1 1 Section 1. NEW SECTION. 18.188 ELECTRONIC RECORDS
1 2 REPOSITORY STANDARDS.
1 3 The division of information technology services shall
1 4 establish standards for an electronic repository for
1 5 maintaining mandated agency reports as provided in section
1 6 304.13A. Such repository shall be developed and maintained
1 7 for the purpose of providing public access to such mandated
1 8 reports. The division shall develop such standards in
1 9 consultation with the state librarian.
1 10 Sec. 2. Section 304.3, Code 1999, is amended by adding the
1 11 following new subsection:
1 12 NEW SUBSECTION. 9. The director of the division of
1 13 information technology services of the department of general
1 14 services.
1 15 Sec. 3. Section 304.7, Code 1999, is amended by adding the
1 16 following new subsection:
1 17 NEW SUBSECTION. 1A. Public records policies for an
1 18 electronic repository for mandated agency reports.
1 19 Sec. 4. NEW SECTION. 304.13A ELECTRONIC RECORDS.
1 20 1. An agency required to compile and maintain a report, on
1 21 and after July 1, 2001, shall maintain such report in an
1 22 electronic form, consistent with standards for electronic
1 23 records established by the division of information technology
1 24 services of the department of general services. Such agency,
1 25 by itself, or with the assistance of the division of
1 26 information technology services, shall also make the report
1 27 accessible to the public through the internet as provided in
1 28 subsection 2 and through other electronic means.
1 29 2. A copy of all required agency reports shall be located
1 30 at an internet site maintained by the division of information
1 31 technology services of the department of general services in
1 32 consultation with the state librarian, and all required
1 33 reports shall be placed on electronic media with sufficient
1 34 copies to permit the state librarian to ensure equal access
1 35 through public libraries throughout the state. The state
2 1 librarian shall provide for the distribution of such copies,
2 2 at a minimum, to all public libraries in this state.
2 3 For purposes of this section, "public library" means a city
2 4 library, a regional library as provided in chapter 256, or a
2 5 county library as provided in chapter 336.
2 6 3. It is the intent of the general assembly that this
2 7 section be interpreted to reduce, to the greatest extent
2 8 possible, printed copies of agency reports while protecting
2 9 the public's right to have access to such reports. It is the
2 10 intent of the general assembly that the distribution of a
2 11 printed mandatory report be used only when it is the most
2 12 efficient and cost-effective method for providing public
2 13 access to such report. It is the intent of the general
2 14 assembly that agency reports subject to this section be made
2 15 available, to the greatest extent possible, to the public by
2 16 electronic means.
2 17 4. The commission, in consultation with the division of
2 18 information technology services, shall make recommendations to
2 19 the governor and the general assembly for the continued
2 20 reduction of printed reports throughout state government in a
2 21 manner that protects the public's right to access such
2 22 reports.
2 23 Sec. 5. INFORMATION TECHNOLOGY DEPARTMENT DUTIES
2 24 CONDITIONED ON ENACTMENT. Notwithstanding the provisions of
2 25 this Act, if an information technology department and an
2 26 information technology council are created by enactment of the
2 27 general assembly during the 2000 regular legislative session,
2 28 and signed by the governor, all of the following apply:
2 29 1. The reference to the director of the division of
2 30 information technology services of the department of general
2 31 services in section 304.3, subsection 9, if enacted in this
2 32 Act, shall be corrected by the Code editor to refer to the
2 33 director of the information technology department.
2 34 2. The references to the division of information
2 35 technology services of the department of general services in
3 1 section 18.187 and section 304.13A, subsection 1, if enacted
3 2 in this Act, shall be corrected by the Code editor to refer to
3 3 the information technology council.
3 4 3. The reference to the division of information technology
3 5 services of the department of general services in section
3 6 304.13A, subsection 2, if enacted in this Act, shall be
3 7 corrected by the Code editor to refer to the information
3 8 technology department.
3 9 EXPLANATION
3 10 This bill provides that a state agency required to compile
3 11 and maintain a report, on and after July 1, 2001, is to
3 12 maintain such report in an electronic form, consistent with
3 13 standards for electronic records established by the division
3 14 of information technology services of the department of
3 15 general services. Such agency, by itself, or with the
3 16 assistance of the division of information technology services,
3 17 is to make the report accessible to the public through the
3 18 internet and other electronic means.
3 19 The bill provides that a copy of all required agency
3 20 reports shall be located at an internet site maintained by the
3 21 division of information technology services, in consultation
3 22 with the state librarian, and all required reports are to be
3 23 placed on electronic media with sufficient copies to permit
3 24 the state librarian to ensure equal access in public libraries
3 25 throughout the state. The state librarian is to provide for
3 26 the distribution of such copies, at a minimum, to all public
3 27 libraries in this state.
3 28 The bill provides that it is the intent of the general
3 29 assembly that the provisions of this bill be interpreted to
3 30 reduce, to the greatest extent possible, printed copies of
3 31 agency reports while protecting the public's right to have
3 32 access to such reports. The bill provides that it is the
3 33 intent of the general assembly that the distribution of a
3 34 printed mandatory report be used only when it is the most
3 35 efficient and cost-effective method for providing public
4 1 access to such report, and that agency reports subject to this
4 2 section be made available, to the greatest extent possible, to
4 3 the public by electronic means.
4 4 The bill provides that if an information technology
4 5 department is created by enactment of the general assembly
4 6 during the 2000 regular legislative session, and signed by the
4 7 governor, the Code editor is to change references to the
4 8 director of the division of information technology services of
4 9 the department of general services to the director of the
4 10 information technology department, and references to the
4 11 division of information technology services of the department
4 12 of general services to the information technology department
4 13 or the information technology council, as provided.
4 14 The bill also adds the director of the division of
4 15 information technology services of the department of general
4 16 services as a member of the state records commission.
