PAG LIN 1 1 Section 1. NEW SECTION. 89A.2A STATE BUILDING CODE 1 2 COMMISSIONER PASSENGER ELEVATORS. 1 3 Notwithstanding any provision of this chapter to the 1 4 contrary, the state building code commissioner shall 1 5 administer the provisions of this chapter for passenger 1 6 elevators. The state building code commissioner shall have 1 7 the authority granted the labor commissioner in this chapter 1 8 to adopt rules, inspect, issue permits, and enforce the 1 9 provisions of this chapter which relate to passenger 1 10 elevators. 1 11 Sec. 2. Section 103A.5, Code 1999, is amended by adding 1 12 the following new subsection: 1 13 NEW SUBSECTION. 6. Administer and enforce chapter 89 as 1 14 it relates to passenger elevators. 1 15 Sec. 3. STUDY. The state building code commissioner, in 1 16 consultation with the division of labor services of the 1 17 department of workforce development, shall study issues 1 18 concerning the transfer of authority and responsibility to 1 19 inspect passenger elevators from the division to the state 1 20 building code commissioner, as provided by this Act, and make 1 21 recommendations concerning its implementation. The state 1 22 building code commissioner shall issue a report, including its 1 23 findings and recommendations, to the co-chairpersons and 1 24 ranking members of the joint appropriations subcommittees on 1 25 administration and regulation and on economic development by 1 26 January 28, 2000. 1 27 Sec. 4. EFFECTIVE DATE. Sections 1 and 2 of this Act take 1 28 effect July 1, 2000. 1 29 EXPLANATION 1 30 This bill provides that the state building code 1 31 commissioner, and not the labor commissioner, shall be 1 32 responsible for inspecting and enforcing the requirements of 1 33 Code chapter 89 as it relates to passenger elevators. This 1 34 requirement takes effect July 1, 2000. 1 35 The bill also requires the state building code 2 1 commissioner, in consultation with the division of labor 2 2 services of the department of workforce development, to 2 3 conduct a study on issues involved in implementing the 2 4 requirements of the bill and to submit a report to two joint 2 5 appropriation subcommittees of the legislature by January 28, 2 6 2000. 2 7 LSB 2555SV 78 2 8 ec/gg/8
