PAG LIN 1 1 Section 1. Section 147.13, subsection 8, Code 1999, is 1 2 amended to read as follows: 1 3 8. For dentistryand, dental hygiene, and dental 1 4 assisting, dental examiners. 1 5 Sec. 2. Section 147.80, Code 1999, is amended by adding 1 6 the following new subsection: 1 7 NEW SUBSECTION. 27A. Registration to practice as a dental 1 8 assistant, registration to practice as a dental assistant 1 9 under a reciprocal agreement, or renewal of registration to 1 10 practice as a dental assistant. 1 11 Sec. 3. Section 153.14, Code 1999, is amended by adding 1 12 the following new subsection: 1 13 NEW SUBSECTION. 5. Persons registered as dental 1 14 assistants who are exclusively engaged in the practice of said 1 15 profession. 1 16 Sec. 4. NEW SECTION. 153.16A DENTAL ASSISTANTS. 1 17 1. A person shall not practice as a dental assistant 1 18 unless the person has registered with the board of dental 1 19 examiners and received a certificate of registration pursuant 1 20 to this subsection. A person shall be registered in 1 21 accordance with one of the following: 1 22 a. As a registered dental assistant upon successful 1 23 completion of education requirements, examination 1 24 requirements, or both, as established by the board by rule. 1 25 Education requirements shall include classes in infection 1 26 control, hazardous materials, and jurisprudence, and shall 1 27 also include possession of a valid certificate in a nationally 1 28 recognized course in cardiopulmonary resuscitation. 1 29 b. As a certified dental assistant, in addition to the 1 30 requirements of paragraph "a", upon submission to the board of 1 31 a valid certified dental assistant credential issued by the 1 32 national board of dental assisting. 1 33 c. As an expanded-function dental assistant, in addition 1 34 to the requirements of paragraphs "a" and "b", upon successful 1 35 completion of a class in expanded functions approved by the 2 1 board. 2 2 2. The board shall establish scope of practice, 2 3 supervision, continuing education, and renewal requirements, 2 4 and shall specify circumstances resulting in registration 2 5 revocation or suspension, by rule. Requirements established 2 6 shall provide that a dental assistant registered pursuant to 2 7 the provisions of subsection 1 may perform only those 2 8 intraoral services which are mechanical in nature and require 2 9 limited judgment, and shall not perform services involving the 2 10 removal of any plaque, stain, calculus, or hard natural or 2 11 synthetic material except by rubber cup coronal polish; 2 12 administration of local anesthesia; and placement of sealants. 2 13 3. Individuals employed as a dental assistant as of July 2 14 1, 2000, shall have until September 1, 2000, to comply with 2 15 the provisions of subsection 1. Individuals employed as a 2 16 dental assistant after July 1, 2000, shall have a sixty-day 2 17 period following their first date of employment after July 1, 2 18 2000, to comply with the provisions of subsection 1. 2 19 Sec. 5. Section 153.34, unnumbered paragraph 1, Code 1999, 2 20 is amended to read as follows: 2 21 The board may issue an order to discipline a licensed 2 22 dentist or dental hygienist, or registered dental assistant, 2 23 for any of the grounds set forth in this chapter, chapter 2 24 272C, or Title IV. Notwithstanding section 272C.3, licensee 2 25 or registrant discipline may include a civil penalty not to 2 26 exceed ten thousand dollars. Pursuant to this section, the 2 27 board may discipline a licensee for any of the following 2 28 reasons: 2 29 Sec. 6. Section 153.34, Code 1999, is amended by adding 2 30 the following new unnumbered paragraph: 2 31 NEW UNNUMBERED PARAGRAPH. The board may discipline a 2 32 registered dental assistant for violation of any applicable 2 33 provision of this section. 2 34 Sec. 7. EFFECTIVE DATE. This Act takes effect July 1, 2 35 2000. 3 1 EXPLANATION 3 2 This bill provides that beginning July 1, 2000, an 3 3 individual must become registered with the board of dental 3 4 examiners to perform the services of a dental assistant. 3 5 Registration may take one of three forms. In order to be 3 6 considered a registered dental assistant, an individual must 3 7 successfully complete education and examination requirements 3 8 as established by the board by rule, which would include 3 9 classes in infection control, hazardous materials, and 3 10 jurisprudence, and also possess a valid certificate in a 3 11 nationally recognized course in cardiopulmonary resuscitation. 3 12 To be considered a certified dental assistant, in addition to 3 13 the requirements for a registered dental assistant, an 3 14 individual must submit to the board a valid certified dental 3 15 assistant credential issued by the national board of dental 3 16 assisting. To be considered an expanded-function dental 3 17 assistant, in addition to the requirements for a registered 3 18 dental assistant and certified dental assistant, an individual 3 19 must successfully complete a class in expanded functions 3 20 approved by the board. 3 21 The bill also provides that the board shall establish scope 3 22 of practice, supervision, renewal, and continuing education 3 23 requirements, and circumstances resulting in registration 3 24 revocation or suspension, for registered, certified, or 3 25 expanded-function dental assistants by rule. The requirements 3 26 would include provisions that a registered dental assistant 3 27 may perform only those intraoral services which are mechanical 3 28 in nature and require limited judgment, and shall not perform 3 29 services involving the removal of any plaque, stain, calculus, 3 30 or hard natural or synthetic material except by rubber cup 3 31 coronal polish; administration of local anesthesia; and 3 32 placement of sealants. 3 33 A registered dental assistant would be subject to the 3 34 penalty prescribed in Code section 147.86 of a serious 3 35 misdemeanor for violation of any applicable provision of Code 4 1 chapters 147 and 153, and would also be subject to the 4 2 disciplinary provisions of Code section 153.34, determined by 4 3 the board of dental examiners to apply to the practice of 4 4 dental assisting. 4 5 The bill additionally provides that individuals employed as 4 6 a dental assistant as of July 1, 2000, must become registered 4 7 by September 1, 2000, and that individuals first employed 4 8 after July 1, 2000, must become registered within 60 days 4 9 following their first date of employment. 4 10 The bill takes effect July 1, 2000. 4 11 LSB 1841SC 78 4 12 rn/gg/8 4 13
