PAG LIN 1 1 Section 1. Section 257.11, Code 1999, is amended to read 1 2 as follows: 1 3 257.11 SUPPLEMENTARY WEIGHTING PLAN. 1 4In order to provide additional funds for school districts1 5which send their resident pupils to another school district or1 6to a community college for classes, which jointly employ and1 7share the services of teachers under section 280.15, which use1 8the services of a teacher employed by another school district,1 9or which jointly employ and share the services of a school1 10superintendent under section 280.15 or 273.7A, a supplementary1 11weighting plan for determining enrollment is adopted as1 12follows:1 13 1. REGULAR CURRICULUM. Pupils in a regular curriculum 1 14 attending all their classes in the district in which they 1 15 reside, taught by teachers employed by that district, and 1 16 having administrators employed by that district, are assigned 1 17 a weighting of one. 1 18 2.SHARED CLASSES OR TEACHERSDISTRICT-TO-DISTRICT 1 19 SHARING. 1 20 a. In order to provide additional funds for school 1 21 districts which send their resident pupils to another school 1 22 district, which jointly employ and share the services of 1 23 teachers under section 280.15, or which use the services of a 1 24 teacher employed by another school district, a supplementary 1 25 weighting plan for determining enrollment is adopted. 1 26 b. If the school budget review committee certifies to the 1 27 department of management that the shared classes or teachers 1 28 would otherwise not be implemented without the assignment of 1 29 additional weighting, pupils attending classes in another 1 30 school districtor a community college, attending classes 1 31 taught by a teacher who is employed jointly under section 1 32 280.15, or attending classes taught by a teacher who is 1 33 employed by another school district, are assigned a weighting 1 34 ofone plus an additional portion equal to one times the1 35percentforty-eight hundredths of the percentage of the 2 1 pupil's school day during which the pupil attends classes in 2 2 another districtor community college, attends classes taught 2 3 by a teacher who is jointly employed under section 280.15, or 2 4 attends classes taught by a teacher who is employed by another 2 5 school district.A pupil attending a class in which students2 6from one or more other school districts are enrolled and the2 7class is taught via the Iowa communications network is not2 8deemed to be attending a class in another school district for2 9the purposes of this subsection and the school district is not2 10eligible for additional weighting for that class under this2 11subsection.2 12School districts that have executed whole grade sharing2 13agreements under section 282.10 through 282.12 beginning with2 14the budget year beginning on July 1, 1993, and that received2 15supplementary weighting for shared teachers or classes under2 16this subsection for the school year ending prior to the2 17effective date of the whole grade sharing agreement shall2 18include in its supplementary weighting amount additional2 19pupils added by the application of the supplementary weighting2 20plan, equal to the pupils added by the application of the2 21supplementary weighting plan pursuant to this subsection in2 22the budget year beginning July 1, 1992. If at any time after2 23July 1, 1993, a district ends a whole grade sharing agreement2 24with the original district and does not enter into a whole2 25grade sharing agreement with an alternative district, the2 26school district shall reduce its supplementary weighting2 27amount by the number of pupils added by the application of the2 28supplementary weighting in this subsection in the budget year2 29beginning July 1, 1992, in the budget year that the whole2 30grade sharing agreement is terminated.2 313. WHOLE GRADE SHARING. For the budget years beginning2 32July 1, 1991, and July 1, 1992, in districts that have2 33executed whole grade sharing agreements under sections 282.102 34through 282.12, the school budget review committee shall2 35assign a weighting equal to one plus an additional portion of3 1one times the percent of the pupil's school day in which a3 2pupil attends classes in another district or a community3 3college, attends classes taught by a teacher who is employed3 4jointly under section 280.15, or attends classes taught by a3 5teacher who is employed by another district. The assignment3 6of additional weighting to a school district shall continue3 7for a period of five years. If the school district3 8reorganizes during that five-year period, the assignment of3 9the additional weighting shall be transferred to the3 10reorganized district until the expiration of the five-year3 11period. If a school district was receiving additional3 12weighting for whole grade sharing under section 442.39,3 13subsection 2, Code 1989, the district shall continue to be3 14assigned additional weighting for whole grade sharing by the3 15school budget review committee under this subsection so that3 16the district is assigned the additional weighting for whole3 17grade sharing for a total period of five years.3 184. PUPILS INELIGIBLE. A pupil eligible for the weighting3 19plan provided in section 256B.9 is not eligible for the3 20weighting plan provided in this section.3 215. SHARED SUPERINTENDENTS. For the budget years beginning3 22July 1, 1991, and July 1, 1992, pupils enrolled in a school3 23district in which the superintendent is employed jointly under3 24section 280.15 or under section 273.7A, are assigned a3 25weighting of one plus an additional portion of one for the3 26superintendent who is jointly employed times the percent of3 27the superintendent's time in which the superintendent is3 28employed in the school district. However, the total3 29additional weighting assigned under this subsection for a3 30budget year for a school district shall not exceed seven and3 31one-half and the total additional weighting added cumulatively3 32to the enrollment of school districts sharing a superintendent3 33shall not exceed twelve and one-half. The assignment of3 34additional weighting to a school district shall continue for a3 35period of five years. If the school district reorganizes4 1during that five-year period, the assignment of the additional4 2weighting shall be transferred to the reorganized district4 3until the expiration of the five-year period.4 4If a district was receiving additional weighting for4 5superintendent sharing or administrator sharing under section4 6442.39, subsection 4, Code 1989, the district shall continue4 7to be assigned additional weighting for superintendent sharing4 8or administrator sharing by the school budget review committee4 9under this subsection so that the district is assigned the4 10additional weighting for sharing for a total period of five4 11years.4 12For purposes of this section, "superintendent" includes a4 13person jointly employed under section 273.7A or section 280.154 14to serve in the capacity of a school superintendent and who4 15holds a superintendent's endorsement issued under chapter 2724 16by the board of educational examiners.4 176. SHARED MATHEMATICS, SCIENCE, AND LANGUAGE COURSES. For4 18the budget years beginning July 1, 1991, and July 1, 1992, a4 19school district receiving additional funds under subsection 24 20or 3 for its pupils at the ninth grade level and above that4 21are enrolled in sequential mathematics courses at the advanced4 22algebra level and above; chemistry, advanced chemistry,4 23physics or advanced physics courses; or foreign language4 24courses at the second year level and above shall have an4 25additional weighting of one pupil added to its total.4 267. CALCULATION OF WEIGHTS. The school budget review4 27committee shall calculate the weights to be used under4 28subsections 2 and 3 to the nearest one-hundredth of one and4 29under subsection 5 to the next highest one-thousandth of one.4 30To the extent possible, the moneys generated by the weighting4 31shall be equivalent to the moneys generated by the one-tenth,4 32five-tenths, and twenty-five thousandths weighting provided in4 33section 442.39, Code 1989.4 34 c. Pupils attending class for all or a substantial portion 4 35 of a school day pursuant to a whole grade sharing agreement 5 1 executed under sections 282.10 through 282.12 shall not be 5 2 eligible for supplementary weighting pursuant to this 5 3 subsection. 5 4 3. DISTRICT-TO-COMMUNITY-COLLEGE SHARING. 5 5 a. In order to provide additional funds for school 5 6 districts which send their resident pupils to a community 5 7 college for classes, a supplementary weighting plan for 5 8 determining enrollment is adopted. 5 9 b. If the school budget review committee certifies to the 5 10 department of management that the class would not otherwise be 5 11 implemented without the assignment of additional weighting, 5 12 pupils attending a community college-offered class or 5 13 attending a class taught by a community college-employed 5 14 teacher are assigned a weighting, in addition to the weighting 5 15 assigned in subsection 1, of forty-eight hundredths of the 5 16 percentage of the pupil's school day during which the pupil 5 17 attends class in the community college or attends a class 5 18 taught by a community college-employed teacher. The following 5 19 requirements shall be met for the purposes of assigning an 5 20 additional weighting for classes offered through a sharing 5 21 agreement between a school district and community college. 5 22 The class must be: 5 23 (1) Supplementing, not supplanting, high school courses. 5 24 (2) Included in the community college catalog or an 5 25 amendment or addendum to the catalog. 5 26 (3) Open to all registered community college students, not 5 27 just high school students. 5 28 (4) For college credit and the credit must apply toward an 5 29 associate of arts or associate of science degree, or toward an 5 30 associate of applied arts or associate of applied science 5 31 degree, or toward completion of a college diploma program. 5 32 (5) Taught by a teacher meeting community college 5 33 licensing requirements. 5 34 (6) Taught utilizing the community college course 5 35 syllabus. 6 1 (7) Of the same quality as a course offered on a community 6 2 college campus. 6 3 4. AT-RISK PROGRAMS. 6 4 a. In order to provide additional funding to school 6 5 districts for programs serving at-risk pupils in grades nine 6 6 through twelve, a supplementary weighting plan for at-risk 6 7 pupils is adopted. A supplementary weighting of one hundred 6 8 twenty-eight ten-thousandths per pupil shall be assigned to 6 9 the percentage of pupils in a school district enrolled in 6 10 grades one through six, as reported by the school district on 6 11 the basic educational data survey for the base year, who are 6 12 eligible for free lunches under the federal National School 6 13 Lunch Act and the federal Child Nutrition Act of 1966, 42 6 14 U.S.C. } 1751-1785, multiplied by the budget enrollment in the 6 15 school district. Amounts received as supplementary weighting 6 16 for at-risk pupils shall be utilized by a school district to 6 17 develop or maintain alternative programs or an at-risk pupils' 6 18 program, including alternative high school programs, and shall 6 19 be in addition to and not supplanting moneys appropriated in 6 20 section 279.51 and moneys otherwise appropriated by law to 6 21 supplement that funding. 6 22 b. Notwithstanding paragraph "a", a school district which 6 23 received supplementary weighting for an alternative high 6 24 school program offered by a community college for the school 6 25 budget year beginning July 1, 1999, shall receive an amount of 6 26 supplementary weighting for the next five school budget years 6 27 as follows: 6 28 (1) For the budget year beginning July 1, 2000, the 6 29 greater of the amount of supplementary weighting determined 6 30 pursuant to paragraph "a", or one hundred percent of the 6 31 amount received for the budget year beginning July 1, 1999. 6 32 (2) For the budget year beginning July 1, 2001, the 6 33 greater of the amount of supplementary weighting determined 6 34 pursuant to paragraph "a", or seventy-five percent of the 6 35 amount received for the budget year beginning July 1, 1999. 7 1 (3) For the budget year beginning July 1, 2002, the 7 2 greater of the amount of supplementary weighting determined 7 3 pursuant to paragraph "a", or fifty percent of the amount 7 4 received for the budget year beginning July 1, 1999. 7 5 (4) For the budget year beginning July 1, 2003, the 7 6 greater of the amount of supplementary weighting determined 7 7 pursuant to paragraph "a", or twenty-five percent of the 7 8 amount received for the budget year beginning July 1, 1999. 7 9 (5) For the budget year beginning July 1, 2004, and 7 10 succeeding budget years, the amount of supplementary weighting 7 11 determined pursuant to paragraph "a". 7 12 If a school district receives an amount pursuant to this 7 13 paragraph "b" which exceeds the amount the district would 7 14 otherwise have received pursuant to paragraph "a", the 7 15 department of management shall annually determine the amount 7 16 of the excess that would have been state aid and the amount 7 17 that would have been property tax if the school district had 7 18 generated that amount pursuant to paragraph "a", and shall 7 19 include the amounts in the state aid payments and property tax 7 20 levies of school districts. The department of management 7 21 shall recalculate the supplementary weighting amount received 7 22 each year to reflect the amount of the reduction in funding 7 23 from one budget year to the next pursuant to subparagraphs (1) 7 24 through (5). 7 25 5. SHARED CLASSES DELIVERED OVER THE IOWA COMMUNICATIONS 7 26 NETWORK. A pupil attending a class in which students from one 7 27 or more other school districts are enrolled and which is 7 28 taught via the Iowa communications network is not deemed to be 7 29 attending a class in another school district or in a community 7 30 college for the purposes of this section and the school 7 31 district is not eligible for supplementary weighting for that 7 32 class under this section. 7 33 6. PUPILS INELIGIBLE. A pupil eligible for the weighting 7 34 plan provided in section 256B.9 is not eligible for 7 35 supplementary weighting pursuant to this section. 8 1 Sec. 2. Section 257.12, Code 1999, is repealed. 8 2 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 8 3 immediate importance, takes effect upon enactment. 8 4 EXPLANATION 8 5 This bill provides supplementary weighting for determining 8 6 enrollment in school districts which are involved in sharing 8 7 programs on a district-to-district, or district-to-community- 8 8 college, basis, and for at-risk programs. 8 9 For purposes of determining the amount of supplementary 8 10 weighting, pupils in a regular curriculum attending all their 8 11 classes in the district in which they reside, taught by 8 12 teachers employed by that district, and having administrators 8 13 employed by that district, are assigned a weighting of one. 8 14 The bill provides that school districts which send their 8 15 resident pupils to another school district, which jointly 8 16 employ and share the services of teachers under Code section 8 17 280.15, or which use the services of a teacher employed by 8 18 another school district, will have assigned to the pupils an 8 19 additional weighting of .48 of the percentage of the pupil's 8 20 school day during which the pupil is involved in the shared 8 21 program. In order to receive the supplementary weighting, the 8 22 school budget review committee must certify to the department 8 23 of management that the shared classes or teachers would 8 24 otherwise not be implemented without the assignment of 8 25 additional weighting. 8 26 The bill also provides that school districts which send 8 27 their resident pupils to a community college-offered class or 8 28 to a class taught by a community college-employed teacher will 8 29 have assigned to the pupils an additional weighting of .48 of 8 30 the percentage of the pupil's school day during which the 8 31 pupil is involved in the shared program, if the school budget 8 32 review committee certifies to the department of management 8 33 that the class would not otherwise be implemented without the 8 34 assignment of the supplementary weighting. The bill provides 8 35 that a number of requirements must be met regarding the nature 9 1 of the class or classes being taken in order to qualify for 9 2 supplementary weighting for programs shared by a district with 9 3 a community college. 9 4 The bill additionally provides that school districts will 9 5 receive supplementary weighting for programs serving at-risk 9 6 pupils in grades nine through 12. A weighting of .0128 per 9 7 pupil will be assigned based on the percentage of pupils 9 8 enrolled in grades one through six who are eligible for free 9 9 and reduced price meals, as reported by the school district on 9 10 the basic educational data survey for the base year, 9 11 multiplied by the budget enrollment in the school district. 9 12 The bill provides that amounts received as supplemental 9 13 weighting for at-risk pupils shall be utilized by a school 9 14 district to develop or maintain alternative programs for at- 9 15 risk pupils, including alternative high school programs, and 9 16 will be in addition to and not supplanting other at-risk 9 17 program moneys appropriated in Code section 279.51 and moneys 9 18 otherwise appropriated by law to supplement that funding. The 9 19 bill provides that a school district which received 9 20 supplementary weighting for an alternative high school program 9 21 offered by a community college for the school budget year 9 22 beginning July 1, 1999, will receive the greater of either 100 9 23 percent of that amount for the school budget year beginning 9 24 July 1, 2000, or the amount determined pursuant to the .0128 9 25 weighting. The bill further provides that for each succeeding 9 26 budget year a school district shall receive the greater of 9 27 either the amount determined pursuant to the .0128 weighting 9 28 or an amount representing a 25 percent annual decrease in the 9 29 amount of supplementary weighting received for an alternative 9 30 high school program offered by a community college for the 9 31 school budget year beginning July 1, 1999, until the amount 9 32 generated by the .0128 weighting is reached. The bill 9 33 provides that the department of management shall annually 9 34 determine the amount received exceeding the .0128 weighting 9 35 which is attributable to state aid and property tax, and shall 10 1 recalculate the supplementary weighting amount received 10 2 annually until the .0128 level is reached. 10 3 The bill provides that pupils attending a class in which 10 4 students from one or more other school districts are enrolled, 10 5 which is taught via the Iowa communications network, will not 10 6 be considered to be attending a class in another school 10 7 district or in a community college for purposes of qualifying 10 8 for supplementary weighting. The bill further provides that 10 9 pupils eligible for special education weighting pursuant to 10 10 Code section 256B.9 will not be eligible for supplementary 10 11 weighting for shared programs between school districts or 10 12 between a school district and a community college. The bill 10 13 additionally provides that pupils attending class pursuant to 10 14 a whole grade sharing agreement executed under Code sections 10 15 282.10 through 282.12 shall not be eligible for district-to- 10 16 district supplementary weighting. 10 17 Additionally, the bill provides for the deletion of 10 18 provisions which previously authorized supplementary 10 19 weighting. The deleted provisions relate to the addition of 10 20 supplementary weighting amounts for school districts entering 10 21 into a whole grade sharing agreement pursuant to Code sections 10 22 282.10 through 282.12 beginning with the budget year beginning 10 23 on July 1, 1993, and for a five-year period for school 10 24 districts entering into a whole grade sharing agreement for 10 25 the budget years beginning July 1, 1991, and July 1, 1992. 10 26 Also deleted are provisions which had authorized supplementary 10 27 weighting for a five-year duration for school districts 10 28 entering into an agreement involving the joint employment of a 10 29 superintendent for the budget years beginning July 1, 1991, 10 30 and July 1, 1992, and supplementary weighting for a six-year 10 31 period for school districts undergoing a reorganization taking 10 32 effect on or before July 1, 1993. The bill further deletes 10 33 previously authorized supplementary weighting for shared 10 34 mathematics, science, and language classes for the budget 10 35 years beginning July 1, 1991, and July 1, 1992, and provisions 11 1 relating to the rounding off of supplementary weighting 11 2 calculations. 11 3 The bill takes effect upon enactment. 11 4 LSB 5388XS 78 11 5 rn/cls/14.4
