  1  1    Section 1.  Section 256D.5, subsection 2, Code Supplement
  1  2 1999, is amended to read as follows:
  1  3    2.  There is appropriated from the general fund of the
  1  4 state to the department of education for each fiscal year of
  1  5 the fiscal period beginning July 1, 2001, and ending June 30,
  1  6 2003, the sum of thirty thirty-two million five hundred
  1  7 thousand dollars for the school improvement technology block
  1  8 grant program.
  1  9    Sec. 2.  NEW SECTION.  256D.8A  TECHNOLOGY FOR ACCREDITED
  1 10 NONPUBLIC SCHOOLS.
  1 11    1.  Technology adopted and purchased by a school district
  1 12 as provided in this chapter may, and shall to the extent funds
  1 13 are appropriated by the general assembly and allocated as
  1 14 provided in this chapter, be made available to students of
  1 15 accredited nonpublic schools located within the boundaries of
  1 16 the school district upon the written request of the
  1 17 authorities in charge of the nonpublic school on behalf of the
  1 18 school's students as provided in this section.
  1 19    2.  From the moneys appropriated in section 295.2,
  1 20 subsection 1, paragraph "d" and from the moneys appropriated
  1 21 in section 256D.5, subsection 2, for each fiscal year in which
  1 22 moneys are appropriated, the sum of two million five hundred
  1 23 thousand dollars shall be allocated to school districts for
  1 24 the purchase of technology for accredited public schools as
  1 25 provided in this section, subject to the restrictions of
  1 26 section 295.4, subsection 1, and section 256D.8, subsection 1,
  1 27 and notwithstanding section 295.2, subsections 2 and 3, and
  1 28 section 256D.6, subsections 1 and 2.  The department of
  1 29 education shall ascertain a maximum annual amount the school
  1 30 district shall be required to use for the purchase of
  1 31 technology for participating accredited nonpublic schools.
  1 32 The amount shall be in the proportion that the basic
  1 33 enrollment of a participating accredited nonpublic school
  1 34 bears to the sum of the basic enrollments of all participating
  1 35 accredited nonpublic schools in the state for the budget year.
  2  1 For each school year in which the authorities in charge of an
  2  2 accredited nonpublic school request technology as provided in
  2  3 this section, the participating accredited nonpublic school
  2  4 shall certify its actual enrollment to the department of
  2  5 education by October 1.  By October 15, the department shall
  2  6 notify the board of directors of each school district of the
  2  7 maximum amount of its allocation that shall be made available
  2  8 for purchasing technology for each of the participating
  2  9 accredited nonpublic schools located within the school
  2 10 district in accordance with this section.  The technology made
  2 11 available to accredited nonpublic schools in accordance with
  2 12 this section shall be comparable to the technology of the
  2 13 district of attendance.  For purposes of this section only, an
  2 14 accredited nonpublic school's enrollment count shall include
  2 15 only students who are residents of Iowa.
  2 16    3.  The costs of providing technology to participating
  2 17 accredited nonpublic schools as provided in this section shall
  2 18 not be included in the computation of district cost under
  2 19 chapter 257, but shall be shown in the budget as an expense
  2 20 from miscellaneous income.
  2 21    4.  Prior to receiving technology under this section, the
  2 22 authorities in charge of an accredited nonpublic school shall
  2 23 adopt a technology plan that supports school improvement
  2 24 technology efforts and includes an evaluation component.  The
  2 25 plan shall be developed by licensed professional staff of the
  2 26 school, including both teachers and administrators.  The plan
  2 27 shall, at a minimum, focus on the attainment of student
  2 28 achievement goals determined in accordance with section 256.7,
  2 29 subsection 21, and shall demonstrate how the school will
  2 30 utilize technology to improve student achievement.  Only one
  2 31 plan shall be required while technology is received under this
  2 32 section.  The technology plan shall be kept on file in the
  2 33 school and a copy of the plan, and any subsequent amendments
  2 34 to the plan, shall be sent to the department of education.
  2 35 Progress made under the plan shall be included as part of the
  3  1 annual comprehensive school improvement plan submitted to the
  3  2 department of education in compliance with section 256.7,
  3  3 subsection 21.
  3  4    5.  Notwithstanding section 295.2, subsection 8, for
  3  5 purposes of this section, "school district" does not mean the
  3  6 Iowa braille and sight saving school, the state school for the
  3  7 deaf, the Price laboratory school at the university of
  3  8 northern Iowa, and the institutions under the control of the
  3  9 department of human services as provided in section 218.1,
  3 10 subsections 1 through 3, 5, 7, and 8.
  3 11    6.  The provisions of section 256D.8, subsection 2, shall
  3 12 not apply.
  3 13    Sec. 3.  Section 295.2, subsection 1, paragraph c, Code
  3 14 1999, is amended to read as follows:
  3 15    c.  There is appropriated from the general fund of the
  3 16 state to the department of education for each fiscal year of
  3 17 the fiscal period beginning July 1, 1997, and ending June 30,
  3 18 2001 2000, the sum of thirty million dollars for the school
  3 19 improvement technology program.
  3 20    Sec. 4.  Section 295.2, subsection 1, Code 1999, is amended
  3 21 by adding the following new paragraph:
  3 22    NEW PARAGRAPH.  d.  There is appropriated from the general
  3 23 fund of the state to the department of education for the
  3 24 fiscal year beginning July 1, 2000, and ending June 30, 2001,
  3 25 the sum of thirty-two million five hundred thousand dollars
  3 26 for the school improvement technology program.  
  3 27                           EXPLANATION
  3 28    This bill permits accredited nonpublic schools to receive
  3 29 school improvement technology and school improvement
  3 30 technology block grant program moneys by increasing the
  3 31 appropriation to the programs to $32.5 million annually and
  3 32 requiring that $2.5 million annually be used to make
  3 33 technology that is comparable to that purchased by a school
  3 34 district, available to students of accredited nonpublic
  3 35 schools.
  4  1    The bill directs the department of education to ascertain a
  4  2 maximum annual amount a school district will be required to
  4  3 use for the purchase of technology for participating
  4  4 accredited nonpublic schools within its boundaries.  The
  4  5 amount shall be in the proportion that the basic enrollment of
  4  6 a participating accredited nonpublic school bears to the sum
  4  7 of the basic enrollments of all participating accredited
  4  8 nonpublic schools in the state for the budget year.  Each
  4  9 year, the authorities in charge of a participating accredited
  4 10 nonpublic school must certify its actual enrollment to the
  4 11 department of education by October 1.  By October 15, the
  4 12 department notifies the board of directors of each school
  4 13 district of the maximum amount of its allocation that must be
  4 14 made available for purchasing technology for each of the
  4 15 participating accredited nonpublic schools located within the
  4 16 school district in accordance with this section.  The
  4 17 technology made available to accredited nonpublic schools in
  4 18 accordance with this section shall be comparable to the
  4 19 technology of the district of attendance.
  4 20    Prior to receiving technology, the authorities in charge of
  4 21 an accredited nonpublic school must adopt, and file with the
  4 22 department of education, a technology plan that supports
  4 23 school improvement technology efforts and includes an
  4 24 evaluation component.  The plan shall, at a minimum, focus on
  4 25 the attainment of student achievement goals, determined under
  4 26 the school's comprehensive school improvement plan, and
  4 27 demonstrate how the school will utilize technology to improve
