PAG LIN 1 1 Section 1. Section 901B.1, subsection 1, paragraph c, Code 1 2 1999, is amended by adding the following new subparagraph: 1 3 NEW SUBPARAGRAPH. (5) Drug treatment facility. 1 4 Sec. 2. Section 901B.1, subsection 4, paragraph a, Code 1 5 1999, is amended to read as follows: 1 6 a. The district department of correctional services shall 1 7 place an individual committed to it under section 907.3 to the 1 8 sanction and level of supervision which is appropriate to the 1 9 individual based upon a current risk assessment evaluation. 1 10 Placements may be to levels two and three of the corrections 1 11 continuum. The district department may, with the approval of 1 12 the department of corrections, place an individual in a level 1 13 three drug treatment facility established pursuant to section 1 14 904.208, to assist the individual in complying with or to 1 15 prevent the individual from violating conditions of probation. 1 16 The district department may, with the approval of the 1 17 department of corrections, place an individual in a level four 1 18 violator facility established pursuant to section 904.207 only 1 19 as a penalty for a violation of a condition imposed under this 1 20 section. 1 21 Sec. 3. NEW SECTION. 904.208 DRUG TREATMENT FACILITY. 1 22 1. The director shall establish and operate a facility for 1 23 the purpose of treating drug offenders who are under the 1 24 supervision of a judicial district department of correctional 1 25 services. The drug treatment facility shall provide 1 26 structured treatment to assist offenders in complying with or 1 27 to prevent offenders from violating conditions of probation 1 28 related to drug use. 1 29 2. A drug treatment facility advisory council is 1 30 established within the department to advise and make 1 31 recommendations to the director regarding the establishment 1 32 and operation of a facility for treating drug offenders and to 1 33 assist the implementation of treatment programs that are 1 34 proven to be effective for offenders. In addition to the 1 35 director, the drug treatment facility advisory council shall 2 1 consist of the directors of the eight judicial district 2 2 departments of correctional services and one representative 2 3 each from the judicial branch, the Iowa department of public 2 4 health, and a licensed substance abuse treatment program. 2 5 Upon the advice and recommendations of the director, the 2 6 board shall adopt rules pursuant to chapter 17A to establish 2 7 and administer the drug treatment facility. 2 8 Sec. 4. Section 908.11, subsection 6, paragraph c, Code 2 9 1999, is amended to read as follows: 2 10 c. Order the defendant to be placed in aviolatorfacility 2 11 established pursuant to section 904.207 or 904.208 while 2 12 continuing the probation. 2 13 Sec. 5. CONTINGENT EFFECTIVE DATE. This Act takes effect 2 14 July 1, 2000, only if an appropriation funding the 2 15 establishment and operation of the drug treatment facility is 2 16 enacted. 2 17 EXPLANATION 2 18 This bill establishes a drug treatment facility in the 2 19 department of corrections. 2 20 The bill provides that an offender who is on probation and 2 21 who needs assistance to comply with conditions of probation, 2 22 or to prevent a violation of a condition of probation, may be 2 23 placed in the drug treatment facility by a judicial district 2 24 department of correctional services upon the approval of the 2 25 department of corrections for the purpose of drug treatment. 2 26 The bill establishes a drug offender advisory council 2 27 within the department of corrections to advise the director on 2 28 implementation of this bill and on effective treatment and 2 29 rehabilitation for offenders assigned to the new facility. 2 30 The members of the council shall consist of the director of 2 31 the department of corrections, the directors of the eight 2 32 judicial district departments of correctional services, and 2 33 one representative each from the judicial branch, the Iowa 2 34 department of public health, and a licensed substance abuse 2 35 treatment program. 3 1 The bill provides that upon the advice and recommendations 3 2 of the director, the board of the department of corrections 3 3 shall adopt rules pursuant to Code chapter 17A to implement 3 4 the establishment and administration of the drug treatment 3 5 facility. 3 6 The bill takes effect July 1, 2000, but only if funding for 3 7 the establishment and operation of the facility is enacted. 3 8 LSB 5494XS 78 3 9 jm/as/5
