Senate Study Bill 3141

  1  1    Section 1.  Section 546.2, subsection 2, Code 1999, is
  1  2 amended to read as follows:
  1  3    2.  The chief administrative officer of the department is
  1  4 the director.  The director shall be appointed annually by the
  1  5 governor from among those individuals who serve as heads of
  1  6 the divisions within the department.  The appointment shall
  1  7 rotate among the division heads such that the division head of
  1  8 any one division shall not be appointed to be the director for
  1  9 a second year until such time as each division head has served
  1 10 as the director.  A division head appointed to be the director
  1 11 shall fulfill the responsibilities and duties of the director
  1 12 in addition to the individual's responsibilities and duties as
  1 13 the head of a division.  However, the administrator of the
  1 14 alcoholic beverages division shall serve as director until
  1 15 June 30, 1995.  The director shall serve at the pleasure of
  1 16 the governor.  If the office of director becomes vacant, the
  1 17 vacancy shall be filled in the same manner as the original
  1 18 appointment was made.  
  1 19                           EXPLANATION
  1 20    This bill provides for the appointment of the director of
  1 21 the department of commerce by the governor from among the
  1 22 division heads within the department.  The bill provides that
  1 23 the director shall serve at the pleasure of the governor.
  1 24 Currently, the director of the department is chosen annually
  1 25 by the governor from among the division heads within the
  1 26 department on a rotating basis.
