PAG LIN 1 1 SENATE FILE 2061 1 2 1 3 AN ACT 1 4 RELATING TO THE REGISTRATION AND LICENSING DUTIES OF THE COUNTY 1 5 RECORDER AND PROVIDING FOR OTHER PROPERLY RELATED MATTERS. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 321G.6, unnumbered paragraph 6, Code 1 10 Supplement 1999, is amended to read as follows: 1 11 Upon the transfer of ownership of an all-terrain vehicle or 1 12 snowmobile, the owner shall complete the form on the back ofa1 13 the current registration certificate and shall deliver it to 1 14 the purchaser or transferee at the time of delivering the all- 1 15 terrain vehicle or snowmobile.If an all-terrain vehicle or1 16snowmobile is stored by the transferor pursuant to section1 17321G.4 at the time of transfer, the transferor shall provide1 18the transferee with a copy of the affidavit filed with the1 19county recorder pursuant to section 321G.4 at the time of1 20delivering the all-terrain vehicle or snowmobile.The 1 21 purchaser or transferee shall, within five days of transfer, 1 22 file a new application form with the county recorder with a 1 23 fee of one dollar and the writing fee, and a transfer of 1 24 number shall be awarded in the same manner as provided in an 1 25 original registration. If the purchaser or transferee does 1 26 not file a new application form within five days of transfer, 1 27 the transfer of number shall be awarded upon payment of all 1 28 applicable fees plus a penalty of five dollars. 1 29 Sec. 2. Section 462A.5, subsection 1, unnumbered paragraph 1 30 2, Code 1999, is amended to read as follows: 1 31 The owner of the vessel shall file an application for 1 32 registration with the appropriate county recorder on forms 1 33 provided by the commission. The application shall be 1 34 completed and signed by the owner of the vessel and shall be 1 35 accompanied by the appropriate fee, andathe writing feeof2 1one dollarspecified in section 462A.53. Upon applying for 2 2 registration the owner shall display a bill of sale, receipt, 2 3 or other satisfactory proof of ownership as provided by the 2 4 rules of the commission to the county recorder. Upon receipt 2 5 of the application in approved form accompanied by the 2 6 required fees, the county recorder shall enter it upon the 2 7 records of the recorder's office and shall issue to the 2 8 applicant a pocket-size registration certificate. The 2 9 certificate shall be executed in triplicate, one copy to be 2 10 delivered to the owner, one copy to the commission, and one 2 11 copy to be retained on file by the county recorder. The 2 12 registration certificate shall bear the number awarded to the 2 13 vessel, the passenger capacity of the vessel and the name and 2 14 address of the owner. In the use of all vessels except 2 15 nonpowered sailboats, nonpowered canoes and commercial 2 16 vessels, the registration certificate shall be carried either 2 17 in the vessel or on the person of the operator of the vessel 2 18 when in use. In the use of nonpowered sailboats, nonpowered 2 19 canoes or commercial vessels, the registration certificate may 2 20 be kept on shore in accordance with rules adopted by the 2 21 commission. The operator shall exhibit the certificate to a 2 22 peace officer upon request, or, when involved in a collision 2 23 or accident of any nature with another vessel or other 2 24 personal property, to the owner or operator of the other 2 25 vessel or personal property. 2 26 Sec. 3. Section 483A.10, Code 1999, is amended to read as 2 27 follows: 2 28 483A.10 ISSUANCE OF LICENSES. 2 29 The licenses issued pursuant to this chapter shall be 2 30 issued by the department, the county recorders,or the license 2 31 depositaries as specified by rules of the commission. A 2 32 county recorder may issue licenses subject to the rules of the 2 33 department. The rules shall include the application 2 34 procedures as necessary. The licenses shall show the cost of 2 35 the license and the writing fee. A person authorized to issue 3 1 a license or collect a fee pursuant to this chapter or chapter 3 2 484A shall charge the fee specified in this chapter or chapter 3 3 484A only plus a writing fee if applicable. 3 4 3 5 3 6 3 7 MARY E.
