  1  1    Section 1.  Section 257.6, subsection 5, unnumbered
  1  2 paragraph 2, Code 1999, is amended to read as follows:
  1  3    Weighted enrollment for special education support services
  1  4 costs is equal to the weighted enrollment for public and
  1  5 nonpublic school pupils minus the additional pupils added due
  1  6 to the application of the supplementary weighting.
  1  7    Sec. 2.  Section 257.9, subsections 3 and 4, Code 1999, are
  1  8 amended by striking the subsections and inserting in lieu
  1  9 thereof the following:
  1 10    3.  SPECIAL EDUCATION SUPPORT SERVICES STATE COST PER PUPIL
  1 11 FOR 2000-2001.  For the budget year beginning July 1, 2000,
  1 12 for the special education support services state cost per
  1 13 pupil, the department of management shall divide the total of
  1 14 the approved budgets of the area education agencies for
  1 15 special education support services for that year which are
  1 16 approved by the state board of education under section 273.3,
  1 17 subsection 12, by the total of the weighted enrollment of
  1 18 public and nonpublic school pupils for special education
  1 19 support services in the state for the budget year.  The
  1 20 special education support services state cost per pupil for
  1 21 the budget year is the amount calculated by the department of
  1 22 management under this subsection.
  1 23    4.  SPECIAL EDUCATION SUPPORT SERVICES STATE COST PER PUPIL
  1 24 FOR 2001-2002 AND SUCCEEDING YEARS.  For the budget year
  1 25 beginning July 1, 2001, and succeeding budget years, the
  1 26 special education support services state cost per pupil for
  1 27 the budget year is the special education support services
  1 28 state cost per pupil for the base year plus the special
  1 29 education support services allowable growth for the budget
  1 30 year.
  1 31    Sec. 3.  Section 257.10, subsections 3 and 4, Code
  1 32 Supplement 1999, are amended by striking the subsections and
  1 33 inserting in lieu thereof the following:
  1 34    3.  SPECIAL EDUCATION SUPPORT SERVICES DISTRICT COST PER
  1 35 PUPIL FOR 2000-2001.  For the budget year beginning July 1,
  2  1 2000, for the special education support services district cost
  2  2 per pupil, the department of management shall divide the
  2  3 approved budget of each area education agency for special
  2  4 education support services for that year approved by the state
  2  5 board of education, under section 273.3, subsection 12, by the
  2  6 total of the weighted enrollment of public and nonpublic
  2  7 school pupils for special education support services in the
  2  8 area for that budget year.
  2  9    The special education support services district cost per
  2 10 pupil for each school district in an area for the budget year
  2 11 is the amount calculated by the department of management under
  2 12 this subsection.
  2 13    4.  SPECIAL EDUCATION SUPPORT SERVICES DISTRICT COST PER
  2 14 PUPIL FOR 2001-2002 AND SUCCEEDING YEARS.  For the budget year
  2 15 beginning July 1, 2001, and succeeding budget years, the
  2 16 special education support services district cost per pupil for
  2 17 the budget year is the special education support services
  2 18 district cost per pupil for the base year plus the special
  2 19 education support services allowable growth for the budget
  2 20 year.
  2 21    Sec. 4.  Section 257.10, subsection 7, Code Supplement
  2 22 1999, is amended to read as follows:
  2 23    7.  SPECIAL EDUCATION SUPPORT SERVICES DISTRICT COST.
  2 24 Special education support services district cost for a school
  2 25 district for a budget year is equal to the special education
  2 26 support services district cost per pupil for the budget year
  2 27 multiplied by the special education support services weighted
  2 28 enrollment for public and nonpublic school pupils for the
  2 29 district for the budget year.  If the special education
  2 30 support services district cost for a school district for a
  2 31 budget year is less than the special education support
  2 32 services district cost for that district for the base year,
  2 33 the department of management shall adjust the special
  2 34 education support services district cost for that district for
  2 35 the budget year to equal the special education support
  3  1 services district cost for the base year.  
  3  2                           EXPLANATION
  3  3    This bill provides for the inclusion of nonpublic school
  3  4 pupils in the enrollment count for special education support
  3  5 services funding determination.  Currently, special education
  3  6 support services funding is based upon the public school
  3  7 weighted enrollment multiplied by a special education support
  3  8 services cost per pupil amount.  To facilitate the inclusion
  3  9 of nonpublic school pupils, the bill provides for the
  3 10 calculation of a new state and district special education
  3 11 support services cost per pupil.  The bill provides that for
  3 12 the school budget year beginning July 1, 2000, the approved
  3 13 budgets for the area education agencies for special education
  3 14 support services for that budget year shall be divided by the
  3 15 total weighted enrollment of public and nonpublic school
  3 16 pupils to establish new state and district cost per pupil
  3 17 amounts for special education support services.  The bill
  3 18 provides that for the school budget year beginning July 1,
  3 19 2001, and succeeding budget years, the new state and district
  3 20 cost per pupil amounts shall be utilized as base year amounts
  3 21 to which the special education support services allowable
  3 22 growth for a budget year shall be applied.  The bill adds a
  3 23 provision to Code section 257.6 providing that weighted
  3 24 enrollment for special education support services costs is
  3 25 equal to the weighted enrollment for public and nonpublic
  3 26 school pupils minus the additional pupils added due to the
  3 27 application of the supplementary weighting, and that each
  3 28 school district shall include in the third Friday in September
  3 29 enrollment report the number of nonpublic school pupils within
  3 30 each school district for special education support services
  3 31 served by the area.
