  1  1    Amend Senate File 66, as passed by the Senate, as
  1  2 follows:
  1  3    #1.  Page 1, by inserting after line 16 the
  1  4 following:
  1  5    "Sec. 100.  PILOT PROJECT FOR REFUND OF PROCESSING
  1  6 FEES.
  1  7    1.  As used in this section:
  1  8    a.  "Customer" means a person paying a fee as
  1  9 provided in paragraph "c", as part of an application
  1 10 for the issuance of a renewed license or certification
  1 11 by a participating agency.
  1 12    b.  "Participating agency" means the Iowa
  1 13 department of public health or the professional
  1 14 licensing division of the department of commerce that
  1 15 elects to participate in the pilot project as provided
  1 16 in subsection 2.
  1 17    c.  "Processing fee" means a fee that is required
  1 18 to be paid to a participating agency as follows:
  1 19    (1)  The Iowa department of public health for
  1 20 issuing a renewed emergency medical care provider
  1 21 certification pursuant to section 147A.6 for which a
  1 22 fee is required pursuant to rules adopted by the
  1 23 department under section 147A.4.
  1 24    (2)  The professional licensing division, for
  1 25 issuing any of the following:
  1 26    (a)  The renewal of a certificate of licensure as a
  1 27 professional engineer pursuant to section 542B.18 for
  1 28 which a fee is required pursuant to section 542B.30.
  1 29    (b)  The renewal of a license to practice as an
  1 30 accounting practitioner pursuant to section 542C.20
  1 31 for which a fee is required pursuant to section
  1 32 542C.15.
  1 33    (c)  The renewal of a license as a real estate
  1 34 broker or real estate salesperson pursuant to section
  1 35 543B.28 for which a fee is required pursuant to
  1 36 section 543B.27.
  1 37    (d)  The renewal of a certification as a real
  1 38 estate appraiser pursuant to section 543D.7 for which
  1 39 a fee is required pursuant to section 543D.6.
  1 40    (e)  The renewal of a certificate of registration
  1 41 as an architect pursuant to section 544A.10 for which
  1 42 a fee is required pursuant to section 544A.11.
  1 43    (f)  The renewal of a certificate of registration
  1 44 as a landscape architect pursuant to section 544B.13
  1 45 for which a fee is required pursuant to section
  1 46 544B.14.
  1 47    2.  The department of management in cooperation
  1 48 with a participating agency may establish a pilot
  1 49 project for the refund of all or a portion of
  1 50 processing fees paid by customers.  The following
  2  1 shall apply to a participating agency:
  2  2    a.  The participating agency shall refund all or a
  2  3 portion of a processing fee to a customer if the
  2  4 participating agency fails to issue a license or
  2  5 certification in a manner and within a period of time
  2  6 customary for issuing similar licenses and
  2  7 certifications.
  2  8    b.  The participating agency is not required to
  2  9 refund any amount of a processing fee if the failure
  2 10 to issue a license or certification is primarily
  2 11 caused by the customer, including the customer's
  2 12 failure to comply with legal requirements, furnish a
  2 13 completed application or document, or cooperate with
  2 14 the participating agency as required by the
  2 15 participating agency.
  2 16    3.  Each participating agency shall adopt rules
  2 17 pursuant to chapter 17A necessary in order to
  2 18 administer this section.  The participating agencies
  2 19 shall cooperate in order to develop simple common
  2 20 procedures for providing refunds, which may include a
  2 21 uniform refund form.  The agencies may cooperate with
  2 22 the general assembly's joint oversight and
  2 23 communications appropriations subcommittee or other
  2 24 appropriate committee or subcommittee in carrying out
  2 25 this section.
  2 26    4.  Each participating agency shall prepare a
  2 27 report to the department of management.  The report
  2 28 shall analyze the administration of the pilot project,
  2 29 including its effect on administrative efficiency, the
  2 30 collection of revenue, and customer reactions.  The
  2 31 reports shall be delivered to the department of
  2 32 management not later than November 1, 2002.  The
  2 33 department of management shall compile the reports and
  2 34 include any findings or recommendations by the
  2 35 department.  The department's compiled report shall be
  2 36 delivered to the governor and general assembly not
  2 37 later than January 10, 2003.
  2 38    Sec.    .  Section 100 of this Act, enacting a
  2 39 pilot project for refund of processing fees, is
  2 40 repealed January 11, 2003."
