  1  4         IOWA AGRICULTURAL INDUSTRY FINANCE CORPORATION
  1  5    Section 1.  RETURN OF MONEYS.  The department of economic
  1  6 development shall deposit all moneys transferred to the
  1  7 department pursuant to 1998 Iowa Acts, chapter 1207, section
  1  8 20, into the road use tax fund created in section 312.1.  An
  1  9 agricultural industry finance corporation formed under section
  1 10 15E.206 shall immediately repay the department the full amount
  1 11 of an Iowa agricultural industry finance loan provided to the
  1 12 corporation by the department under section 15E.208.  The
  1 13 department shall cooperate with the attorney general to bring
  1 14 any legal action necessary in order to accomplish the
  1 15 repayment.  
  1 16                             Part B
  1 17                  WORLD FOOD CAPITAL INITIATIVE
  1 18    Sec. 2.  NEW SECTION.  15E.113  SHORT TITLE.
  1 19    This part shall be known and may be cited as the "World
  1 20 Food Capital Initiative".
  1 21    Sec. 3.  NEW SECTION.  15E.114  DEFINITIONS.
  1 22    As used in this part:
  1 23    1.  "Advertise" means the same as defined in section
  1 24 190C.1.
  1 25    2.  "Agricultural commodity" means the same as defined in
  1 26 section 190C.1.
  1 27    3.  "Agricultural product" means the same as defined in
  1 28 section 190C.1.
  1 29    4.  "Consumer" means a person who purchases a food product
  1 30 for personal consumption.
  1 31    5.  "Food" means an article used or intended for use in
  1 32 whole or in part for human consumption.
  1 33    6.  "Handler" means the same as defined in section 190C.1.
  1 34    7.  "Iowa food product" means an agricultural product that
  1 35 is used for food which is part of the Iowa food product
  2  1 system.
  2  2    8.  "Iowa food product system" means the production and
  2  3 harvesting, handling, processing, marketing, and consumption
  2  4 of food products, if the food products are agricultural
  2  5 commodities produced in this state for use as a food product
  2  6 or produced for further processing in this state for use as
  2  7 food.
  2  8    9.  "Label" means a commercial message in a printed medium
  2  9 which is affixed by any method to a product or to a receptacle
  2 10 including a container or package.
  2 11    10.  "Marketer" means a person who sells food products on a
  2 12 wholesale or retail basis, including a food establishment as
  2 13 defined in section 137F.1, a retail grocery, meat market, or
  2 14 bakery, or organizations representing those persons.
  2 15    11.  "Processor" means the same as defined in section
  2 16 190C.1.
  2 17    12.  "Producer" means a person who produces agricultural
  2 18 commodities which are food products.
  2 19    Sec. 4.  NEW SECTION.  15E.115  WORLD FOOD CAPITAL
  2 20 INITIATIVE – ESTABLISHMENT – PURPOSE.
  2 21    1.  The department shall establish a world food capital
  2 22 initiative.  The purpose of the initiative is to implement an
  2 23 Iowa food product system policy that promotes this state as
  2 24 the food capital of the world.  In carrying out this purpose,
  2 25 the department shall do all of the following:
  2 26    a.  Assist in efforts to revitalize rural regions of this
  2 27 state.
  2 28    b.  Increase markets for Iowa food products.
  2 29    2.  In carrying out the purpose of the initiative, the
  2 30 department shall cooperate with all of the following:
  2 31    a.  Other state agencies such as the department of
  2 32 agriculture and land stewardship as provided in chapter 159,
  2 33 the college of agriculture of Iowa state university of science
  2 34 and technology as established in chapter 266, and the organic
  2 35 standards board created in section 190C.2.
  3  1    b.  Persons or organizations representing persons involved
  3  2 in the Iowa food product system, including producers,
  3  3 handlers, processors, marketers, and consumers.
  3  4    Sec. 5.  NEW SECTION.  15E.115A  FINANCIAL ASSISTANCE
  3  5 PROGRAM.
  3  6    1.  The department shall establish a financial assistance
  3  7 program to provide financial assistance to persons as
  3  8 necessary in order to carry out the purposes of this part as
  3  9 provided in section 15E.115.
  3 10    2.  In carrying out this section, the department may
  3 11 provide financing to do any of the following:
  3 12    a.  Encourage local agricultural producer-led ventures to
  3 13 expand production and processing of high-value food products,
  3 14 including agricultural processed products, to organize new
  3 15 business structures within the state to carry out these
  3 16 ventures, and to market and deliver high-value food products
  3 17 to consumers around the world.
  3 18    b.  Encourage ventures which promote the research and
  3 19 application of biological techniques for the development of
  3 20 specialized plant or animal characteristics for beneficial
  3 21 food products.
  3 22    3.  Financial assistance may be in the form of a grant,
  3 23 loan, loan guarantee, sale and purchase of mortgage
  3 24 instruments, or other similar forms of financing.  The
  3 25 financing shall be awarded pursuant to an agreement between
  3 26 the department and the person receiving financing assistance.
  3 27 The department shall not provide financing to support an
  3 28 outstanding debt or other obligation, regardless of whether
  3 29 the original financing was provided by a corporation.
  3 30    Sec. 6.  NEW SECTION.  15E.115B  DOMESTIC TRADE ASSISTANCE
  3 31 PROGRAM.
  3 32    The department shall establish a domestic trade assistance
  3 33 program in order to promote the Iowa food product system.  In
  3 34 carrying out the program, the department shall provide for
  3 35 advertising campaigns to increase the consumption of Iowa food
  4  1 products in this state.  The department shall cooperate with
  4  2 persons or organizations representing persons involved in the
  4  3 Iowa food product system as provided in section 15E.115.
  4  4    The department shall cooperate with marketers to carry out
  4  5 a program to label agricultural products which are Iowa food
  4  6 products for sale on a voluntary basis by marketers to
  4  7 consumers.  The label shall appear in a conspicuous manner.
  4  8 If the Iowa food product is offered for sale in a packaged
  4  9 form, the package shall be labeled, and if the Iowa food
  4 10 product is offered for sale unpackaged, the label shall appear
  4 11 as a placard in close proximity to the Iowa food product.  The
  4 12 label shall state information identifying the agricultural
  4 13 product as an Iowa food product and shall contain the phrase
  4 14 "World Food Capital".
  4 15    Sec. 7.  DEPARTMENT OF ECONOMIC DEVELOPMENT –
  4 16 APPROPRIATION.  There is appropriated from the general fund of
  4 17 the state to the department of economic development for the
  4 18 fiscal year beginning July 1, 2000, and ending June 30, 2001,
  4 19 the following amount, or so much thereof as is necessary, to
  4 20 be used for the purpose designated:
  4 21    For supporting the Iowa world food capital initiative as
  4 22 provided in chapter 15E, division X, part 2:  
  4 23 .................................................. $    250,000
  4 24                             Part C
  4 25         DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
  4 26    Sec. 8.  VALUE-ADDED AGRICULTURAL VENTURES –
  4 27 APPROPRIATIONS.  There is appropriated from the general fund
  4 28 of the state to the department of agriculture and land
  4 29 stewardship for the fiscal year beginning July 1, 2000, and
  4 30 ending June 30, 2001, the following amount, or so much thereof
  4 31 as is necessary, to be used for the purpose designated:
  4 32    For supporting value-added agricultural ventures:  
  4 33 .................................................. $  7,500,000
  4 34    1.  The department shall use the moneys appropriated
  4 35 pursuant to this section to provide grants to persons actively
  5  1 engaged in farming as defined in section 10.1 who have a low
  5  2 or moderate net worth as defined in section 175.2.
  5  3    2.  The grants shall be used to provide financial
  5  4 assistance to eligible persons who organize and participate in
  5  5 cooperative ventures in order to do any of the following:
  5  6    a.  Stimulate existing businesses or encourage the
  5  7 establishment of new businesses that add value through the
  5  8 processing of agricultural commodities.
  5  9    b.  Encourage the production of agricultural commodities,
  5 10 if a shortage in production exists.
  5 11    3.  The department shall provide a preference in awarding
  5 12 grants to persons participating in the value-added
  5 13 agricultural linked investment loan program as provided in
  5 14 section 12.43B.
  5 15    Sec. 9.  TRADITIONAL LIVESTOCK PRODUCERS – APPROPRIATIONS.
  5 16 There is appropriated from the general fund of the state to
  5 17 the department of agriculture and land stewardship for the
  5 18 fiscal year beginning July 1, 2000, and ending June 30, 2001,
  5 19 the following amount, or so much thereof as is necessary, to
  5 20 be used for the purpose designated:
  5 21    For supporting traditional livestock producers:  
  5 22 .................................................. $  7,500,000
  5 23    1.  The department shall use the moneys appropriated
  5 24 pursuant to this section to provide grants to persons who
  5 25 qualify to participate in the traditional livestock producers
  5 26 linked investment loan program as provided in section 12.43A.
  5 27 A person may receive a grant regardless of whether the person
  5 28 receives a loan under the traditional livestock producers
  5 29 linked investment loan program.
  5 30    2.  The grants provided under this section shall be used to
  5 31 do any of the following:
  5 32    a.  Support the farm operations of a traditional livestock
  5 33 producer in any manner that a linked investment loan may be
  5 34 used under the traditional livestock producers linked
  5 35 investment loan program.
  6  1    b.  Stimulate existing businesses or encourage the
  6  2 establishment of new businesses that add value through the
  6  3 processing of agricultural commodities.
  6  4    Sec. 10.  LOCALLY PRODUCED FOOD DISTRIBUTION SYSTEMS –
  6  5 APPROPRIATION.  There is appropriated from the general fund of
  6  6 the state to the department of agriculture and land
  6  7 stewardship for the fiscal year beginning July 1, 2000, and
  6  8 ending June 30, 2001, the following amount, or so much thereof
  6  9 as is necessary, to be used for the purpose designated:
  6 10    For supporting locally produced food distribution systems,
  6 11 including but not limited to farmers markets:  
  6 12 .................................................. $    500,000
  6 13    The department shall award grants to persons in order to
  6 14 stimulate existing or establish new locally produced food
  6 15 distribution systems in order to increase markets for Iowa-
  6 16 grown agricultural commodities as defined in section 190C.1,
  6 17 including commodities which are processed into food products
  6 18 by local processors.
  6 19    Sec. 11.  ORGANIC AGRICULTURAL PRODUCTS – APPROPRIATION.
  6 20 There is appropriated from the general fund of the state to
  6 21 the department of agriculture and land stewardship for the
  6 22 fiscal year beginning July 1, 2000, and ending June 30, 2001,
  6 23 the following amount, or so much thereof as is necessary, to
  6 24 be used for the purpose designated:
  6 25    For supporting the production and processing of organic
  6 26 agricultural products as provided in chapter 190C:  
  6 27 .................................................. $    500,000
  6 28    The department shall award grants to persons, including
  6 29 agricultural producers and regional organic associations in
  6 30 order to encourage the production, processing, and marketing
  6 31 of organic agricultural products.  The department may award
  6 32 grants to persons for purposes of improving the system of
  6 33 organic farming and the system of organic handling as provided
  6 34 in chapter 190C.  
  6 35                           DIVISION II
  7  1             AGRICULTURAL ANTICOMPETITIVE REGULATION
  7  2                             Part A
  7  3                    ATTORNEY GENERAL'S OFFICE
  7  4    Sec. 12.  NEW SECTION.  13.26  AGRICULTURAL ANTICOMPETITIVE
  7  5 ENFORCEMENT FUND.
  7  6    1.  An agricultural anticompetitive enforcement fund is
  7  7 created in the state treasury under the control of the
  7  8 attorney general.  The fund is composed of moneys appropriated
  7  9 by the general assembly, and moneys available to and obtained
  7 10 or accepted by the attorney general from the federal
  7 11 government or other sources for placement in the fund.
  7 12    2.  Moneys in the fund are subject to an annual audit by
  7 13 the auditor of state.  The fund is subject to warrants written
  7 14 by the director of revenue and finance, drawn upon the written
  7 15 requisition of the attorney general.
  7 16    3.  Moneys deposited in the fund are appropriated for
  7 17 purposes of supporting the attorney general in investigating
  7 18 and pursuing legal action to eradicate anticompetitive
  7 19 practices relating to agriculture, including but not limited
  7 20 to violations of section 9H.2.  The fund shall be used to
  7 21 support enforcement actions brought by the attorney general
  7 22 against persons who are in violation of state agricultural
  7 23 antitrust laws, including but not limited to violations of
  7 24 section 9H.2.
  7 25    4.  Section 8.33 shall not apply to moneys in the fund.
  7 26 Notwithstanding section 12C.7, moneys earned as income,
  7 27 including as interest, from the fund shall remain in the fund
  7 28 until expended as provided in this section.
  7 29    Sec. 13.  Section 321.34, Code Supplement 1999, is amended
  7 30 by adding the following new subsection:
  7 31    NEW SUBSECTION.  23.  SUPPORT FAMILY FARMING PLATES.
  7 32    a.  Upon application and payment of the proper fees, the
  7 33 director may issue support family farming plates to an owner
  7 34 referred to in subsection 12.
  7 35    b.  Support family farming plates shall be designed by the
  8  1 department in cooperation with the department of agriculture
  8  2 and land stewardship, which design shall include on the plate
  8  3 the name of the county where the vehicle is registered.
  8  4    c.  The special support family farming fee for letter
  8  5 number designated support family farming plates is thirty-five
  8  6 dollars.  The fee for personalized support family farming
  8  7 plates is forty-five dollars which shall be paid in addition
  8  8 to the special support family farming fee of thirty-five
  8  9 dollars.  The fees collected by the director under this
  8 10 subsection shall be paid monthly to the treasurer of state and
  8 11 credited to the road use tax fund.  Notwithstanding section
  8 12 423.24, and prior to the crediting of revenues to the road use
  8 13 tax fund under section 423.24, subsection 1, paragraph "c",
  8 14 the treasurer of state shall deposit monthly from those
  8 15 revenues into the agricultural anticompetitive enforcement
  8 16 fund, created in section 13.26, the amount of the special
  8 17 support family farming fees collected in the previous month
  8 18 for the support family farming plates.
  8 19    d.  Upon receipt of the special registration plates, the
  8 20 applicant shall surrender the current registration receipt and
  8 21 plates to the county treasurer.  The county treasurer shall
  8 22 validate the special registration plates in the same manner as
  8 23 regular registration plates are validated under this section.
  8 24 The annual special support family farming fee for letter
  8 25 number designated plates is ten dollars, which shall be paid
  8 26 in addition to the regular annual registration fee.  The
  8 27 annual fee for personalized support family farming plates is
  8 28 five dollars, which shall be paid in addition to the annual
  8 29 special support family farming fee and the regular annual
  8 30 registration fee.  The annual special support family farming
  8 31 fee shall be credited as provided under paragraph "c".
  8 32    Sec. 14.  AGRICULTURAL ANTICOMPETITIVE ENFORCEMENT FUND –
  8 33 APPROPRIATION.  There is appropriated from the general fund of
  8 34 the state to the department of justice for the fiscal year
  8 35 beginning July 1, 2000, and ending June 30, 2001, not more
  9  1 than the following amount, or so much thereof as is necessary,
  9  2 to be used for the purpose designated:
  9  3    For deposit into the agricultural anticompetitive
  9  4 enforcement fund created in section 13.26 for purposes as
  9  5 provided in that section including salaries, support,
  9  6 maintenance, and miscellaneous purposes:  
  9  7 .................................................. $    100,000
  9  8    Moneys appropriated in this section shall be deposited into
  9  9 the fund each month on a dollar-for-dollar matching basis with
  9 10 moneys deposited into the fund pursuant to section 321.34.  
  9 11                             Part B
  9 12         DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
  9 13    Sec. 15.  PACKER REPORTING – APPROPRIATION.  There is
  9 14 appropriated from the general fund of the state to the
  9 15 department of agriculture and land stewardship for the fiscal
  9 16 year beginning July 1, 2000, and ending June 30, 2001, the
  9 17 following amount, or so much thereof as is necessary, to be
  9 18 used for the purpose designated:
  9 19    For the supporting the regulation of price reporting by
  9 20 packers as provided in 1999 Iowa Acts, chapter 88, including
  9 21 salaries, support, maintenance, and miscellaneous purposes:  
  9 22 .................................................. $    300,000
  9 23                          DIVISION III
  9 24                    ENVIRONMENTAL PROTECTION
  9 25    Sec. 16.  Section 455J.1, Code 1999, is amended by adding
  9 26 the following new subsection:
  9 27    NEW SUBSECTION.  4A.  "Designated agricultural drainage
  9 28 well area" means the same as defined in section 455I.1.
  9 29    NEW SUBSECTION.  4B. "Earthen manure storage structure"
  9 30 means an earthen cavity, either covered or uncovered, which,
  9 31 on a regular basis, receives waste discharges from a
  9 32 confinement feeding operation, including but not limited to an
  9 33 earthen manure storage basin or an anaerobic lagoon as defined
  9 34 in section 455B.161.
  9 35    NEW SUBSECTION.  4C. "Formed manure storage structure"
 10  1 means the same as defined in section 455B.161.
 10  2    Sec. 17.  Section 455J.2, subsection 3, Code 1999, is
 10  3 amended to read as follows:
 10  4    3.  a.  The moneys collected under this section shall be
 10  5 deposited in the fund and shall be appropriated to the
 10  6 department for the exclusive purpose of providing moneys for
 10  7 following purposes:
 10  8    (1)  Supporting programs provided for in this chapter,
 10  9 including the cleanup of abandoned facilities as provided in
 10 10 section 455J.5, and to pay and providing cost-share moneys to
 10 11 persons for closing and replacing earthen manure storage
 10 12 structures as provided in section 455J.7A.
 10 13    (2)  Reimbursing the department for costs related to
 10 14 administering the provisions of this chapter.  For each fiscal
 10 15 year, the department shall not use more than one percent of
 10 16 the total amount which is available in the fund or ten
 10 17 thousand dollars, whichever is less, to pay for the costs of
 10 18 administration.
 10 19    b.  Moneys in the fund shall not be subject to
 10 20 appropriation or expenditure for any other purpose than
 10 21 provided in this section.
 10 22    Sec. 18.  NEW SECTION.  455J.7A  EARTHEN MANURE STORAGE
 10 23 STRUCTURE CLOSURE AND REPLACEMENT PROGRAM.
 10 24    1.  The department shall establish an earthen manure
 10 25 storage structure closure and replacement program.  To the
 10 26 extent that moneys are available to support the program, the
 10 27 department shall provide cost-share moneys to reimburse a
 10 28 person who is the owner of a confinement feeding operation for
 10 29 costs incurred in closing an earthen manure storage structure
 10 30 which is part of a confinement feeding operation.  If the
 10 31 person is replacing the closed earthen manure storage
 10 32 structure, the department shall reimburse the person for the
 10 33 costs of constructing a formed manure storage structure as
 10 34 provided in this section.
 10 35    2.  The person shall apply to the department in a manner
 11  1 and according to procedures required by the department.  As
 11  2 part of any receipt of cost-share assistance, the person must
 11  3 execute an agreement providing that the person shall repay any
 11  4 cost-share moneys provided under this section if the person
 11  5 constructs another earthen manure storage structure as part of
 11  6 any confinement feeding operation in this state.  A person who
 11  7 acquires an interest in the land where the manure storage
 11  8 structure is located shall repay the cost-share moneys
 11  9 provided in this section if the person constructs a new
 11 10 earthen manure storage structure on the land.  A notarized
 11 11 copy of the cost-share agreement shall be filed in the office
 11 12 of the recorder of deeds of the county in which the land is
 11 13 located.
 11 14    3.  a.  The closure must include all of the following:
 11 15    (1)  Cleanup, including removing and disposing of manure
 11 16 stored in the earthen manure storage structure and remediating
 11 17 contamination which originates from the earthen manure storage
 11 18 basin.
 11 19    (2)  Conversion of the earthen manure storage structure to
 11 20 another purpose approved by the department or filling in the
 11 21 structure with soil or other materials in a manner that is
 11 22 approved by the department.
 11 23    b.  The construction of the formed manure storage structure
 11 24 must comply with standards adopted by the department, which
 11 25 may be more stringent than otherwise required for the
 11 26 construction of a formed manure storage structure which is not
 11 27 subject to reimbursement under this section.  The formed
 11 28 manure storage structure must be aboveground and covered.
 11 29    3.  The department shall award cost-share moneys first to a
 11 30 person closing an earthen manure storage basin located within
 11 31 a designated agricultural drainage well area.
 11 32    4.  The amount of moneys allocated in cost-share payments
 11 33 to a person qualifying under this section to close an earthen
 11 34 manure storage basin or construct a formed manure storage
 11 35 basin shall not exceed fifty percent of the estimated cost or
 12  1 the actual cost of the project, whichever is less.
 12  2    5.  A person who owns an interest in land on which an
 12  3 earthen manure storage basin is located shall not be eligible
 12  4 to participate in the program, if the person is any of the
 12  5 following:
 12  6    a.  A party to a pending legal or administrative action,
 12  7 including a contested case proceeding under chapter 17A
 12  8 relating to an alleged violation involving an animal feeding
 12  9 operation as regulated by the department of natural resources,
 12 10 regardless of whether the pending action is brought by the
 12 11 department or the attorney general.
 12 12    b.  Is classified as a habitual violator for a violation of
 12 13 state law involving an animal feeding operation as regulated
 12 14 by the department of natural resources.
 12 15    Sec. 19.  EARTHEN MANURE STORAGE BASIN CLOSURE AND
 12 16 REPLACEMENT PROGRAM – APPROPRIATION.  There is appropriated
 12 17 from the general fund of the state to the department of
 12 18 natural resources for the fiscal year beginning July 1, 2000,
 12 19 and ending June 30, 2001, the following amount, or so much
 12 20 thereof as is necessary, to be used for the purpose
 12 21 designated:
 12 22    For deposit into the manure storage indemnity fund created
 12 23 in section 455J.2:  
 12 24 .................................................. $  2,000,000
 12 25    Moneys deposited into the fund shall be used to support the
 12 26 earthen manure storage structure closure and replacement
 12 27 program as provided in section 455J.7A.  
 12 28                           DIVISION IV
 12 29                      RURAL INFRASTRUCTURE
 12 30                             Part A
 12 31                   DEPARTMENT OF PUBLIC SAFETY
 12 32    Sec. 20.  FIRE FIGHTERS AND EMERGENCY MEDICAL PERSONNEL –
 12 33 APPROPRIATION.  There is appropriated from the general fund of
 12 34 the state to the department of public safety for the fiscal
 12 35 year beginning July 1, 2000, and ending June 30, 2001, the
 13  1 following amount, or so much thereof as is necessary, to be
 13  2 used for the purpose designated:
 13  3    To the state fire marshal for purposes of providing grants
 13  4 to rural communities in training volunteer fire fighters and
 13  5 persons providing emergency medical services and purchasing
 13  6 fire suppression and medical equipment:  
 13  7 .................................................. $  1,000,000
 13  8                             Part B
 13  9               DEPARTMENT OF ECONOMIC DEVELOPMENT
 13 10    Sec. 21.  WATER SUPPLY AND SEWER SYSTEMS – APPROPRIATION.
 13 11 There is appropriated from the general fund of the state to
 13 12 the department of economic development for the fiscal year
 13 13 beginning July 1, 2000, and ending June 30, 2001, the
 13 14 following amount, or so much thereof as is necessary, to be
 13 15 used for the purpose designated:
 13 16    For allocation in grants to cities for purposes of
 13 17 improving or replacing infrastructure associated with public
 13 18 drinking water, storm sewer, and sanitary sewer systems:  
 13 19 .................................................. $  3,000,000
 13 20    The moneys appropriated in this section shall be allocated
 13 21 to communities by the department in the same manner as the
 13 22 rural community 2000 program as provided in chapter 15,
 13 23 subchapter II, part 8.  However, in order to qualify, a
 13 24 community must have a population of one thousand or less.  In
 13 25 order to receive a grant under this section, a community must
 13 26 contribute to the cost of the repair or replacement on a
 13 27 dollar-for-dollar matching basis.
 13 28    Sec. 22.  RURAL MAIN STREET PROGRAM – APPROPRIATION.
 13 29 There is appropriated from the general fund of the state to
 13 30 the department of economic development for the fiscal year
 13 31 beginning July 1, 2000, and ending June 30, 2001, the

 14  2                     DEPARTMENT OF EDUCATION
 14  3    Sec. 23.  COMPUTER TECHNOLOGY FOR RURAL SCHOOL DISTRICTS –
 14  4 APPROPRIATION.  There is appropriated from the general fund of
 14  5 the state to the department of education for the fiscal year
 14  6 beginning July 1, 2000, and ending June 30, 2001, the
 14  7 following amount, or so much thereof as is necessary, to be
 14  8 used for the purpose designated:
 14  9    For upgrading computer technology for rural school
 14 10 districts:  
 14 11 .................................................. $  1,100,000
 14 12    Moneys appropriated pursuant to this section shall be
 14 13 allocated to rural school districts in order to upgrade
 14 14 computer technology, including equipment, software, and other
 14 15 related peripheral equipment, in order to ensure that the
 14 16 computer technology is comparable to that used in urban areas.
 14 17 The department may require that rural school districts expend
 14 18 the moneys in a manner that is compatible with the school
 14 19 district's technology plan required pursuant to section
 14 20 256D.7.  
 14 21                             Part D
 14 22                IOWA DEPARTMENT OF PUBLIC HEALTH
 14 23    Sec. 24.  MENTAL HEALTH AND COUNSELING SERVICES –
 14 24 APPROPRIATION.  There is appropriated from the general fund of
 14 25 the state to the Iowa department of public health for the
 14 26 fiscal year beginning July 1, 2000, and ending June 30, 2001,
 14 27 the following amount, or so much thereof as is necessary, to
 14 28 be used for the purpose designated:
 14 29    For supporting the delivery of mental health and counseling
 14 30 services in rural communities:  
 14 31 .................................................. $    500,000
 14 32    The department shall use the moneys appropriated by this
 14 33 section to assist persons requiring assistance because of
 14 34 conditions which have affected rural communities because of
 14 35 the agricultural economic crisis.  The department shall use
 15  1 the moneys after consultation with the center for rural health
 15  2 and primary care as established pursuant to section 135.107.  
 15  3                             Part E
 15  4               DEPARTMENT OF WORKFORCE DEVELOPMENT
 15  5    Sec. 25.  JOB TRAINING – APPROPRIATION.  There is
 15  6 appropriated from the general fund of the state to the
 15  7 department of workforce development for the fiscal year
 15  8 beginning July 1, 2000, and ending June 30, 2001, the
 15  9 following amount, or so much thereof as is necessary, to be
 15 10 used for the purpose designated:
 15 11    For deposit into the workforce development fund as provided
 15 12 in section 15.343 for purposes of providing training or
 15 13 retraining of members of farm families:  
 15 14 .................................................. $    500,000
 15 15    The department of workforce development shall use the
 15 16 moneys appropriated by this section to assist members of farm
 15 17 families requiring assistance because of conditions which have
 15 18 affected rural communities because of the agricultural
 15 19 economic crisis.  The department shall use the moneys in order
 15 20 to assist members of farm families who have been displaced or
 15 21 who require supplemental income in order to remain on the
 15 22 farm.  The department shall use the moneys in coordination
 15 23 with the department of economic development, the department of
 15 24 education, and the community under the Iowa industrial new
 15 25 jobs training Act in chapter 260E and the Iowa jobs training
 15 26 Act in chapter 260F.  
 15 27                           EXPLANATION
 15 28    This bill provides for a number of initiatives to support
 15 29 rural communities, and appropriates moneys to support those
 15 30 initiatives.  The moneys used to support the initiatives are
 15 31 moneys which were appropriated to support an agricultural
 15 32 industry finance corporation as provided in Code chapter 15E.  
 15 33                           DIVISION I
 15 34                AGRICULTURAL ECONOMIC DEVELOPMENT
 15 35    In 1998, the general assembly enacted Senate File 2415
 16  1 (1998 Iowa Acts, chapter 1207), which creates a new Code
 16  2 division within Code chapter 15E, entitled the "Iowa
 16  3 Agricultural Industry Finance Act", which authorizes the
 16  4 establishment of Iowa agricultural industry finance
 16  5 corporations and authorizes the department of economic
 16  6 development to award an Iowa agricultural industry finance
 16  7 loan to a corporation.  The purpose of the statute is to
 16  8 support sources of financing for local agricultural producer-
 16  9 led ventures to expand production, processing, and marketing
 16 10 of high-value agricultural products.  The Act also amended
 16 11 Code section 423.24, which allocates use tax moneys to the
 16 12 Iowa comprehensive petroleum underground storage tank
 16 13 marketability fund through January 1, 1998, until July 1,
 16 14 1998.
 16 15    This bill provides that the department of economic
 16 16 development must deposit all moneys transferred to the
 16 17 department pursuant to 1998 Iowa Acts, chapter 1207, section
 16 18 20, into the general fund of the state.  An agricultural
 16 19 industry finance corporation formed under Code section 15E.206
 16 20 is required to repay the department the full amount of an Iowa
 16 21 agricultural industry finance loan provided to the corporation
 16 22 under the 1998 Act.  The bill authorizes the department to
 16 23 cooperate with the attorney general to bring any legal action
 16 24 necessary in order to accomplish the repayment.
 16 25    The bill creates several Code sections within a new part of
 16 26 a division of Code chapter 15E relating to economic
 16 27 development activities.  The bill refers to this part as the
 16 28 "World Food Capital Initiative".  The bill creates programs
 16 29 under the initiative and appropriates moneys to the department
 16 30 of economic development in order to support the initiative.
 16 31 The bill requires the department to establish the initiative
 16 32 for purposes of promoting this state as the food capital of
 16 33 the world.  In carrying out this purpose, the department is
 16 34 required to assist in efforts to revitalize rural regions of
 16 35 this state, and increase markets for Iowa food products.  The
 17  1 bill creates a financial assistance program to encourage local
 17  2 agricultural producer-led ventures to expand production and
 17  3 processing of high-value food products, and to encourage
 17  4 ventures which promote the research and application of
 17  5 biological techniques.  The bill also requires the department
 17  6 to establish a domestic trade assistance program.  As part of
 17  7 the program, the department is required to cooperate with
 17  8 marketers to carry out a program to label agricultural
 17  9 products which are Iowa food products by marketers on a
 17 10 voluntary basis for sale to consumers.
 17 11    The bill appropriates moneys to the department of
 17 12 agriculture and land stewardship in order to support a number
 17 13 of rural projects.  The bill appropriates moneys to support
 17 14 value-added agricultural ventures.  According to the bill, the
 17 15 department is required to provide moneys to assist farmers who
 17 16 organize and participate in cooperative ventures in order to
 17 17 stimulate existing businesses or encourage the establishment
 17 18 of new businesses that add value through the processing of
 17 19 agricultural commodities or who produce agricultural
 17 20 commodities, if a shortage in production exists.  The bill
 17 21 provides that the department must provide a preference in
 17 22 awarding grants to persons participating in the value-added
 17 23 agricultural linked investment loan program.  The bill
 17 24 appropriates moneys to support persons who qualify to
 17 25 participate in the traditional livestock producers linked
 17 26 investment loan program as provided in Code section 12.43A.
 17 27 The bill appropriates moneys to the department to support
 17 28 locally produced food distribution systems, including but not
 17 29 limited to farmers markets.  The bill appropriates moneys to
 17 30 support the production and processing of organic agricultural
 17 31 products, including by awarding moneys to agricultural
 17 32 producers and regional organic associations in order to
 17 33 encourage the production, processing, and marketing of organic
 17 34 agricultural products.  
 17 35                           DIVISION II
 18  1             AGRICULTURAL ANTICOMPETITIVE REGULATION
 18  2    The bill establishes an agricultural anticompetitive
 18  3 enforcement fund in the state treasury under the control of
 18  4 the attorney general.  The bill provides that moneys in the
 18  5 fund are to be used for supporting the attorney general in
 18  6 investigating and pursuing legal action to eradicate
 18  7 anticompetitive practices relating to agriculture.  The bill
 18  8 directs the state department of transportation, in cooperation
 18  9 with the department of agriculture and land stewardship, to
 18 10 create a new, special support family farming motor vehicle
 18 11 registration plate.  An owner of a motor vehicle subject to
 18 12 registration, light delivery truck, panel delivery truck,
 18 13 pickup, motor home, multipurpose vehicle, motorcycle, trailer,
 18 14 or travel trailer may apply for, and upon payment of a special
 18 15 fee of $35 for letter number designated plates or $80 for
 18 16 personalized plates, be issued the support family farming
 18 17 plates.  The annual special fee for support family farming
 18 18 plates is $10 for letter number designated plates and $15 for
 18 19 personalized plates.  The bill directs the treasurer of state
 18 20 to deposit from the special fees for support family farming
 18 21 plates monthly into the fund.  The bill also appropriates
 18 22 moneys into the fund on a matching basis with moneys collected
 18 23 pursuant to the license plate sales.
 18 24    In 1999, the general assembly enacted Senate File 436 (1999
 18 25 Iowa Acts, chapter 88) which provided for price reporting by
 18 26 packers to the department of agriculture and land stewardship.
 18 27 The bill appropriates moneys to the department for
 18 28 administration of those price reporting requirements.  
 18 29                          DIVISION III
 18 30                    ENVIRONMENTAL PROTECTION
 18 31    The bill amends Code chapter 455J which establishes a
 18 32 manure storage indemnity fund administered by the department
 18 33 of natural resources.  The moneys in the fund must be used to
 18 34 provide for cleanup of abandoned facilities.  This establishes
 18 35 a program to support the closure of earthen manure storage
 19  1 structures, such as earthen basins and lagoons and their
 19  2 replacement with aboveground formed manure storage structures.
 19  3 The moneys must be used on a cost-share basis.  The bill
 19  4 appropriates moneys into the fund to support the program.  The
 19  5 bill provides that moneys must be used first to support the
 19  6 closure of earthen manure storage structures located within a
 19  7 designated agricultural drainage well area.  The bill provides
 19  8 for the repayment of cost-share moneys if the owner constructs
 19  9 a new earthen structure anywhere in the state or a new owner
 19 10 of the land constructs a new structure on the acquired land.
 19 11 The bill prohibits persons from participating in the program
 19 12 if they are a party to a pending environmental action or are
 19 13 classified as a habitual violator.  
 19 14                           DIVISION IV
 19 15                      RURAL INFRASTRUCTURE
 19 16    The bill appropriates moneys to various departments in
 19 17 order to support the improvement of rural infrastructure.  The
 19 18 bill appropriates moneys to the department of public safety
 19 19 for use by the state fire marshal for purposes of providing
 19 20 grants to rural communities in training volunteer fire
 19 21 fighters and persons providing emergency medical services and
 19 22 purchasing fire suppression and medical equipment.  The bill
 19 23 appropriates moneys to the department of economic development
 19 24 for allocation in grants to cities for purposes of improving
 19 25 or replacing infrastructure associated with public drinking
 19 26 water, storm sewer, and sanitary sewer systems.  The bill
 19 27 appropriates moneys to the department of economic development
 19 28 for purposes of supporting the rural main street program.  The
 19 29 bill appropriates moneys to the department of education for
 19 30 purposes of upgrading computer technology for rural school
 19 31 districts.  According to the bill, the moneys must be used to
 19 32 upgrade computer technology, including equipment, software,
 19 33 and other related peripheral equipment, in order to ensure
 19 34 that the computer technology is comparable to that used in
 19 35 urban areas.  The bill appropriates moneys to the Iowa
 20  1 department of public health for purposes of supporting the
 20  2 delivery of mental health and counseling services because of
 20  3 conditions which have affected rural communities because of
 20  4 the agricultural economic crisis.  Finally, the bill
 20  5 appropriates moneys to the department of workforce development
 20  6 for deposit into the workforce development fund as provided in
