PAG LIN 1 1 Section 1. Section 257.11, subsection 2, Code 1999, is 1 2 amended to read as follows: 1 3 2. SHARED CLASSES OR TEACHERS. If the school budget 1 4 review committee certifies to the department of management 1 5 that the shared classes or teachers would otherwise not be 1 6 implemented without the assignment of additional weighting, 1 7 pupils attending classes in another school district or a 1 8 community college, attending classes taught by a teacher who 1 9 is employed jointly under section 280.15, or attending classes 1 10 taught by a teacher who is employed by another school 1 11 district, are assignedaan additional weighting ofone plus1 12an additional portion equal to one times the percentforty- 1 13 eight hundredths of the percentage of the pupil's school day 1 14 during which the pupil attends classes in another district or 1 15 community college, attends classes taught by a teacher who is 1 16 jointly employed under section 280.15, or attends classes 1 17 taught by a teacher who is employed by another school 1 18 district. A pupil attending a class in which students from 1 19 one or more other school districts are enrolled and the class 1 20 is taught via the Iowa communications networkis notwill be 1 21 deemed to be attending a class in another school district for 1 22 the purposes of this subsection and the school districtis not1 23 shall be eligible for additional weighting for that class 1 24 under this subsection. 1 25 School districts that have executed whole grade sharing 1 26 agreements under section 282.10 through 282.12 beginning with 1 27 the budget year beginning on July 1,19932000, and that 1 28 received supplementary weighting for shared teachers or 1 29 classes under this subsection for the school year ending prior 1 30 to the effective date of the whole grade sharing agreement 1 31 shall include in its supplementary weighting amount additional 1 32 pupils added by the application of the supplementary weighting 1 33 plan, equal to the pupils added by the application of the 1 34 supplementary weighting plan pursuant to this subsection in 1 35 the budget year beginning July 1,19921999. If at any time 2 1 after July 1,19932000, a district ends a whole grade sharing 2 2 agreement with the original district and does not enter into a 2 3 whole grade sharing agreement with an alternative district, 2 4 the school district shall reduce its supplementary weighting 2 5 amount by the number of pupils added by the application of the 2 6 supplementary weighting in this subsection in the budget year 2 7 beginning July 1,19921999, in the budget year that the whole 2 8 grade sharing agreement is terminated. 2 9 Sec. 2. Section 257.11, subsection 3, Code 1999, is 2 10 amended to read as follows: 2 11 3. WHOLE GRADE SHARING. For the budget years beginning 2 12 July 1,19912000, and July 1,19922001, in districts that 2 13 have executed whole grade sharing agreements under sections 2 14 282.10 through 282.12, the school budget review committee 2 15 shall assignaan additional weighting equal toone plus an2 16additional portion of one times the percentforty-eight 2 17 hundredths of the percentage of the pupil's school day in 2 18 which a pupil attends classes in another district or a 2 19 community college, attends classes taught by a teacher who is 2 20 employed jointly under section 280.15, or attends classes 2 21 taught by a teacher who is employed by another district. The 2 22 assignment of additional weighting to a school district shall 2 23 continue for a period of five years. If the school district 2 24 reorganizes during that five-year period, the assignment of 2 25 the additional weighting shall be transferred to the 2 26 reorganized district until the expiration of the five-year 2 27 period.If a school district was receiving additional2 28weighting for whole grade sharing under section 442.39,2 29subsection 2, Code 1989, the district shall continue to be2 30assigned additional weighting for whole grade sharing by the2 31school budget review committee under this subsection so that2 32the district is assigned the additional weighting for whole2 33grade sharing for a total period of five years.2 34 Sec. 3. Section 257.11, subsection 5, Code 1999, is 2 35 amended to read as follows: 3 1 5. SHARED SUPERINTENDENTS. For the budget years beginning 3 2 July 1,19912000, and July 1,19922001, pupils enrolled in a 3 3 school district in which the superintendent is employed 3 4 jointly under section 280.15 or under section 273.7A, are 3 5 assignedaan additional weighting ofone plus an additional3 6portion of one for the superintendent who is jointly employed3 7 two hundredths times the percent of the superintendent's time 3 8 in which the superintendent is employed in the school 3 9 district. However, the total additional weighting assigned 3 10 under this subsection for a budget year for a school district 3 11 shall not exceedseven and one-half and the total additional3 12weighting added cumulatively to the enrollment of school3 13districts sharing a superintendent shall not exceed twelve and3 14one-halffive. The assignment of additional weighting to a 3 15 school district shall continue for a period of five years. If 3 16 the school district reorganizes during that five-year period, 3 17 the assignment of the additional weighting shall be 3 18 transferred to the reorganized district until the expiration 3 19 of the five-year period. 3 20If a district was receiving additional weighting for3 21superintendent sharing or administrator sharing under section3 22442.39, subsection 4, Code 1989, the district shall continue3 23to be assigned additional weighting for superintendent sharing3 24or administrator sharing by the school budget review committee3 25under this subsection so that the district is assigned the3 26additional weighting for sharing for a total period of five3 27years.3 28 For purposes of this section, "superintendent" includes a 3 29 person jointly employed under section 273.7A or section 280.15 3 30 to serve in the capacity of a school superintendent and who 3 31 holds a superintendent's endorsement issued under chapter 272 3 32 by the board of educational examiners. 3 33 Sec. 4. Section 257.12, unnumbered paragraph 1, Code 1999, 3 34 is amended to read as follows: 3 35 In determining weighted enrollment under section 257.6, if 4 1 the board of directors of a school district has approved a 4 2 contract for sharing undersection 442.39, subsection 2 or 4,4 3Code 1991, orsection 257.11 and the school district has 4 4 initiated an action prior to November 30,19902000, to bring 4 5 about a reorganization, the reorganized school district shall 4 6 include, for a period ofsixfive years following the 4 7 effective date of the reorganization, additional pupils added 4 8 by the application of the supplementary weighting plan, equal 4 9 to the pupils added by the application of the supplementary 4 10 weighting plan in the year preceding the reorganization. For 4 11 the purposes of this paragraph, the weighted enrollment for 4 12 the period ofsixfive years following the effective date of 4 13 reorganization shall include the supplementary weighting in 4 14 the base year used for determining the combined district cost 4 15 for the first year of the reorganization. However, the 4 16 weighting shall be reduced by the supplementary weighting 4 17 added for a pupil whose residency is not within the 4 18 reorganized district. For purposes of this paragraph, a 4 19 reorganized district is one in which the reorganization was 4 20 approved in an election pursuant to sections 275.18 and 275.20 4 21 and takes effect on or after July 1,19912001, and on or 4 22 before July 1,19932003. Each district which initiated, by a 4 23 vote of the board of directors or jointly by the affected 4 24 boards, action to bring about a reorganization or dissolution 4 25 by November 30,19902000, shall certify the date and the 4 26 nature of the action taken to the department of education by 4 27 September 1,19912001. 4 28 EXPLANATION 4 29 This bill provides incentives for school districts involved 4 30 in reorganization efforts and sharing arrangements. 4 31 The bill provides that if the school budget review 4 32 committee certifies to the department of management that 4 33 shared classes or teachers would otherwise not be implemented 4 34 without the assignment of additional weighting, pupils 4 35 attending classes in another school district or a community 5 1 college, attending classes taught by a teacher who is employed 5 2 jointly under Code section 280.15, or attending classes taught 5 3 by a teacher who is employed by another school district, are 5 4 assigned an additional weighting of .48 of the percentage of 5 5 the pupil's school day during which the pupil attends classes 5 6 in another district or community college, attends classes 5 7 taught by a teacher who is jointly employed under Code section 5 8 280.15, or attends classes taught by a teacher who is employed 5 9 by another school district. 5 10 The bill provides that pupils attending a class in which 5 11 students from one or more other school districts are enrolled 5 12 and the class is taught via the Iowa communications network 5 13 shall be deemed to be attending a class in another school 5 14 district and the district shall be eligible for the additional 5 15 .48 weighting for that class. 5 16 The bill provides that school districts that have executed 5 17 whole grade sharing agreements under Code sections 282.10 5 18 through 282.12 beginning with the budget year beginning on 5 19 July 1, 2000, and that received supplementary weighting for 5 20 shared teachers or classes for the school year ending prior to 5 21 the effective date of the whole grade sharing agreement shall 5 22 include in its supplementary weighting amount additional 5 23 pupils equal to the pupils added by the application of the 5 24 supplementary weighting plan in the budget year beginning July 5 25 1, 1999. The bill provides that if at any time after July 1, 5 26 2000, a district ends a whole grade sharing agreement with the 5 27 original district and does not enter into a whole grade 5 28 sharing agreement with an alternative district, the school 5 29 district shall reduce its supplementary weighting amount by 5 30 the number of pupils added by the application of supplementary 5 31 weighting in the budget year beginning July 1, 1999, in the 5 32 budget year that the whole grade sharing agreement is 5 33 terminated. 5 34 The bill also provides that for the budget years beginning 5 35 July 1, 2000, and July 1, 2001, in districts that have 6 1 executed whole grade sharing agreements under Code sections 6 2 282.10 through 282.12, the school budget review committee 6 3 shall assign an additional weighting equal to .48 of the 6 4 percentage of the pupil's school day in which a pupil attends 6 5 classes in another district or a community college, attends 6 6 classes taught by a teacher who is employed jointly under Code 6 7 section 280.15, or attends classes taught by a teacher who is 6 8 employed by another district. The bill provides that the 6 9 assignment of additional weighting to a school district shall 6 10 continue for a period of five years, and that if the school 6 11 district reorganizes during that five-year period, the 6 12 assignment of the additional weighting shall be transferred to 6 13 the reorganized district until the expiration of the five-year 6 14 period. 6 15 The bill provides that for the budget years beginning July 6 16 1, 2000, and July 1, 2001, pupils enrolled in a school 6 17 district in which the superintendent is employed jointly under 6 18 Code section 280.15 or under Code section 273.7A, are assigned 6 19 an additional weighting of .02 times the percent of the 6 20 superintendent's time in which the superintendent is employed 6 21 in the school district, with a total additional weighting 6 22 assigned for a budget year for a school district not to exceed 6 23 five. The bill provides that the assignment of additional 6 24 weighting to a school district shall continue for a period of 6 25 five years, and that if the school district reorganizes during 6 26 that five-year period, the assignment of the additional 6 27 weighting shall be transferred to the reorganized district 6 28 until the expiration of the five-year period. 6 29 The bill additionally provides that if the board of 6 30 directors of a school district has approved a contract for 6 31 sharing under Code section 257.11 and the school district has 6 32 initiated an action prior to November 30, 2000, to bring about 6 33 a reorganization, the reorganized school district shall 6 34 include, for a period of five years following the effective 6 35 date of the reorganization, additional pupils added by the 7 1 application of the supplementary weighting plan.
