  1  1    Section 1.  Section 321.180B, subsection 2, unnumbered
  1  2 paragraph 1, Code 1999, is amended to read as follows:
  1  3    The department may issue an intermediate driver's license
  1  4 to a person sixteen or seventeen years of age who possesses an
  1  5 instruction permit issued under subsection 1 or a comparable
  1  6 instruction permit issued by another state for a minimum of
  1  7 six months immediately preceding application, and who presents
  1  8 an affidavit signed by a parent or guardian on a form to be
  1  9 provided by the department that the permittee has accumulated
  1 10 a total of twenty hours of street or highway driving of which
  1 11 two hours were conducted after sunset and before sunrise and
  1 12 the street or highway driving was with the permittee's parent,
  1 13 guardian, instructor, a person certified by the department, or
  1 14 a person at least twenty-five years of age who had written
  1 15 permission from a parent or guardian to accompany the
  1 16 permittee, and whose driving privileges have not been
  1 17 suspended, revoked, or barred under this chapter or chapter
  1 18 321J during, and who has been accident and conviction free
  1 19 continuously for, the six-month period immediately preceding
  1 20 the application for an intermediate license.  An applicant for
  1 21 an intermediate license must meet the requirements of section
  1 22 321.186, including satisfactory completion of driver education
  1 23 as required in section 321.178, and payment of the required
  1 24 license fee before an intermediate license will be issued.  A
  1 25 person issued an intermediate license must limit the number of
  1 26 passengers in the motor vehicle when the intermediate licensee
  1 27 is operating the motor vehicle to the number of passenger
  1 28 safety belts.
  1 29    Sec. 2.  Section 321.180B, subsection 4, Code 1999, is
  1 30 amended to read as follows:
  1 31    4.  FULL DRIVER'S LICENSE.  A full driver's license may be
  1 32 issued to a person seventeen years of age who possesses an
  1 33 intermediate license issued under subsection 2 or a comparable
  1 34 intermediate license issued by another state for a minimum of
  1 35 twelve months immediately preceding application, and who
  2  1 presents an affidavit signed by a parent or guardian on a form
  2  2 to be provided by the department that the intermediate
  2  3 licensee has accumulated a total of ten hours of street or
  2  4 highway driving of which two hours were conducted after sunset
  2  5 and before sunrise and the street or highway driving was with
  2  6 the licensee's parent, guardian, instructor, a person
  2  7 certified by the department, or a person at least twenty-five
  2  8 years of age who had written permission from a parent or
  2  9 guardian to accompany the licensee, whose driving privileges
  2 10 have not been suspended, revoked, or barred under this chapter
  2 11 or chapter 321J during, and who has been accident and
  2 12 conviction free continuously for, the twelve-month period
  2 13 immediately preceding the application for a full driver's
  2 14 license, and who has paid the required fee.
  2 15    Sec. 3.  EFFECTIVE DATE.  This Act, being deemed of
  2 16 immediate importance, takes effect upon enactment.  
  2 17                           EXPLANATION 
  2 18    This bill amends Code section 321.180B, relating to
  2 19 graduated driver's licenses for persons aged 14 through 17
  2 20 years.  The bill allows an instruction permit or an
  2 21 intermediate driver's license issued by another state which
  2 22 has comparable requirements to an instruction permit or
  2 23 intermediate license issued in this state to be used to meet
  2 24 the requirements for obtaining an intermediate driver's
  2 25 license or a full driver's license in this state.
  2 26    The bill also requires that the possession of an
  2 27 instruction permit or intermediate driver's license for a
  2 28 designated period of time by an applicant for an intermediate
  2 29 driver's license or full driver's license must occur
  2 30 immediately preceding application for the respective license.
