  1  1    Section 1.  NEW SECTION.  148A.7  PROFESSIONAL PRACTICE
  1  2 RESTRICTION.
  1  3    Notwithstanding section 148A.3, subsection 1, a person,
  1  4 including a licensed health care provider engaged in the
  1  5 practice of the provider's profession, shall not represent
  1  6 that the person is providing physical therapy, physiotherapy,
  1  7 or to use any other words which indicate or suggest that the
  1  8 person is a physical therapist unless that person has obtained
  1  9 from the department a license pursuant to this chapter.
  1 10    Sec. 2.  Section 151.1, subsection 3, Code Supplement 1999,
  1 11 is amended to read as follows:
  1 12    3.  Persons utilizing differential diagnosis and related
  1 13 procedures, withdrawing or ordering withdrawal of the
  1 14 patient's blood for diagnostic purposes, performing or
  1 15 utilizing routine laboratory tests, performing physical
  1 16 examinations, rendering nutritional advice, utilizing
  1 17 chiropractic physiotherapy modalities and procedures, all of
  1 18 which are subject to and authorized by section 151.8.
  1 19    Sec. 3.  NEW SECTION.  151.13  LIMITATIONS.
  1 20    A license to practice chiropractic shall not authorize the
  1 21 licensee to practice or represent that the licensee practices
  1 22 physical therapy, physiotherapy, or to use any other words
  1 23 indicating or implying that the person is a physical therapist
  1 24 unless that person has obtained a license from the department
  1 25 pursuant to chapter 148A.  Nothing in this section shall
  1 26 restrict the utilization of modalities and procedures
  1 27 authorized pursuant to this chapter in the practice of
  1 28 chiropractic.  
  1 29                           EXPLANATION
  1 30    This bill provides for changes relating to authorization to
  1 31 perform, or representing that a person performs, physical
  1 32 therapy or physiotherapy.  The bill provides that a person,
  1 33 including a licensed health care provider engaged in the
  1 34 practice of the provider's profession, is not permitted to
  1 35 represent that the person provides physical therapy or
  2  1 physiotherapy, or use any other words to indicate or suggest
  2  2 that the person is a physical therapist unless that person has
  2  3 obtained a license pursuant to Code chapter 148A.  This
  2  4 provision is added to the physical therapy licensure
  2  5 provisions in Code chapter 148A and to the chiropractic
  2  6 licensure provisions in Code chapter 151.
  2  7    The bill also provides for a consistent change in
  2  8 terminology regarding authorized procedures included within
  2  9 the chiropractic scope of practice.  The utilization of
  2 10 chiropractic physiotherapy procedures is currently included
  2 11 within the chiropractic scope of practice.  The bill replaces
  2 12 this term with the term "chiropractic modalities" to
  2 13 differentiate chiropractic from the practice of physical
  2 14 therapy.
