1 1 Section 1. Section 282.31, subsection 1, paragraph a, Code
1 2 1999, is amended by adding the following new unnumbered
1 3 paragraph:
1 4 NEW UNNUMBERED PARAGRAPH. If a facility described in
1 5 section 282.30, subsection 1, paragraph "a", that is initially
1 6 established and approved or licensed after the date identified
1 7 in rule by the department of education for submittal of the
1 8 area education agency proposed program and budget for the next
1 9 succeeding school year, requests educational services under
1 10 this paragraph "a", the facility must file the appropriate
1 11 forms with the area education agency at least ninety days
1 12 prior to the date that the services would commence. The
1 13 department's review, modification, approval, and notice
1 14 process shall be completed within the sixty-day period
1 15 following filing of the facility's request. The costs
1 16 associated with the request for educational services shall be
1 17 paid in the manner provided in this paragraph "a".
1 18 Sec. 2. EFFECTIVE DATE FACILITIES FOR 1999-2000 SCHOOL
1 19 YEAR. This Act, being deemed of immediate importance, takes
1 20 effect upon enactment. A facility described in section
1 21 282.30, subsection 1, paragraph "a", that was initially
1 22 established and approved or licensed after December 1, 1998,
1 23 and that made a written request to the area education agency
1 24 for educational services at least ninety days prior to the
1 25 placement of children at the facility, shall be reimbursed by
1 26 the department of revenue and finance for the facility's
1 27 actual costs of providing the appropriate educational services
1 28 to children placed at the facility for the 1999-2000 school
1 29 year. Any amount paid by the department of revenue and
1 30 finance shall be deducted monthly from the state foundation
1 31 aid paid under section 257.16 to all school districts in the
1 32 state during the subsequent fiscal year.
1 33 EXPLANATION
1 34 This bill relates to payment of education costs for
1 35 facilities approved or licensed as a juvenile shelter care
2 1 home or juvenile detention home.
2 2 Under current law in Code section 282.31, state payment is
2 3 provided to area education services for the costs of providing
2 4 appropriate educational services to children placed at such
2 5 juvenile facilities. A proposed program and budget for the
2 6 next succeeding school year must be submitted to the
2 7 department of education by January 1. The proposal is subject
2 8 to review, modification, and approval by the department of
2 9 education by February 1. The bill amends that Code section to
2 10 allow facilities initially licensed or approved after the date
2 11 set by the department of education for submission of the
2 12 request for educational services to submit the request 90 days
2 13 in advance of commencement of the services. The department
2 14 must complete its review, modification, and approval process
2 15 within 60 days of the filing of the request.
2 16 The bill is effective upon enactment. The bill includes a
2 17 temporary provision providing that a facility that was
2 18 initially established and approved or licensed after December
2 19 1, 1998, and that made a written request to the area education
2 20 agency for educational services at least 90 days prior to the
2 21 placement of children at the facility, shall be reimbursed by
2 22 the department of revenue and finance for the facility's
2 23 actual costs of providing the appropriate educational services
2 24 to children placed at the facility for the 1999-2000 school
2 25 year. Any amount paid by the department of revenue and
2 26 finance shall be deducted monthly from the state foundation
