1 6 Sec. . NEW SECTION. 56.14A FALSE INFORMATION
1 7 IN POLITICAL MATERIAL.
1 8 1. A person shall not be a sponsor of any
1 9 published material on behalf of or in opposition to
1 10 any candidate or ballot issue that contains any
1 11 assertion, representation, or statement of fact,
1 12 including, but not limited to, information concerning
1 13 a candidate's prior public record, which the sponsor
1 14 knows to be untrue, deceptive, or misleading.
1 15 2. For purposes of this section, "published
1 16 material" means statements or graphic representations
1 17 made through any public medium which includes, but is
1 18 not limited to, any of the following:
1 19 a. Electronic media such as live or prerecorded
1 20 radio or television broadcasts, broadcasts or
1 21 transmissions through other publicly available
1 22 electronic communications, and video or audio tape
1 23 recordings which are publicly distributed.
1 24 b. Print media, such as newspapers, pamphlets,
1 25 folders, display cards, signs, posters, or billboard
1 26 advertisements.
1 27 c. Any other methods or mediums designed for
1 28 publicly advertising or publishing information.
1 29 3. For purposes of this section, "sponsor" means a
1 30 person who pays for or approves published material and
1 31 shall include a candidate or committee which knows and
1 32 approves of an independent expenditure made by another
1 33 person under section 56.13."
1 34 #2. Title page, line 8, by inserting after the
1 35 word "areas," the following: "prohibiting the
1 36 publication of false or misleading information in
1 37 political advertisements, and applying a penalty,".
1 38 #3. By renumbering as necessary.
