1 1 Amend House File 577 as follows:
1 2 #1. Page 2, by striking lines 8 through 12 and
1 3 inserting the following:
1 4 "e. The board shall review the reasonableness and
1 5 prudence of the costs of a power purchase contract
1 6 approved under this subsection at least every twenty-
1 7 four months.
1 8 (1) If, after a contested case proceeding, the
1 9 board finds by a preponderance of the evidence that
1 10 fuel procurement costs or other contract costs are
1 11 imprudent, unreasonable, or excessive, the board shall
1 12 order a refund to affected retail customers.
1 13 (2) In the period between contested case
1 14 proceedings, the board may require a rate-regulated
1 15 public utility to file certain information as it deems
1 16 necessary to monitor power purchase contract costs.
1 17 The board shall adopt rules pursuant to chapter 17A to
1 18 administer this subparagraph."
