PAG LIN 1 1 Section 1. Section 262.2, Code 1999, is amended to read as 1 2 follows: 1 3 262.2 APPOINTMENT TERM OF OFFICE. 1 4 1. The members shall be appointed by the governor subject 1 5 to confirmation by the senate.TheExcept for the student 1 6 member, the term of each member of the board shall be for six 1 7 years, staggered so that not all terms expire at the same 1 8 time. The terms ofthreethe members of the board shall begin 1 9 and expire ineachan odd-numbered yearason the dates 1 10 provided in section 69.19. A vacancy shall be filled in the 1 11 same manner as the original appointment and shall be for the 1 12 remainder of the unexpired term. 1 13 2. The term of the student member of the board shall be 1 14 for two years. The student member must remain enrolled on a 1 15 full-time basis in good standing at either the graduate or 1 16 undergraduate level at one of the institutions listed in 1 17 section 262.7, subsection 1, 2, or 3, throughout the student's 1 18 term of office. An appointment for a full term shall be made 1 19 in a manner so that at the time of appointment the student 1 20 member appointed is not enrolled in the same institution as 1 21 the student whose term is expiring. However, a vacancy shall 1 22 be filled in the same manner as the original appointment is 1 23 made and shall be for the remainder of the unexpired term. 1 24 Sec. 2. CONTINGENT EFFECTIVE DATE. This Act takes effect 1 25 upon a vacancy or expiration of the term of the student member 1 26 of the state board of regents holding office as of the 1 27 enactment date of this Act, whichever is earlier. If a 1 28 vacancy occurs in the term of that student member before the 1 29 member's term expires, the term shall expire on April 30 of 1 30 the soonest odd-numbered year. Notwithstanding section 262.2, 1 31 subsection 2, as enacted by this Act, a student appointed to 1 32 fill the vacancy in an unexpired term as provided in this 1 33 section may also be appointed to fill a full two-year term as 1 34 the student member of the board. The state board of regents 1 35 shall notify the Code editor upon the vacancy or expiration of 2 1 the term of the student member holding office as of the 2 2 enactment date of this Act. 2 3 EXPLANATION 2 4 This bill relates to the student member of the state board 2 5 of regents by amending Code section 262.2, relating to the 2 6 appointment and terms of the members of the board. 2 7 Under current law, the term of office of all members of the 2 8 state board of regents is six years. The bill provides the 2 9 term for the student member of the board would be two years. 2 10 Current law provides that at the time of appointment the 2 11 student member must be a full-time student in good standing at 2 12 the university of Iowa, Iowa state university, or the 2 13 university of northern Iowa. The bill requires the student to 2 14 maintain this qualification throughout the student's term on 2 15 the board. The bill also provides that once the student 2 16 member's term expires, the next student appointed must be 2 17 enrolled in a different regents institution than was the 2 18 student whose term expired. 2 19 Current law provides for terms of three board members to 2 20 begin and end in each odd-numbered year. With the student 2 21 member moving to a two-year term, this will no longer be 2 22 possible. The bill provides that terms should be staggered 2 23 and that a vacancy on the board is filled for the remainder of 2 24 the unexpired term. 2 25 The bill includes a contingent effective date. The bill 2 26 would not take effect until the term of the current student 2 27 member of the board expires or the student member vacates the 2 28 appointment. If such a vacancy occurs, that term will expire 2 29 on April 30 of the soonest odd-numbered year. The state board 2 30 is to notify the Code editor in either event. 2 31 LSB 2458XC 78 2 32 jp/sc/14
