  1  1    Section 1.  Section 147A.8, subsection 2, Code Supplement
  1  2 1999, is amended to read as follows:
  1  3    2.  Function in any hospital or any other entity in which
  1  4 health care is ordinarily provided only when under the direct
  1  5 supervision, as defined by rules adopted pursuant to chapter
  1  6 17A, of a physician, when:
  1  7    a.  Enrolled as a student or participating as a preceptor
  1  8 in a training program approved by the department; or
  1  9    b.  Fulfilling continuing education requirements as defined
  1 10 by rule; or
  1 11    c.  Employed by or assigned to a hospital or other entity
  1 12 in which health care is ordinarily provided only when under
  1 13 the direct supervision of a physician, as a member of an
  1 14 authorized ambulance, rescue, or first response service, or in
  1 15 an individual capacity, by rendering lifesaving services in
  1 16 the facility in which employed or assigned pursuant to the
  1 17 emergency medical care provider's certification and under the
  1 18 direct supervision of a physician, physician assistant, or
  1 19 registered nurse.  An emergency medical care provider shall
  1 20 not routinely function without the direct supervision of a
  1 21 physician, physician assistant, or registered nurse.  However,
  1 22 when the physician, physician assistant, or registered nurse
  1 23 cannot directly assume emergency care of the patient, the
  1 24 emergency medical care provider may perform without direct
  1 25 supervision emergency medical care procedures for which that
  1 26 individual is certified if the life of the patient is in
  1 27 immediate danger and such care is required to preserve the
  1 28 patient's life; or
  1 29    d.  Employed by or assigned to a hospital or other entity
  1 30 in which health care is ordinarily provided only when under
  1 31 the direct supervision of a physician, as a member of an
  1 32 authorized ambulance, rescue, or first response service, or in
  1 33 an individual capacity, to perform nonlifesaving procedures
  1 34 for which those individuals have been trained and are
  1 35 designated in a written job description.  Such procedures may
  2  1 be performed after the patient is observed by and when the
  2  2 emergency medical care provider is under the supervision of
  2  3 the physician, physician assistant, or registered nurse,
  2  4 including when the registered nurse is not acting in the
  2  5 capacity of a physician designee, and where the procedure may
  2  6 be immediately abandoned without risk to the patient.  
  2  7                           EXPLANATION
  2  8    This bill provides for changes relating to the
  2  9 authorization of emergency medical care providers to provide
  2 10 emergency and nonemergency medical care services.  The bill
  2 11 provides that Code section 147A.8, subsection 2, which relates
  2 12 to the provision of services by emergency medical care
  2 13 providers in a hospital setting, shall be expanded to include,
  2 14 in addition to a hospital, the provision of services in any
  2 15 other entity in which health care is ordinarily provided only
  2 16 when under the direct supervision of a physician.  The bill
  2 17 provides that the phrase "direct supervision" shall be defined
  2 18 by the department of public health by rule.  The bill
  2 19 additionally provides that in providing emergency and
  2 20 nonemergency medical care services, an emergency medical care
  2 21 provider shall now be authorized to act in an individual
  2 22 capacity, as well as in their capacity as a member of an
  2 23 authorized ambulance, rescue, or first response service, while
  2 24 employed or assigned to the hospital or other entity in which
  2 25 health care is ordinarily provided only when under the direct
  2 26 supervision of a physician.  The bill further provides that
  2 27 the list of individuals under whose supervision an emergency
  2 28 medical care provider may perform nonlifesaving procedures,
  2 29 which currently includes a physician, physician assistant, or
  2 30 registered nurse, shall have added to it the phrase "including
  2 31 when the registered nurse is not acting in the capacity of a
  2 32 physician designee".
