PAG LIN 1 1 Section 1. Section 392.6, unnumbered paragraph 2, Code 1 2 Supplement 1999, is amended to read as follows: 1 3 Cities maintaining an institution as provided for in this 1 4 section which have a board of trustees consisting of three or 1 5 five members may by ordinance increase the number of members 1 6 to five or sevenand. The ordinance shall provide for the 1 7 appointment of one additional member in the expansion of a 1 8 three-member board to a five-member board or in the expansion 1 9 of a five-member board to a seven-member board, or for the 1 10 appointment of two additional members in the expansion of a 1 11 three-member board to a seven-member board until the next 1 12 succeeding general or city election, and for the appointment 1 13 of the one or two other additional members until the second 1 14 succeeding general or city election. Thereafter, the terms of 1 15 office of such additional members shall be four years. 1 16 However, if a city has adopted an ordinance which increases 1 17 the number of members of the board of trustees to five or 1 18 seven members and the terms of office of four of the five 1 19 members or six of the seven members end in the same year, the 1 20 date of expiration of the term of one of the four members or 1 21 two of the six members, to be determined by lot, shall be 1 22 extended by an additional two years. 1 23 EXPLANATION 1 24 This bill provides that when the number of hospital board 1 25 of trustees increases from three to five members, or from five 1 26 to seven members, one of the two additional members shall 1 27 serve until the next succeeding general or city election. The 1 28 other additional member serves until the second succeeding 1 29 election. If the board expands from three members to seven, 1 30 then two additional members will serve until the next 1 31 election. Under current law, expansion to seven members from 1 32 a five-member board requires that two of the additional 1 33 members serve until the next succeeding election, preventing 1 34 the staggering of terms as provided for other expansions. 1 35 LSB 5761SC 78 2 1 ec/cf/24
