PAG LIN 1 1 Section 1. Section 257.11, Code 1999, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 2A. AT-RISK PROGRAMS. 1 4 a. A school district which received supplementary 1 5 weighting for at-risk pupils for the school budget year 1 6 beginning July 1, 1999, which does not qualify for 1 7 supplementary weighting for at-risk pupils for the school 1 8 budget year beginning July 1, 2000, and which meets the 1 9 requirements of paragraph "c", shall receive an amount of 1 10 additional funding for at-risk pupils as follows: 1 11 (1) For the school budget year beginning July 1, 2000, a 1 12 school district shall receive an amount of additional funding 1 13 for at-risk pupils equivalent to one hundred percent of the 1 14 amount of supplementary weighting which the district was 1 15 entitled to receive for the budget year beginning July 1, 1 16 1999. 1 17 (2) For the school budget year beginning July 1, 2001, a 1 18 school district shall receive seventy-five percent of the 1 19 amount received pursuant to subparagraph (1). 1 20 (3) For the school budget year beginning July 1, 2002, a 1 21 school district shall receive fifty percent of the amount 1 22 received pursuant to subparagraph (1). 1 23 (4) For the school budget year beginning July 1, 2003, a 1 24 school district shall receive twenty-five percent of the 1 25 amount received pursuant to subparagraph (1). 1 26 (5) For the school budget year beginning July 1, 2004, and 1 27 succeeding budget years, a school district shall not be 1 28 entitled to receive additional funding for at-risk pupils 1 29 pursuant to this paragraph. 1 30 b. The department of management shall annually establish a 1 31 modified allowable growth for the applicable school budget 1 32 year for a school district receiving additional funding 1 33 pursuant to paragraph "a". 1 34 c. A school district shall be eligible to receive 1 35 additional funding for at-risk pupils pursuant to paragraph 2 1 "a" only to the extent that the school district is fully 2 2 funding a returning dropout and dropout prevention program 2 3 pursuant to section 257.41 for the school budget year 2 4 beginning July 1, 2000, 2001, 2002, or 2003. If the amount 2 5 received pursuant to section 257.41 is less than the amount of 2 6 supplementary weighting which the district was entitled to 2 7 receive for the budget year beginning July 1, 1999, then for 2 8 the applicable school budget year a district shall receive the 2 9 sum of the amount received pursuant to section 257.41 and the 2 10 amount of additional funding received pursuant to paragraph 2 11 "a". This sum, however, shall not exceed one hundred percent 2 12 of the amount of supplementary weighting which the district 2 13 was entitled to receive for the budget year beginning July 1, 2 14 1999. If a school district is fully funding a returning 2 15 dropout and dropout prevention program pursuant to section 2 16 257.41 for the school budget year beginning July 1, 2000, 2 17 2001, 2002, or 2003, and the amount received pursuant to 2 18 section 257.41 is equal to or exceeds the amount of 2 19 supplementary weighting which the district was entitled to 2 20 receive for the budget year beginning July 1, 1999, a district 2 21 shall not receive additional funding pursuant to paragraph "a" 2 22 for the applicable budget year. 2 23 Sec. 2. Section 257.11, Code 1999, is amended by adding 2 24 the following new subsection: 2 25 NEW SUBSECTION. 8. The department of education shall 2 26 annually prepare a report regarding school finance provisions 2 27 or programs receiving a standing appropriation, including 2 28 supplementary weighting programs. The report shall provide 2 29 information regarding amounts received or accessed by school 2 30 districts pursuant to the provisions or programs, whether the 2 31 amounts received represent an increase or decrease over 2 32 amounts received during the previous budget year and the 2 33 percentage increase or decrease, conclusions regarding the 2 34 adequacy of amounts received by school districts and whether 2 35 the amounts received are equitable between school districts 3 1 based upon input from the school districts and analysis by the 3 2 department, and the rationale for current trends being 3 3 observed by the department and projections regarding possible 3 4 trends in the future. The report shall be submitted to the 3 5 general assembly by January 1 each year, and copies of the 3 6 report shall be forwarded to the chairpersons and members of 3 7 the committee on education in the senate and in the house of 3 8 representatives. 3 9 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 3 10 immediate importance, takes effect upon enactment. 3 11 EXPLANATION 3 12 This bill provides that a school district which received 3 13 supplementary weighting for at-risk pupils for the school 3 14 budget year beginning July 1, 1999, and which does not qualify 3 15 for supplementary weighting for at-risk pupils for the school 3 16 budget year beginning July 1, 2000, shall receive additional 3 17 funding for at-risk pupils under specified circumstances. 3 18 The bill provides that for the school budget year beginning 3 19 July 1, 2000, a school district shall receive an amount of 3 20 additional funding for at-risk pupils equivalent to 100 3 21 percent of the amount of supplementary weighting which the 3 22 district was entitled to receive for the budget year beginning 3 23 July 1, 1999. The bill provides that for each succeeding 3 24 budget year, the amount of additional funding shall be reduced 3 25 incrementally by 25 percent, until the school budget year 3 26 beginning July 1, 2004, when a school district shall not be 3 27 eligible to receive additional funding for at-risk pupils. 3 28 The bill provides that the additional funding received shall 3 29 be in the form of modified allowable growth established by the 3 30 department of management. 3 31 The bill additionally provides that a school district shall 3 32 be eligible to receive the additional funding for at-risk 3 33 pupils only to the extent that the district is fully funding a 3 34 returning dropout and dropout prevention program pursuant to 3 35 Code section 257.41 for the school budget years beginning July 4 1 1, 2000, through July 1, 2003. The bill provides that if the 4 2 amount received pursuant to Code section 257.41 is less than 4 3 the amount of supplementary weighting which the district was 4 4 entitled to receive for the budget year beginning July 1, 4 5 1999, then for the applicable school budget year a district 4 6 shall receive the sum of the amount received pursuant to the 4 7 fully funded dropout and dropout prevention levy and the 4 8 amount of supplementary weighting which the district was 4 9 entitled to receive for the budget year beginning July 1, 4 10 1999. The bill provides that if a fully funded dropout and 4 11 dropout prevention program results in an amount received that 4 12 is equal to or exceeds the amount of supplementary weighting 4 13 which the district was entitled to receive for the budget year 4 14 beginning July 1, 1999, a district shall not receive 4 15 additional funding. 4 16 The bill further provides that the department of education 4 17 shall annually prepare a report regarding school finance 4 18 provisions or programs receiving a standing appropriation, 4 19 including supplementary weighting programs. The report shall 4 20 provide information regarding amounts received by school 4 21 districts, trends regarding increases or decreases observed, 4 22 and adequacy and equity issues. The bill provides that the 4 23 report shall be submitted to the general assembly by January 1 4 24 each year, and copies of the report shall be forwarded to the 4 25 chairpersons and members of the committee on education in the 4 26 senate and the house of representatives. 4 27 The bill takes effect upon enactment. 4 28 LSB 6725SV 78 4 29 rn/cls/14
