALCOHOL AND TOBACCO 2 4 CONTROL DIVISION. 2 5 Thealcoholic beveragesalcohol and tobacco control 2 6 division shall enforce and implement chapter 123. The 2 7 division is headed by the administrator ofalcoholic2 8beveragesalcohol and tobacco control who shall be 2 9 appointed pursuant to section 123.10. Thealcoholic2 10beveragesalcohol and tobacco control commission shall 2 11 perform duties within the division pursuant to chapter 2 12 123." 2 13 #6. Page 26, by inserting after line 21 the 2 14 following: 2 15 "Sec. . Section 633.568, Code 2001, is amended 2 16 to read as follows: 2 17 633.568 NOTICE TO PROPOSED WARD. 2 18 1. a. If the proposed ward is an adult, notice of 2 19 the filing of the petition shall be served upon the 2 20 proposed ward in the manner of an original notice and 2 21 the content of the notice is governed by the rules of 2 22 civil procedure governing original notice. 2 23 b. Except where the ward is the petitioner, notice 2 24 shall also be served upon the ward's spouse. If the 2 25 ward has no spouse, notice shall be served upon the 2 26 ward's adult children, if any. 2 27 2. a. If the proposed ward is a minor or if the 2 28 proposed ward is an adult under a standby petition and 2 29 the court determines, pursuant to section 633.575, 2 30 subsection 1, paragraph "b", that the proposed ward is 2 31 entitled to representation, notice in the manner of 2 32 original notice, or another form of notice ordered by 2 33 the court, given to the attorney appointed to 2 34 represent the ward is notice to the proposed ward. 2 35 b. Notice shall also be served uponthe: 2 36 (1) The parents of the proposed ward, if the ward 2 37 is a minor. 2 38 (2) The spouse of the proposed ward, if the 2 39 proposed ward is an adult. If the ward has no spouse, 2 40 notice shall be serviced upon the proposed ward's 2 41 adult children, if any. 2 42 3. Service of notice under this section upon 2 43 persons other than the proposed ward shall be made 2 44 upon such persons whose identities are reasonably 2 45 ascertainable pursuant to section 633.40, subsection 2 46 5. Proof of service shall be made by affidavit, to 2 47 which copies of all documents served shall be 2 48 attached. 2 49 Sec. . Section 633.4105, subsection 2, 2 50 paragraph b, subparagraph (1), Code 2001, is amended 3 1 to read as follows: 3 2 (1) By majority vote of all adult beneficiaries 3 3 and the representative of any minor or incompetent 3 4 beneficiary, asdefined byprovided in section 3 5 633.6303. 3 6 Sec. . Section 633.4106, subsection 1, 3 7 paragraph c, Code 2001, is amended to read as follows: 3 8 c. With the consent of the adult beneficiariesas3 9defined in section 633.4105, subsection 1, if the 3 10 trust is irrevocable or the holder of the power to 3 11 revoke lacks competency or is not represented by a 3 12 guardian, conservator, or agent. 3 13 Sec. . Section 633.4213, subsections 5 and 6, 3 14 Code 2001, are amended to read as follows: 3 15 5. A trustee shall prepare and send to the 3 16 beneficiaries anaccountaccounting of the trust 3 17 property, liabilities, receipts, and disbursements at 3 18 least annually, at the termination of the trust, and 3 19 upon a change of a trustee. An accounting on behalf 3 20 of a former trustee shall be prepared by the former 3 21 trustee, or if the trustee's appointment terminated by 3 22 reason of death or incapacity, by the former trustee's 3 23 personal representative or guardian or conservator. 3 24 6. Copies of accountings and other information 3 25 required under this section need only be sent to the 3 26 following beneficiaries: 3 27 a. The beneficiaries defined in section 633.4105. 3 28 b. Each beneficiary who has delivered to the 3 29 trustee or other fiduciary a written request for a 3 30 copy of theaccountaccounting or other information. 3 31 Sec. . Section 633.6202, subsection 2, 3 32 paragraph o, Code 2001, is amended to read as follows: 3 33 o. Authorize or direct transferorof a trust or 3 34 trust property to or from another jurisdiction." 3 35 #7. Page 27, line 2, by striking the word "person" 3 36 and inserting the following: "person,". 3 37 #8. Page 27, line 3, by striking the words "of 3 38 release" and inserting the following: "of release,". 3 39 #9. Page 31, by inserting after line 35, the 3 40 following: 3 41 "Sec. . ALCOHOLIC BEVERAGES DIVISION NAME 3 42 CHANGES. 3 43 1. Sections 18.14, 22.7, 123.3, 123.4, 123.10, 3 44 123.14, 123.20, 142A.3, 142A.4, 142A.5, 321.19, 3 45 455C.3, and 455C.4, Code 2001, are amended by striking 3 46 the words "alcoholic beverages division" and inserting 3 47 in lieu thereof the words "alcohol and tobacco control 3 48 division". 3 49 2. Sections 123.3, 123.5, and 123.8, Code 2001, 3 50 are amended by striking the words "alcoholic beverages 4 1 commission" and inserting in lieu thereof the words 4 2 "alcohol and tobacco control commission". 4 3 3. The Code editor is directed to change all 4 4 references to the "alcoholic beverages division" to 4 5 the "alcohol and tobacco control division" and further 4 6 to change all references to "alcoholic beverages 4 7 commission" to the "alcohol and tobacco control 4 8 commission" in any section of the 2001 Code of Iowa 4 9 and in any enactment which is codified on or after the 4 10 effective date of this Act and in which there is no 4 11 doubt as to the intent to refer to that division or 4 12 commission. The Code editor is further directed to 4 13 change all references to the "administrator of the 4 14 alcoholic beverages division" or the "administrator of 4 15 alcoholic beverages" to the "administrator of the 4 16 alcohol and tobacco control division" or the 4 17 "administrator of alcohol and tobacco control", 4 18 respectively, in any section of the 2001 Code of Iowa 4 19 and in any enactment which is codified on or after the 4 20 effective date of this Act and in which there is no 4 21 doubt as to the intent to refer to that 4 22 administrator." 4 23 #10.
