  1  1    Section 1.  The following amendment to the Constitution of
  1  2 the State of Iowa is proposed:
  1  3    1.  Section 3 of Article III of the Constitution of the
  1  4 State of Iowa is repealed and the following adopted in lieu
  1  5 thereof:
  1  6    REPRESENTATIVES.  Sec. 3.  The members of the House of
  1  7 Representatives shall be chosen every second year, by the
  1  8 qualified electors of their respective districts, and their
  1  9 term of office shall commence on the first day of January next
  1 10 after their election, and continue two years, and until their
  1 11 successors are elected and qualified.  A person shall not be
  1 12 elected for a term as Representative if the term would result
  1 13 in more than a total of twelve years of service as a
  1 14 Representative.  If a person is elected to serve a portion of
  1 15 a term to which some other person was elected but that person
  1 16 died in office or resigned from office or was otherwise
  1 17 removed from office, those years served shall not be included
  1 18 in the years of service for purposes of this limitation.  This
  1 19 limitation on the years of service shall only apply to terms
  1 20 of office beginning on or after January 1, 2003.
  1 21    2.  Section 5 of Article III of the Constitution of the
  1 22 State of Iowa is repealed and the following adopted in lieu
  1 23 thereof:
  1 24    SENATORS – QUALIFICATIONS.  Sec. 5.  Senators shall be
  1 25 chosen for a term of four years, at the same time and place as
  1 26 Representatives; they shall be twenty-five years of age, and
  1 27 possess the qualifications of Representatives as to residence
  1 28 and citizenship.  A person shall not be elected for a term as
  1 29 Senator if the term would result in more than a total of
  1 30 twelve years of service as a Senator.  If a person is elected
  1 31 to serve a portion of a term to which some other person was
  1 32 elected but that person died in office or resigned from office
  1 33 or was otherwise removed from office, those years served shall
  1 34 not be included in the years of service for purposes of this
  1 35 limitation.  This limitation on the years of service shall
  2  1 only apply to terms of office beginning on or after January 1,
  2  2 2003.
  2  3    3.  Section 2 of Article IV of the Constitution of the
  2  4 State of Iowa, as amended by amendment number 1 of the
  2  5 Amendments of 1972 and amendment number 1 of the Amendments of
  2  6 1988, is repealed and the following adopted in lieu thereof:
  2  7    ELECTION AND TERM.  Sec. 2.  The Governor and the
  2  8 Lieutenant Governor shall be elected by the qualified electors
  2  9 at the time and place of voting for members of the General
  2 10 Assembly.  Each of them shall hold office for four years from
  2 11 the time of installation in office and until a successor is
  2 12 elected and qualifies.  A person shall not be elected Governor
  2 13 or Lieutenant Governor if the term would result in more than a
  2 14 total of twelve years of service in that office.  If a person
  2 15 is elected or appointed to serve a portion of a term to which
  2 16 some other person was elected or appointed but that person
  2 17 died in office or resigned from office or was otherwise
  2 18 removed from office, those years served shall not be included
  2 19 in the years of service for purposes of this limitation.  This
  2 20 limitation on the years of service shall only apply to terms
  2 21 of office beginning on or after January 1, 2003.
  2 22    4.  Section 22 of Article IV of the Constitution of the
  2 23 State of Iowa, as amended by amendment number 1 of the
  2 24 Amendments of 1972, is repealed and the following adopted in
  2 25 lieu thereof:
  2 26    SECRETARY – AUDITOR – TREASURER.  Sec. 22.  A Secretary
  2 27 of State, an Auditor of State, and a Treasurer of State shall
  2 28 be elected by the qualified electors at the same time that the
  2 29 Governor is elected and for a four-year term commencing on the
  2 30 first day of January next after their election, and they shall
  2 31 perform such duties as may be provided by law.  A person shall
  2 32 not be elected Secretary of State if the term would result in
  2 33 more than a total of twelve years of service as Secretary of
  2 34 State.  A person shall not be elected Auditor of State if the
  2 35 term would result in more than a total of twelve years of
  3  1 service as Auditor of State.  A person shall not be elected
  3  2 Treasurer of State if the term would result in more than a
  3  3 total of twelve years of service as Treasurer of State.  If a
  3  4 person is elected or appointed to serve a portion of a term to
  3  5 which some other person was elected or appointed but that
  3  6 person died in office or resigned from office or was otherwise
  3  7 removed from office, those years served shall not be included
  3  8 in the years of service for purposes of this limitation.  This
  3  9 limitation on the years of service shall only apply to terms
  3 10 of office beginning on or after January 1, 2003.
  3 11    5.  Section 12 of Article V of the Constitution of the
  3 12 State of Iowa, as amended by amendment number 1 of the
  3 13 Amendments of 1972, is repealed and the following adopted in
  3 14 lieu thereof:
  3 15    ATTORNEY GENERAL.  Sec. 12.  The General Assembly shall
  3 16 provide, by law, for the election of an Attorney General by
  3 17 the people, whose term of office shall be four years, and
  3 18 until a successor is elected and qualifies.  A person shall
  3 19 not be elected Attorney General if the term would result in
  3 20 more than a total of twelve years of service as Attorney
  3 21 General.  If a person is elected or appointed to serve a
  3 22 portion of a term to which some other person was elected or
  3 23 appointed but that person died in office or resigned from
  3 24 office or was otherwise removed from office, those years
  3 25 served shall not be included in the years of service for
  3 26 purposes of this limitation.  This limitation on the years of
  3 27 service shall only apply to terms of office beginning on or
  3 28 after January 1, 2003.
  3 29    Sec. 2.  The foregoing amendment to the Constitution of the
  3 30 State of Iowa is referred to the General Assembly to be chosen
  3 31 at the next general election for members of the General
  3 32 Assembly and the Secretary of State is directed to cause the
  3 33 same to be published for three consecutive months previous to
  3 34 the date of that election as provided by law.  
  3 35                           EXPLANATION
  4  1    This joint resolution proposes an amendment to the
  4  2 Constitution of the State of Iowa to provide that members of
  4  3 the Iowa house of representatives shall not serve more than 12
  4  4 years as a representative and that members of the Iowa senate
  4  5 shall not serve more than 12 years as a senator.  If a person
  4  6 serves a portion of a term to which some other person was
  4  7 elected, the partial term shall not be included in the years
  4  8 of service.  The limitation on the years of service shall only
  4  9 apply to terms of office beginning on or after January 1,
  4 10 2003.
  4 11    The amendment also provides that persons elected to the
  4 12 office of governor, lieutenant governor, attorney general,
  4 13 secretary of state, auditor of state, and treasurer of state
  4 14 are limited to 12 years in each office.  If a person serves a
  4 15 portion of a term to which some other person was elected or
  4 16 appointed, the partial term shall not be included in the years
  4 17 of service.  The limitation on the years of service shall only
  4 18 apply to terms of office beginning on or after January 1,
  4 19 2003.
  4 20    The resolution, if adopted, would be referred to the next
  4 21 general assembly before being submitted to the electorate for
  4 22 ratification.
