PAG LIN 1 1 1 2 SENATE FILE 424 1 3 1 4 AN ACT 1 5 RELATING TO AND MAKING TRANSPORTATION AND OTHER INFRASTRUCTURE- 1 6 RELATED APPROPRIATIONS TO THE STATE DEPARTMENT OF TRANSPORTA- 1 7 TION, INCLUDING ALLOCATION AND USE OF MONEYS FROM THE GENERAL 1 8 FUND OF THE STATE, ROAD USE TAX FUND, AND PRIMARY ROAD FUND, 1 9 PROVIDING FOR A COMMERCIAL TRUCK PARKING STUDY, AND PROVIDING 1 10 FOR THE NONREVERSION OF CERTAIN MONEYS AND AN EFFECTIVE DATE. 1 11 1 12 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 13 1 14 STATE DEPARTMENT OF TRANSPORTATION 1 15 Section 1. There is appropriated from the general fund of 1 16 the state to the state department of transportation for the 1 17 fiscal year beginning July 1, 1999, and ending June 30, 2000, 1 18 the following amounts, or so much thereof as is necessary, to 1 19 be used for the purposes designated: 1 20 1. a. For providing assistance for the restoration, 1 21 conservation, improvement, and construction of railroad main 1 22 lines, branch lines, switching yards, and sidings as required 1 23 in section 327H.18, for use by the Iowa railway finance 1 24 authority as provided in chapter 327I: 1 25 ................................................. $ 1,424,672 1 26 If loan repayments received by the Iowa railway finance 1 27 authority for the fiscal year ending June 30, 2000, exceed the 1 28 amount appropriated in this paragraph, the amount appropriated 1 29 shall be increased to equal the amount of the loan repayments 1 30 received. 1 31 b. For airport engineering studies and improvement 1 32 projects as provided in chapter 328: 1 33 ................................................. $ 2,475,000 1 34 c. There is appropriated from the road use tax fund 2 5 to the state department of transportation for the fiscal year 2 6 beginning July 1, 1999, and ending June 30, 2000, the 2 7 following amounts, or so much thereof as is necessary, for the 2 8 purposes designated: 2 9 1. For the payment of costs associated with the production 2 10 of driver's licenses, as defined in section 321.1, subsection 2 11 20A: 2 12 ................................................. $ 2,069,000 2 13 Notwithstanding section 8.33, unencumbered or unobligated 2 14 funds remaining on June 30, 2000, from the appropriation made 2 15 in this subsection, shall not revert, but shall remain 2 16 available for the following fiscal years for the purposes 2 17 specified in this subsection. 2 18 2. For salaries, support, maintenance, and miscellaneous 2 19 purposes: 2 20 a. Operations and finance: 2 21 ................................................. $ 5,003,366 2 22 The division of information technology services in the 2 23 department of general services shall submit a report to the 2 24 legislative fiscal bureau and the joint appropriations 2 25 subcommittee on transportation, infrastructure, and capitals 2 26 of the general assembly concerning the use of any moneys paid 2 27 to the division from moneys appropriated to the operations and 2 28 finance division of the state department of transportation. 2 29 The report shall be submitted by January 1, 2000, and shall 2 30 include an itemized accounting of how the moneys so paid to 2 31 the division were used to benefit transportation in the state. 2 32 b. For improvements to the scale facility in Clarke 3 25 county: 3 26 .................................................. $ 550,000 3 27 Notwithstanding section 8.33, moneys appropriated in this 3 28 subsection that remain unencumbered or unobligated at the 3 29 close of the fiscal year shall not revert but shall remain 3 30 available for expenditure for the purpose designated until the 3 31 close of the fiscal year that begins July 1, 2002. 3 32 10. For up to the following amount for membership in the 3 33 North America's superhighway corridor coalition: 3 34 .................................................. $ 50,000 3 35 Sec. 3. For planning, design, and construction of field garage 5 29 facilities throughout the state: 5 30 .................................................. $ 1,050,000 5 31 The state department of transportation may use up to 5 32 $800,000 of the funds appropriated in this subsection for the 5 33 completion of a joint maintenance garage construction project. 5 34 The department shall enter into the necessary chapter 28E 5 35 agreements with participating local jurisdictions to implement 6 1 the project. 6 2 12. For the federal Americans With Disabilities Act 6 3 accessibility improvements to department facilities throughout 6 4 the state: 6 5 .................................................. $ 200,000 6 6 13. For remodeling the third floor of the administration 6 7 building in Ames, including the removal of asbestos and the 6 8 replacement of HVAC and electrical systems: 6 9 .................................................. $ 1,350,000 6 10 14. For replacement of the radiant heating systems in 6 11 field garage facilities throughout the state: 6 12 .................................................. $ 200,000 6 13 15. For tuckpointing and repair of the brick exteriors of 6 14 office buildings and field garage facilities throughout the 6 15 state: 6 16 .................................................. $ 100,000 6 17 16. For roof repairs to department facilities in Ames: 6 18 .................................................. $ 400,000 6 19 17. For assistance in purchasing biodegradable hydraulic 6 20 fluids manufactured from soybeans pursuant to sections 18.22 6 21 and 307.21: 6 22 .................................................. $ 15,000 6 23 18. For assistance in purchasing biodiesel fuel for use in 6 24 heavy-duty fleet vehicles of the department: 6 25 .................................................. $ 20,000 6 26 Notwithstanding section 8.33, moneys appropriated in 6 27 subsections 9 through 18 that remain unencumbered or 6 28 unobligated at the close of the fiscal year shall not revert 6 29 but shall remain available for expenditure for the purposes 6 30 designated until the close of the fiscal year that begins July 6 31 1, 2001. 6 32 Sec. 4. Section 321.11, Code 1999, is amended by adding 6 33 the following new unnumbered paragraph: 6 34 NEW UNNUMBERED PARAGRAPH. The department shall not sell 6 35 personal information which is in the form of a person's 7 1 photograph or digital image or a digital reproduction of a 7 2 person's photograph, regardless of whether an individual has 7 3 elected to prohibit disclosure of the information to the 7 4 general public. This paragraph does not prohibit the 7 5 department from collecting reasonable fees for copies of 7 6 records or other services provided pursuant to section 22.3, 7 7 321.10, or 622.46. 7 8 Sec. 5. HOURS OF SERVICE STUDY. The state department 7 9 of transportation shall conduct a study concerning hours of 7 10 service for drivers of vehicles operated for hire and designed 7 11 to transport more than six persons, including the driver. The 7 12 study shall not include hours of service for drivers of 7 13 vehicles offered to the public for hire that are used 7 14 principally in intracity operation and that are regulated by 7 15 local authorities pursuant to section 321.236. The department 7 16 shall report the findings of the study and make 7 17 recommendations regarding such findings to the general 7 18 assembly by January 1, 2000. 7 19 Sec. 6. 1998 Iowa Acts, chapter 1212, section 2, 7 20 subsection 10, is amended to read as follows: 7 21 10. For improvements to scale facility in Fremont county: 7 22 .................................................. $ 550,000 7 23 Notwithstanding section 8.33, moneys appropriated in this 7 24 subsection that remain unencumbered or unobligated at the 7 25 close of the fiscal year shall not revert but shall remain 7 26 available for expenditure for the purpose designated until the 7 27 close of the fiscal year that begins July 1, 2001. 7 28 Sec. 7. ADOPT-A-HIGHWAY PROGRAM DANGERS STUDY. The 7 29 state department of transportation shall conduct a study 7 30 regarding the possible dangers of eligible activities which 7 31 may be conducted by sponsors of the adopt-a-highway program 7 32 and regarding measures which could prevent or minimize harm to 7 33 the environment or to an individual participating in such 7 34 activities. The department shall submit a report on the 7 35 results of the study to the general assembly by January 1, 8 1 2000. 8 2 Sec. 8. COMMERCIAL TRUCK PARKING STUDY. The state 8 3 department of transportation shall, in consultation with 8 4 interested parties, review public policy issues related to the 8 5 state provision of commercial truck parking. The department 8 6 shall report its findings and recommendations to the general 8 7 assembly by January 1, 2000. 8 8 Sec. 9. EFFECTIVE DATE. Section 6 of this Act, amending 8 9 1998 Iowa Acts, chapter 1212, being deemed of immediate 8 10 importance, takes effect upon enactment. 8 11 8 12 8 13 8 14 MARY E.
