  1  4 RELATING TO THE COMPENSATION AND BENEFITS FOR PUBLIC OFFICIALS
  1  5    AND EMPLOYEES, PROVIDING FOR RELATED MATTERS, AND MAKING
  1  6    APPROPRIATIONS.
  1  7 
  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  STATE COURTS – JUSTICES, JUDGES, AND
  1 11 MAGISTRATES.
  1 12    1.  The salary rates specified in subsection 2 are for the
  1 13 fiscal year beginning July 1, 2000, effective for the pay
  1 14 period beginning June 23, 2000, and for subsequent fiscal
  1 15 years until otherwise provided by the general assembly.  The
  1 16 salaries provided for in this section shall be paid from funds
  1 17 appropriated to the judicial branch from the salary adjustment
  1 18 fund or if the appropriation is not sufficient, from the funds
  1 19 appropriated to the judicial branch pursuant to any Act of the
  1 20 general assembly.
  1 21    2.  The following annual salary rates shall be paid to the
  1 22 persons holding the judicial positions indicated during the
  1 23 fiscal year beginning July 1, 2000, effective with the pay
  1 24 period beginning June 23, 2000, and for subsequent pay
  1 25 periods.
  1 26    a.  Chief justice of the supreme court:

  2 14    Sec. 2.  SALARY RATE LIMITS.  Persons receiving the salary
  2 15 rates established under section 1 of this Act shall not
  2 16 receive any additional salary adjustments provided by this
  2 17 Act.
  2 18    Sec. 3.  ELECTIVE EXECUTIVE OFFICIALS.
  2 19    1.  The annual salary rates specified in this section are
  2 20 effective for the fiscal year beginning July 1, 2000, with the
  2 21 pay period beginning June 23, 2000, and for subsequent fiscal
  2 22 years until otherwise provided by the general assembly.  The
  2 23 salaries provided for in this section shall be paid from funds
  2 24 appropriated to the department or agency specified in this
  2 25 section from the salary adjustment fund or if the
  2 26 appropriation is not sufficient, from the funds appropriated
  2 27 to the department or agency pursuant to any Act of the general
  2 28 assembly.
  2 29    2.  The following annual salary rates shall be paid to the
  2 30 person holding the position indicated:

  3 16    Sec. 4.  APPOINTED STATE OFFICERS.  The governor shall
  3 17 establish a salary for appointed nonelected persons in the
  3 18 executive branch of state government holding a position
  3 19 enumerated in section 5 of this Act within the range provided,
  3 20 by considering, among other items, the experience of the
  3 21 individual in the position, changes in the duties of the
  3 22 position, the incumbent's performance of assigned duties, and
  3 23 subordinates' salaries.  If a department charged with
  3 24 information technology is created by the general assembly, the
  3 25 governor shall establish a salary for the director of the
  3 26 department within salary range 9 as provided in section 5 of
  3 27 this Act.  However, the attorney general shall establish the
  3 28 salary for the consumer advocate, the chief justice of the
  3 29 supreme court shall establish the salary for the state court
  3 30 administrator, the ethics and campaign disclosure board shall
  3 31 establish the salary of the executive director, and the state
  3 32 fair board shall establish the salary of the secretary of the
  3 33 state fair board, each within the salary range provided in
  3 34 section 5 of this Act.
  3 35    The governor, in establishing salaries as provided in
  4  1 section 5 of this Act, shall take into consideration other
  4  2 employee benefits which may be provided for an individual
  4  3 including, but not limited to, housing.
  4  4    A person whose salary is established pursuant to section 5
  4  5 of this Act and who is a full-time, year-round employee of the
  4  6 state shall not receive any other remuneration from the state
  4  7 or from any other source for the performance of that person's
  4  8 duties unless the additional remuneration is first approved by
  4  9 the governor or authorized by law.  However, this provision
  4 10 does not exclude the reimbursement for necessary travel and
  4 11 expenses incurred in the performance of duties or fringe
  4 12 benefits normally provided to employees of the state.
  4 13    Sec. 5.  STATE OFFICERS – SALARY RATES AND RANGES.  The
  4 14 following annual salary ranges are effective for the positions
  4 15 specified in this section for the fiscal year beginning July
  4 16 1, 2000, and for subsequent fiscal years until otherwise
  4 17 provided by the general assembly.  The governor or other
  4 18 person designated in section 4 of this Act shall determine the
  4 19 salary to be paid to the person indicated at a rate within the
  4 20 salary ranges indicated from funds appropriated by the general
  4 21 assembly for that purpose.
  4 22    1.  The following are salary ranges 1 through 5 for the
  4 23 fiscal year beginning July 1, 2000, effective with the pay
  4 24 period beginning June 23, 2000:

  4 31    2.  The following are range 1 positions:  There are no
  4 32 range 1 positions for the fiscal year beginning July 1, 2000.
  4 33    3.  The following are range 2 positions:  administrator of
  4 34 the arts division of the department of cultural affairs,
  4 35 administrators of the division of persons with disabilities,
  5  1 the division on the status of women, the division on the
  5  2 status of African-Americans, the division of deaf services,
  5  3 and the division of Latino affairs of the department of human
  5  4 rights, and administrator of the division of professional
  5  5 licensing and regulation of the department of commerce.
  5  6    4.  The following are range 3 positions:  administrator of
  5  7 the division of emergency management of the department of
  5  8 public defense, administrator of the division of criminal and
  5  9 juvenile justice planning of the department of human rights,
  5 10 administrator of the division of community action agencies of
  5 11 the department of human rights, executive director of the
  5 12 commission of veterans affairs, and chairperson and members of
  5 13 the employment appeal board of the department of inspections
  5 14 and appeals.
  5 15    5.  The following are range 4 positions:  superintendent of
  5 16 banking, superintendent of credit unions, administrator of the
  5 17 alcoholic beverages division of the department of commerce,
  5 18 state public defender, and chairperson, vice chairperson, and
  5 19 members of the board of parole.
  5 20    6.  The following are range 5 positions:  consumer
  5 21 advocate, drug policy coordinator, labor commissioner,
  5 22 workers' compensation commissioner, administrator of the
  5 23 historical division of the department of cultural affairs,
  5 24 administrator of the public broadcasting division of the
  5 25 department of education, and commandant of the veterans home.
  5 26    7.  The following are salary ranges 6 through 9 for the
  5 27 fiscal year beginning July 1, 2000, effective with the pay
  5 28 period beginning June 23, 2000:

  5 34    8.  The following are range 6 positions:  director of the
  5 35 department of human rights, director of the Iowa state civil
  6  1 rights commission, executive director of the college student
  6  2 aid commission, director of the department for the blind, and
  6  3 executive director of the ethics and campaign disclosure
  6  4 board.
  6  5    9.  The following are range 7 positions:  director of the
  6  6 department of cultural affairs, director of the department of
  6  7 elder affairs, and director of the law enforcement academy.
  6  8    10.  The following are range 8 positions:  the
  6  9 administrator of the state racing and gaming commission of the
  6 10 department of inspections and appeals, director of the
  6 11 department of inspection and appeals, director of the
  6 12 department of general services, director of the department of
  6 13 personnel, commissioner of public safety, commissioner of
  6 14 insurance, executive director of the Iowa finance authority,
  6 15 director of revenue and finance, director of the department of
  6 16 natural resources, director of the department of corrections,
  6 17 and chairperson of the utilities board.  The other members of
  6 18 the utilities board shall receive an annual salary within a
  6 19 range of not less than 90 percent but not more than 95 percent
  6 20 of the annual salary of the chairperson of the utilities
  6 21 board.
  6 22    11.  The following are range 9 positions:  director of the
  6 23 department of education, director of human services, director
  6 24 of the department of economic development, executive director
  6 25 of the state board of regents, director of the state
  6 26 department of transportation, director of the department of
  6 27 workforce development, lottery commissioner, director of
  6 28 public health, the state court administrator, secretary of the
  6 29 state fair board, and the director of the department of
  6 30 management.
  6 31    Sec. 6.  PUBLIC EMPLOYMENT RELATIONS BOARD.
  6 32    1.  The salary rates specified in this section are
  6 33 effective for the fiscal year beginning July 1, 2000, with the
  6 34 pay period beginning June 23, 2000, and for subsequent fiscal
  6 35 years until otherwise provided by the general assembly.  The
  7  1 salaries provided for in this section shall be paid from funds
  7  2 appropriated to the public employment relations board from the
  7  3 salary adjustment fund, or if the appropriation is not
  7  4 sufficient from funds appropriated to the public employment
  7  5 relations board pursuant to any other Act of the general
  7  6 assembly.
  7  7    2.  The following annual salary rates shall be paid to the
  7  8 persons holding the positions indicated:
  7  9    a.  Chairperson of the public employment relations board:  
  7 10 .................................................. $     68,700
  7 11    b.  Two members of the public employment relations board:  
  7 12 .................................................. $     64,000
  7 13    Sec. 7.  COLLECTIVE BARGAINING AGREEMENTS FUNDED – GENERAL
  7 14 FUND.  There is appropriated from the general fund of the
  7 15 state to the salary adjustment fund for distribution by the
  7 16 department of management to the various state departments,
  7 17 boards, commissions, councils, and agencies, including the
  7 18 state board of regents, for the fiscal year beginning July 1,
  7 19 2000, and ending June 30, 2001, the amount of $42,173,997, or
  7 20 so much thereof as may be necessary, to fully fund the
  7 21 following annual pay adjustments, expense reimbursements, and
  7 22 related benefits:
  7 23    1.  The collective bargaining agreement negotiated pursuant
  7 24 to chapter 20 for employees in the blue collar bargaining
  7 25 unit.
  7 26    2.  The collective bargaining agreement negotiated pursuant
  7 27 to chapter 20 for employees in the public safety bargaining
  7 28 unit.
  7 29    3.  The collective bargaining agreement negotiated pursuant
  7 30 to chapter 20 for employees in the security bargaining unit.
  7 31    4.  The collective bargaining agreement negotiated pursuant
  7 32 to chapter 20 for employees in the technical bargaining unit.
  7 33    5.  The collective bargaining agreement negotiated pursuant
  7 34 to chapter 20 for employees in the professional fiscal and
  7 35 staff bargaining unit.
  8  1    6.  The collective bargaining agreement negotiated pursuant
  8  2 to chapter 20 for employees in the university of northern Iowa
  8  3 faculty bargaining unit.
  8  4    7.  The collective bargaining agreement negotiated pursuant
  8  5 to chapter 20 for employees in the clerical bargaining unit.
  8  6    8.  The collective bargaining agreement negotiated pursuant
  8  7 to chapter 20 for employees in the professional social
  8  8 services bargaining unit.
  8  9    9.  The collective bargaining agreement negotiated pursuant
  8 10 to chapter 20 for employees in the community-based corrections
  8 11 bargaining unit.
  8 12    10.  The collective bargaining agreement negotiated
  8 13 pursuant to chapter 20 for employees in the judicial branch of
  8 14 government bargaining unit.
  8 15    11.  The collective bargaining agreement negotiated
  8 16 pursuant to chapter 20 for employees in the patient care
  8 17 bargaining unit.
  8 18    12.  The collective bargaining agreement negotiated
  8 19 pursuant to chapter 20 for employees in the science bargaining
  8 20 unit.
  8 21    13.  The collective bargaining agreement negotiated
  8 22 pursuant to chapter 20 for employees in the state university
  8 23 of Iowa graduate student bargaining unit.
  8 24    14.  The collective bargaining agreement negotiated
  8 25 pursuant to chapter 20 for employees in the state university
  8 26 of Iowa hospital and clinics tertiary health care bargaining
  8 27 unit.
  8 28    15.  The annual pay adjustments, related benefits, and
  8 29 expense reimbursements referred to in sections 8 and 9 of this
  8 30 Act for employees not covered by a collective bargaining
  8 31 agreement.
  8 32    Sec. 8.  NONCONTRACT STATE EMPLOYEES – GENERAL.
  8 33    1.  a.  For the fiscal year beginning July 1, 2000, the
  8 34 maximum salary levels of all pay plans provided for in section
  8 35 19A.9, subsection 2, as they exist for the fiscal year ending
  9  1 June 30, 2000, shall be increased by 3 percent for the pay
  9  2 period beginning June 23, 2000, and any additional changes in
  9  3 the pay plans shall be approved by the governor.
  9  4    b.  For the fiscal year beginning July 1, 2000, employees
  9  5 may receive a step increase or the equivalent of a step
  9  6 increase.
  9  7    2.  The pay plans for state employees who are exempt from
  9  8 chapter 19A and who are included in the department of revenue
  9  9 and finance's centralized payroll system shall be increased in
  9 10 the same manner as provided in subsection 1, and any
  9 11 additional changes in any executive branch pay plans shall be
  9 12 approved by the governor.
  9 13    3.  This section does not apply to members of the general
  9 14 assembly, board members, commission members, salaries of
  9 15 persons set by the general assembly pursuant to this Act, or
  9 16 set by the governor, other persons designated in section 4 of
  9 17 this Act, employees designated under section 19A.3, subsection
  9 18 5, and employees covered by 581 IAC 4.6(3).
  9 19    4.  The pay plans for the bargaining eligible employees of
  9 20 the state shall be increased in the same manner as provided in
  9 21 subsection 1, and any additional changes in such executive
  9 22 branch pay plans shall be approved by the governor.  As used
  9 23 in this section, "bargaining eligible employee" means an
  9 24 employee who is eligible to organize under chapter 20, but has
  9 25 not done so.
  9 26    5.  The policies for implementation of this section shall
  9 27 be approved by the governor.
  9 28    Sec. 9.  STATE EMPLOYEES – STATE BOARD OF REGENTS.  Funds
  9 29 from the appropriation in section 7 of this Act shall be
  9 30 allocated to the state board of regents for the purposes of
  9 31 providing increases for state board of regents employees
  9 32 covered by section 7 of this Act and for employees not covered
  9 33 by a collective bargaining agreement as follows:
  9 34    1.  For regents merit system employees and merit
  9 35 supervisory employees to fund for the fiscal year, increases
 10  1 comparable to those provided for similar contract-covered
 10  2 employees in this Act.
 10  3    2.  For faculty members and professional and scientific
 10  4 employees to fund for the fiscal year, percentage increases
 10  5 comparable to those provided for contract-covered employees in
 10  6 section 7, subsection 6, of this Act.
 10  7    Sec. 10.  APPROPRIATIONS FROM ROAD FUNDS.
 10  8    1.  There is appropriated from the road use tax fund to the
 10  9 salary adjustment fund for the fiscal year beginning July 1,
 10 10 2000, and ending June 30, 2001, the following amount, or so
 10 11 much thereof as may be necessary, to be used for the purpose
 10 12 designated:
 10 13    To supplement other funds appropriated by the general
 10 14 assembly:  
 10 15 .................................................. $  1,113,641
 10 16    2.  There is appropriated from the primary road fund to the
 10 17 salary adjustment fund, for the fiscal year beginning July 1,
 10 18 2000, and ending June 30, 2001, the following amount, or so
 10 19 much thereof as may be necessary, to be used for the purpose
 10 20 designated:
 10 21    To supplement other funds appropriated by the general
 10 22 assembly:  
 10 23 .................................................. $  5,682,160
 10 24    3.  Except as otherwise provided in this Act, the amounts
 10 25 appropriated in subsections 1 and 2 shall be used to fund the
 10 26 annual pay adjustments, expense reimbursements, and related
 10 27 benefits for public employees as provided in this Act.
 10 28    Sec. 11.  SPECIAL FUNDS – AUTHORIZATION.  To departmental
 10 29 revolving, trust, or special funds, except for the primary
 10 30 road fund or the road use tax fund, for which the general
 10 31 assembly has established an operating budget, a supplemental
 10 32 expenditure authorization is provided, unless otherwise
 10 33 provided, in an amount necessary to fund salary adjustments as
 10 34 otherwise provided in this Act.
 10 35    Sec. 12.  GENERAL FUND SALARY MONEYS.  Funds appropriated
 11  1 from the general fund of the state in this Act relate only to
 11  2 salaries supported from general fund appropriations of the
 11  3 state.
 11  4    Sec. 13.  FEDERAL FUNDS APPROPRIATED.  All federal grants
 11  5 to and the federal receipts of the agencies affected by this
 11  6 Act which are received and may be expended for purposes of
 11  7 this Act are appropriated for those purposes and as set forth
 11  8 in the federal grants or receipts.
 11  9    Sec. 14.  USE OF SURPLUS HEALTH INSURANCE FUNDS.  The
 11 10 executive council shall transfer an amount, as determined by
 11 11 the department of management, from the health insurance
 11 12 surplus account to the health insurance premium operating
 11 13 account for the fiscal year beginning July 1, 2000, to reduce
 11 14 insurance premiums.  Any amount remaining in the health
 11 15 insurance premium operating account at the end of the fiscal
 11 16 year beginning July 1, 2000, shall be transferred to the
 11 17 health insurance surplus account.
 11 18    Sec. 15.  STATE TROOPER MEAL ALLOWANCE.  The sworn peace
 11 19 officers in the department of public safety who are not
 11 20 covered by a collective bargaining agreement negotiated
 11 21 pursuant to chapter 20 shall receive the same per diem meal
 11 22 allowance as the sworn peace officers in the department of
 11 23 public safety who are covered by a collective bargaining
 11 24 agreement negotiated pursuant to chapter 20.
 11 25    Sec. 16.  SALARY MODEL COORDINATOR.  Of the funds
 11 26 appropriated by section 7 of this Act, $133,800 for the fiscal
 11 27 year beginning July 1, 2000, is allocated to the department of
 11 28 management for salary and support of the salary model
 11 29 coordinator who shall work in conjunction with the legislative
 11 30 fiscal bureau to maintain the state's salary model used for
 11 31 analyzing, comparing, and projecting state employee salary and
 11 32 benefit information, including information relating to
 11 33 employees of the state board of regents.  The department of
 11 34 revenue and finance, the department of personnel, the five
 11 35 institutions under the jurisdiction of the state board of
 12  1 regents, the eight judicial district departments of
 12  2 correctional services, and the state department of
 12  3 transportation shall provide salary data to the department of
 12  4 management and the legislative fiscal bureau to operate the
 12  5 state's salary model.  The format and frequency of provision
 12  6 of the salary data shall be determined by the department of
 12  7 management and the legislative fiscal bureau.  The information
 12  8 shall be used in collective bargaining processes under chapter
 12  9 20 and in calculating the funding needs contained within the
 12 10 annual salary adjustment legislation.  A state employee
 12 11 organization as defined in section 20.3, subsection 4, may
 12 12 request information produced by the model, but the information
 12 13 provided shall not contain information attributable to
 12 14 individual employees.
 12 15    Sec. 17.  Section 546.2, subsection 2, Code 1999, is
 12 16 amended to read as follows:
 12 17    2.  The chief administrative officer of the department is
 12 18 the director.  The director shall be appointed annually by the
 12 19 governor from among those individuals who serve as heads of
 12 20 the divisions within the department.  The appointment shall
 12 21 rotate among the division heads such that the division head of
 12 22 any one division shall not be appointed to be the director for
 12 23 a second year until such time as each division head has served
 12 24 as the director.  A division head appointed to be the director
 12 25 shall fulfill the responsibilities and duties of the director
 12 26 in addition to the individual's responsibilities and duties as
 12 27 the head of a division.  However, the administrator of the
 12 28 alcoholic beverages division shall serve as director until
 12 29 June 30, 1995.  The director shall serve at the pleasure of
 12 30 the governor.  If the office of director becomes vacant, the
 12 31 vacancy shall be filled in the same manner as the original
 12 32 appointment was made.
 12 33    Sec. 18.  Section 7H.1, Code Supplement 1999, is repealed.
