  1  4 STRIKING A MANDATORY LEAVE OF ABSENCE FOR A CIVIL SERVICE
  1  5    OFFICER OR EMPLOYEE, OR A DEPUTY SHERIFF WHO IS A CANDIDATE
  1  6    FOR PARTISAN PUBLIC OFFICE, AND PROVIDING AN EFFECTIVE DATE.

  1  8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  9 
  1 10    Section 1.  Section 341A.18, unnumbered paragraph 8, Code
  1 11 1999, is amended to read as follows:
  1 12    An officer or employee subject to civil service and a chief
  1 13 deputy sheriff or second deputy sheriff, who becomes a
  1 14 candidate for a partisan elective office for remuneration,
  1 15 unless running unopposed upon request, shall automatically be
  1 16 given a leave of absence without pay, commencing thirty days
  1 17 before the date of the primary election and continuing until
  1 18 the person is eliminated as a candidate or wins the primary,
  1 19 and commencing thirty days before the date of the general
  1 20 election and continuing until the person is eliminated as a
  1 21 candidate or wins the general election, and during the leave
  1 22 period shall not perform any duties connected with the office
  1 23 or position so held.  The officer or employee subject to civil
  1 24 service, or chief deputy sheriff or second deputy sheriff,
  1 25 may, however, use accumulated paid vacation time for part or
  1 26 all of the any leave of absence required under this section.
  1 27 The county shall continue to provide health benefit coverages,
  1 28 and may continue to provide other fringe benefits, to any
  1 29 officer or employee subject to civil service, or to any chief
  1 30 deputy sheriff or second deputy sheriff during any leave of
  1 31 absence required under this section.
  1 32    Sec. 2.  EFFECTIVE DATE.  This Act, being deemed of
  1 33 immediate importance, takes effect upon enactment.
