PAG LIN 1 1 Section 1. Section 903A.5, unnumbered paragraph 2, Code 1 2 Supplement 1999, is amended to read as follows: 1 3 An inmate shall not receive credit upon the inmate's 1 4 sentence for time spent in custody in another state resisting 1 5 return to Iowa following an escape, or for time served. 1 6 However, an inmate shall receive credit upon the inmate's 1 7 sentence while incarcerated in an institution or jail of 1 8 another jurisdiction during any period of time the person is 1 9 receiving credit upon a sentence of that other jurisdiction. 1 10 EXPLANATION 1 11 Existing law prohibits an inmate who is incarcerated in 1 12 another jurisdiction from receiving credit upon the inmate's 1 13 Iowa sentence if the inmate is also receiving credit upon the 1 14 inmate's sentence in the other jurisdiction. 1 15 This bill provides that an inmate incarcerated in another 1 16 jurisdiction shall receive credit upon the inmate's Iowa 1 17 sentence if the inmate is receiving credit upon a sentence in 1 18 that other jurisdiction. Generally, an inmate would receive 1 19 one day of credit on the inmate's Iowa sentence for one day 1 20 served in the other jurisdiction. 1 21 LSB 5065IC 78 1 22 jm/gg/8.1
