SENATE FILE 404 SUBSTITUTED FOR HOUSE FILE 424
Jacobs of Polk asked and received unanimous consent to substitute 
Senate File 404 for House File 424.
Senate File 404, a bill for an act relating to a relationship 
involving real estate licensees and real estate clients, and 
establishing restrictions on the payment of commissions or other 
consideration, was taken up for consideration.
Jacobs of Polk moved that the bill be read a last time now and 
placed upon its passage which motion prevailed and the bill was read 
a last time.

Siegrist of Pottawattamie asked and received unanimous consent 
that Senate File 404 be immediately messaged to the Senate.
House File 661, a bill for an act relating to the offense of sexual 
abuse in the third degree, providing related definitions, and applying 
penalties, was taken up for consideration.
Davis of Wapello offered the following amendment H?1241 filed by 
him and moved its adoption:

 1     Amend House File 661 as follows:
 2     1.  Page 1, by inserting before line 1 the
 3   following:
 4     "Section 1.  Section 709.1, Code 1999, is amended
 5   to read as follows:
 6     709.1  SEXUAL ABUSE DEFINED.
 7     Any sex act between persons is sexual abuse by
 8   either of the participants persons when the act is
