PAG LIN 1 1 SENATE FILE 2047 1 2 1 3 AN ACT 1 4 RELATING TO THE POWERS AND DUTIES OF COUNTY OFFICERS WITH 1 5 RESPECT TO COUNTY WARRANTS. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 331.506, subsection 1, Code 1999, is 1 10 amended to read as follows: 1 11 1. a. Except as provided in subsections 2 and 3, the 1 12 auditor shall prepare and signor issuea county warrant only 1 13 afterapprovalissuance of the warrant has been approved by 1 14 the board by recorded vote. Each warrant shall be numbered 1 15 and the date, amount, number, name of the person to whom 1 16 issued, and the purpose for which the warrant is issued, shall 1 17 be entered in the county system. Each warrant shall be made 1 18 payable to the person performing the service or furnishing the 1 19 supplies for which the warrant makes payment. 1 20 b. The auditor shall not issue a warrant to a drawee until 1 21 the auditor has transmitted to the treasurer a list of the 1 22 warrants to be issued. The list shall include the date, 1 23 amount, and number of the warrant, name of the person to whom 1 24 the warrant is issued, and the purpose for which the warrant 1 25 is issued. The treasurer shall acknowledge receipt of the 1 26 list by affixing the treasurer's signature at the bottom of 1 27 the list and immediately returning the list to the auditor. 1 28 The requirement that the treasurer sign to acknowledge receipt 1 29 of the list is satisfied by use of a digital signature or 1 30 other secure electronic signature if the county auditor and 1 31 treasurer have complied with the applicable provisions of 1 32 chapter 554C. 1 33 c. The warrant list signed by the treasurer shall be 1 34 preserved by the auditor for at least two years. The 1 35 requirement that the list be preserved is satisfied by 2 1 preservation of the list in electronic form if the 2 2 requirements of section 554C.205 are met. 2 3 d. The requirement that the county auditor sign a warrant 2 4 is satisfied by use of a digital signature or other secure 2 5 electronic signature if the county auditor has complied with 2 6 the applicable provisions of chapter 554C. 2 7 e. In lieu of the auditor issuing a warrant to a drawee, 2 8 the auditor may issue a warrant payment order to the county 2 9 treasurer. Upon receipt of the warrant payment order, the 2 10 treasurer may submit payment to the drawee through an 2 11 electronic funds transfer system. 2 12 Sec. 2. Section 331.552, Code 1999, is amended by adding 2 13 the following new subsection: 2 14 NEW SUBSECTION. 33. Carry out duties relating to warrant 2 15 lists provided by the county auditor pursuant to section 2 16 331.506, subsection 1. 2 17 Sec. 3. Section 331.554, subsection 4, Code 1999, is 2 18 amended to read as follows: 2 19 4. The treasurer shall return the paid warrants to the 2 20 auditor. The original warrant shall be preserved for at least 2 21 two years. The requirement that the original warrant be 2 22 preserved is satisfied by preservation of the warrant in 2 23 electronic form if the requirements of section 554C.205 are 2 24 met. The treasurer shall make monthly reports to show for 2 25 each warrant the number, date, drawee's name, when paid, to 2 26 whom paid, original amount, and interest. 2 27 Sec. 4. Section 331.554, subsection 6, Code 1999, is 2 28 amended to read as follows: 2 29 6. The amount of a check, other than a warrant, 2 30 outstanding for more than two years shall be paid to the 2 31 treasurer and credited as unclaimed fees and trusts. The 2 32 treasurer shall provide a list of the checks to the auditor 2 33 who shall maintain a record of the unclaimed fees and trusts. 2 34 A person may claim an unclaimed fee or trust within five years 2 35 after the money is credited upon proper proof of ownership. 3 1 3 2 3 3 3 4 MARY E.
