1 1 Section 1. Section 256D.8, subsections 1 and 3, Code
1 2 Supplement 1999, are amended to read as follows:
1 3 1. Except as provided in subsection 2, a school district
1 4 shall expend funds received pursuant to section 256D.5,
1 5 subsection 2, for the acquisition, lease, lease-purchase,
1 6 installation, and maintenance of instructional technology
1 7 equipment, including hardware and software, materials and
1 8 supplies related to instructional technology, and staff
1 9 development and training related to instructional technology,
1 10 and shall establish priorities for the use of the funds.
1 11 However, funds received by a school district pursuant to
1 12 section 256D.5, subsection 2, shall not be expended to add a
1 13 full-time equivalent position or otherwise increase staffing,
1 14 unless the school district expends not more than ten percent
1 15 of the funds received to employ or enter into a contract with
1 16 information technology specialists to provide technical
1 17 consulting and integration of technology in curriculum and
1 18 instruction to advance student achievement.
1 19 3. Funds received by an area education agency pursuant to
1 20 section 256D.6, subsection 2, shall be expended for the costs
1 21 related to supporting school districts within the area served
1 22 with technology planning and equipment, including hardware and
1 23 software, materials and supplies related to instructional
1 24 technology, employment of or contracting with information
1 25 technology specialists to provide technical consulting and
1 26 integration of technology in curriculum and instruction, and
1 27 staff development and training related to instructional
1 28 technology.
1 29 Sec. 2. Section 295.4, Code 1999, is amended to read as
1 30 follows:
1 31 295.4 SCHOOL IMPROVEMENT AND TECHNOLOGY EXPENDITURES.
1 32 1. School districts, as defined in section 295.2,
1 33 subsection 8, shall expend funds received pursuant to section
1 34 295.2 for the acquisition, lease, lease-purchase,
1 35 installation, and maintenance of instructional technology
2 1 equipment, including hardware and software, materials and
2 2 supplies related to instructional technology, and staff
2 3 development and training related to instructional technology,
2 4 and shall establish priorities for the use of the funds.
2 5 However, funds received by a school district pursuant to
2 6 section 295.2 shall not be expended to add a full-time
2 7 equivalent position or otherwise increase staffing, unless the
2 8 school district expends not more than ten percent of the funds
2 9 received to employ or enter into a contract with information
2 10 technology specialists to provide technical consulting and
2 11 integration of technology in curriculum and instruction to

2 23 EXPLANATION
2 24 This bill permits a school district or area education
2 25 agency to employ or contract with information technology
2 26 specialists to provide technical consulting and integration of
2 27 technology in curriculum and instruction, using state
2 28 technology funds allocated to school districts and area
2 29 education agencies.
2 30 Code chapter 295, which establishes the school improvement
2 31 and technology program and sunsets on July 1, 2001, and Code
2 32 chapter 256D, which establishes the school improvement
2 33 technology block grant program and funds the program from
2 34 fiscal year 2001-2002 through 2003-2004, both use similar
2 35 language to set forth permissible expenditures of funds
3 1 received by school districts and area education agencies under
3 2 the programs. Currently, language in the Code prohibits
3 3 school districts from using technology funds to add a full-
3 4 time equivalent position or otherwise increase staffing. The
3 5 current Code language does not specifically permit or prohibit
3 6 an area education agency from using its technology funds to
3 7 increase staffing.
