1 1 Section 1. Section 455B.301, Code 1999, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 21. "Transfer station" means a fixed or
1 4 mobile intermediate sanitary disposal project for transferring
1 5 loads of solid waste, with or without reduction of volume, to
1 6 another transportation unit.
1 7 Sec. 2. Section 455B.305A, subsection 1, unnumbered
1 8 paragraph 1, Code 1999, is amended to read as follows:
1 9 Prior to the siting of a proposed, new sanitary landfill,
1 10 transfer station, incinerator, or infectious medical waste
1 11 incinerator, a city, county, or private agency, shall submit a
1 12 request for local siting approval to the city council or
1 13 county board of supervisors which governs the city or county
1 14 in which the proposed site is to be located. The requirements
1 15 of this section do not apply to the expansion of an existing
1 16 sanitary landfill owned by a private agency which disposes of
1 17 waste which the agency generates on property owned by the
1 18 agency. The city council or county board of supervisors shall
1 19 approve or disapprove the site for each sanitary landfill,
1 20 transfer station, or incinerator, or infectious medical waste
1 21 incinerator.
1 22 Sec. 3. Section 455B.305A, subsection 2, unnumbered
1 23 paragraph 1, Code 1999, is amended to read as follows:
1 24 An applicant for siting approval shall submit information
1 25 to the city council or county board of supervisors to
1 26 demonstrate compliance with the requirements prescribed by
1 27 this chapter regarding a sanitary landfill, transfer station,
1 28 or infectious waste incinerator. Siting approval shall be
1 29 granted only if the proposed project meets all of the
1 30 following criteria:
1 31 EXPLANATION
1 32 This bill defines a solid waste transfer station in Code
1 33 section 455B.301 as a type of sanitary disposal project for
1 34 transferring loads of solid waste, with or without reduction
1 35 in volume, to another transportation unit. The bill adds
2 1 transfer stations in Code section 455B.305A to the siting
2 2 requirements which are currently in place for sanitary
2 3 landfill and infectious waste incinerator projects.
