PAG LIN 1 1 Section 1. TOBACCO SETTLEMENT FUND APPROPRIATION TO 1 2 DEPARTMENT OF HUMAN SERVICES. There is appropriated from the 1 3 tobacco settlement fund created in section 12.65 to the 1 4 department of human services for the fiscal year beginning 1 5 July 1, 2000, and ending June 30, 2001, the following amounts, 1 6 or so much thereof as is necessary, to be used for the 1 7 purposes designated: 1 8 To the department of human services to implement 1 9 reimbursement increases and reimbursement methodology changes 1 10 for program providers under the purview of the department of 1 11 human services: 1 12 .................................................. $ 11,250,000 1 13 1. The department shall review reimbursements and 1 14 reimbursement methodology for program providers under the 1 15 purview of the department of human services and shall 1 16 determine appropriate changes. These changes may be 1 17 implemented with funding available under this section. 1 18 2. The department may transfer funds appropriated in this 1 19 section to other appropriations made to the department as 1 20 necessary to carry out the purpose of this section. 1 21 Sec. 2. Section 12.65, Code 1999, is amended to read as 1 22 follows: 1 23 12.65 TOBACCO SETTLEMENT FUND. 1 24 1. A tobacco settlement fund is created in the office of 1 25 the treasurer of state. After payment of litigation costs, 1 26 the state portion of any moneys paid to the state by tobacco 1 27 companies in settlement of the state's lawsuit for recovery of 1 28 public expenditures associated with tobacco use shall be 1 29 deposited in the tobacco settlement fund. Moneys deposited in 1 30 the fund shall be used only as provided in appropriations from 1 31 the fundto the department of human services for the medical1 32assistance program and to the Iowa department of public health1 33 for health care-related programsto reduce smoking by teenage1 34youth. For purposes of this section, "litigation costs" are 1 35 those costs itemized by the attorney general and submitted to 2 1 and approved by thegeneral assemblyexecutive council. 2 2 2. On June 30, 2001, the balance remaining in the tobacco 2 3 settlement fund shall be transferred to the general fund of 2 4 the state. Beginning July 1, 2001, the tobacco settlement 2 5 fund shall be considered part of the general fund of the 2 6 state. However, the state portion of the moneys received 2 7 shall only be appropriated for health care-related programs. 2 8 Sec. 3. EFFECTIVE DATE. The section in this Act amending 2 9 section 12.65, being deemed of immediate importance, takes 2 10 effect upon enactment and is retroactively applicable to July 2 11 1, 1999. 2 12 EXPLANATION 2 13 This bill relates to the tobacco settlement fund, makes an 2 14 appropriation to the department of human services from the 2 15 fund, and provides conforming provisions relating to the 2 16 expenditure of the funds. 2 17 The bill also appropriates $11,250,000 to the department of 2 18 human services to implement reimbursement increases or 2 19 methodology changes for program providers under the purview of 2 20 the department of human services. The department is directed 2 21 to review reimbursements and reimbursement methodologies for 2 22 program providers under the purview of the department of human 2 23 services, determine appropriate changes, and implement the 2 24 changes with the funding available under the appropriation. 2 25 The department is also authorized to transfer the funds 2 26 provided related to reimbursements to other appropriations to 2 27 the department as necessary to carry out the purpose of the 2 28 appropriation related to reimbursements. 2 29 The bill also amends codified provisions relating to the 2 30 tobacco settlement fund and to the provisions of the bill. 2 31 The bill amends Code section 12.65, the tobacco settlement 2 32 fund, to provide that moneys deposited in the fund shall be 2 33 used only as provided in appropriations from the fund for 2 34 health care-related programs. The amendment to the section 2 35 also provides that litigation costs, which are to be paid 3 1 prior to deposit of moneys in the fund, are to be submitted to 3 2 and approved by the executive council. The executive council, 3 3 under Code section 7D.1, includes the governor, secretary of 3 4 state, auditor of state, treasurer of state, and the secretary 3 5 of agriculture. The bill also amends Code section 12.65 to 3 6 provide that the balance remaining in the tobacco settlement 3 7 fund shall be transferred to the general fund of the state 3 8 effective June 30, 2001. Additionally, beginning July 1, 3 9 2001, the tobacco settlement fund is to be considered part of 3 10 the general fund of the state. However, the state portion of 3 11 the tobacco settlement funds are to continue to only be 3 12 appropriated for health care-related programs.
