PAG LIN 1 1 SENATE FILE 2031 1 2 1 3 AN ACT 1 4 RELATING TO VIOLATIONS OF THE SEX OFFENDER REGISTRY 1 5 REQUIREMENTS AND PROVIDING AN EFFECTIVE DATE. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 692A.3, Code Supplement 1999, is 1 10 amended to read as follows: 1 11 692A.3 REGISTRATION PROCESS. 1 12 1. A person required to register under this chapter shall 1 13 register with the sheriff of the county of the person's 1 14 residence withintenfive days of establishment of residence 1 15 in this state or withintenfive days of any conviction for 1 16 which the person is not incarcerated, a release from custody, 1 17 or placement on probation, parole, or work release. A sheriff 1 18 shall accept the registration of a nonresident of the county 1 19 if the person required to register is a full-time or part-time 1 20 student or is employed on a full-time or part-time basis in 1 21 the county. 1 22 2. A person required to register under this chapter shall, 1 23 withintenfive days of changing residence within a county in 1 24 this state or withintenfive days of a change in the person's 1 25 name as a result of marriage, dissolution of marriage, or a 1 26 legal name change, notify the sheriff of the county in which 1 27 the person is registered of the change of address, name, and 1 28 any changes in the person's telephone number in writing on a 1 29 form provided by the sheriff. The sheriff shall send a copy 1 30 of the change of information to the department within three 1 31 working days of receipt of notice of the change. The sex 1 32 offender registry shall maintain and make available 1 33 information from the registry cross-referenced by name at the 1 34 time of conviction and by name subsequent to any change. 1 35 3. A person required to register under this chapter shall 2 1 register with the sheriff of a county in which residence has 2 2 been newly established and notify the sheriff of the county in 2 3 which the person was registered, withintenfive days of 2 4 changing residence to a location outside the county in which 2 5 the person was registered. Registration shall be in writing 2 6 on a form provided by the sheriff and shall include the 2 7 person's change of address and any changes to the person's 2 8 telephone number or name. The sheriff shall send a copy of 2 9 the change of information to the department within three 2 10 working days of receipt of notice of the change. 2 11 4. A person required to register under this chapter shall 2 12 notify the sheriff of the county in which the person is 2 13 registered, withintenfive days of changing residence to a 2 14 location outside this state, of the new residence address and 2 15 any changes in telephone number or name. The sheriff shall 2 16 send a copy of the change to the department within three 2 17 working days of receipt of notice of the change. The person 2 18 must register with the registering agency of the other state 2 19 withintenfive days of changing residency, if persons are 2 20 required to register under the laws of the other state. The 2 21 department shall notify the registering agency in the other 2 22 state of the registrant's new address, telephone number, or 2 23 name. 2 24 5. The collection of information by a court or releasing 2 25 agency under section 692A.5 shall serve as the person's 2 26 initial registration for purposes of this section. The court 2 27 or releasing agency shall forward a copy of the registration 2 28 to the department within three working days of completion of 2 29 registration. 2 30 Sec. 2. Section 692A.5, subsection 1, paragraphs c and d, 2 31 Code Supplement 1999, are amended to read as follows: 2 32 c. Inform the person that, withintenfive days of 2 33 changing residence, registration with the sheriff in the 2 34 county in which residence is established is required, if the 2 35 residence is within the state. 3 1 d. Inform the person that if the person moves the person's 3 2 residence to another state, the person must give the person's 3 3 new address to the sheriff's department in the county of the 3 4 person's old residence withintenfive days of changing 3 5 addresses, and that, if the other state has a registration 3 6 requirement, the person is also required to register in the 3 7 new state of residence, not later thantenfive days after 3 8 establishing residence in the other state and to verify the 3 9 address at least annually. 3 10 Sec. 3. Section 692A.7, subsection 1, Code 1999, is 3 11 amended to read as follows: 3 12 1. Awillful failure to register as required under this3 13chapter isperson required to register under this chapter who 3 14 knowingly violates any requirements specified under sections 3 15 692A.2 through 692A.4 commits an aggravated misdemeanor for a 3 16 first offense and a class "D" felony for a second or 3 17 subsequent offense. However, a personwho willfully fails to3 18register as required under this chapterrequired to register 3 19 under this chapter who knowingly violates any of the 3 20 requirements specified under sections 692A.2 through 692A.4 3 21 and who commits a criminal offense against a minor, sexual 3 22 exploitation, an other relevant offense, or a sexually violent 3 23 offense is guilty of a class "C" felony. Any fine imposed for 3 24 a second or subsequentoffenseviolation shall not be 3 25 suspended. The court shall not defer judgment or sentence for 3 26 any violation ofthe registrationany requirementsof this3 27chapterspecified under sections 692A.2 through 692A.4.The3 28willful failureA knowing violation of a person who is on 3 29 probation, parole,orwork release, or any other form of 3 30 release toregister as required under this chaptercomply with 3 31 any requirements specified under sections 692A.2 through 3 32 692A.4 shall result in the automatic revocation of the 3 33 person's probation, parole, or work release. 3 34 Sec. 4. EFFECTIVE DATE. The section of this Act amending 3 35 section 692A.7, being deemed of immediate importance, takes 4 1 effect upon enactment. 4 2 4 3 4 4 4 5 MARY E.
