PAG LIN 1 1 Section 1. Section 341A.18, unnumbered paragraph 8, Code 1 2 1999, is amended to read as follows: 1 3 An officer or employee subject to civil service and a chief 1 4 deputy sheriff or second deputy sheriff, who becomes a 1 5 candidate for a partisan elective office for remuneration, 1 6 unless the candidate is running unopposed or the incumbent is 1 7 not a candidate, shall automatically be given a leave of 1 8 absence without pay, commencing thirty days before the date of 1 9 the primary election and continuing until the person is 1 10 eliminated as a candidate or wins the primary, and commencing 1 11 thirty days before the date of the general election and 1 12 continuing until the person is eliminated as a candidate or 1 13 wins the general election, and during the leave period shall 1 14 not perform any duties connected with the office or position 1 15 so held. The officer or employee subject to civil service, or 1 16 chief deputy sheriff or second deputy sheriff, may, however, 1 17 use accumulated paid vacation time for part or all oftheany 1 18 leave of absence required under this section. The county 1 19 shall continue to provide health benefit coverages, and may 1 20 continue to provide other fringe benefits, to any officer or 1 21 employee subject to civil service, or to any chief deputy 1 22 sheriff or second deputy sheriff during any leave of absence 1 23 required under this section. 1 24 Sec. 2. EFFECTIVE DATE. This Act, being deemed of 1 25 immediate importance, takes effect upon enactment. 1 26 EXPLANATION 1 27 This bill provides that a civil service officer or employee 1 28 or a chief deputy sheriff or second deputy sheriff may be a 1 29 candidate for a paid partisan elective office without taking a 1 30 mandatory leave of absence without pay if the officer, 1 31 employer, or deputy sheriff is an unopposed candidate or if 1 32 the incumbent is not a candidate for the office. Under Code 1 33 section 55.4, a county civil service employee who is a 1 34 candidate for elective office may request a leave of absence 1 35 commencing 30 days before a contested election and ending the 2 1 second day after the election.
