PAG LIN 1 1 SENATE FILE 398 1 2 1 3 AN ACT 1 4 RELATING TO THE REQUIREMENTS FOR ISSUANCE OF INTERMEDIATE 1 5 DRIVER'S LICENSES AND FULL DRIVER'S LICENSES AND PROVIDING 1 6 AN EFFECTIVE DATE. 1 7 1 8 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 9 1 10 Section 1. Section 321.180B, subsection 2, unnumbered 1 11 paragraph 1, Code 1999, is amended to read as follows: 1 12 The department may issue an intermediate driver's license 1 13 to a person sixteen or seventeen years of age who possesses an 1 14 instruction permit issued under subsection 1 or a comparable 1 15 instruction permit issued by another state for a minimum of 1 16 six months immediately preceding application, and who presents 1 17 an affidavit signed by a parent or guardian on a form to be 1 18 provided by the department that the permittee has accumulated 1 19 a total of twenty hours of street or highway driving of which 1 20 two hours were conducted after sunset and before sunrise and 1 21 the street or highway driving was with the permittee's parent, 1 22 guardian, instructor, a person certified by the department, or 1 23 a person at least twenty-five years of age who had written 1 24 permission from a parent or guardian to accompany the 1 25 permittee, and whose driving privileges have not been 1 26 suspended, revoked, or barred under this chapter or chapter 1 27 321J during, and who has been accident and conviction free 1 28 continuously for, the six-month period immediately preceding 1 29 the application for an intermediate license. An applicant for 1 30 an intermediate license must meet the requirements of section 1 31 321.186, including satisfactory completion of driver education 1 32 as required in section 321.178, and payment of the required 1 33 license fee before an intermediate license will be issued. A 1 34 person issued an intermediate license must limit the number of 1 35 passengers in the motor vehicle when the intermediate licensee 2 1 is operating the motor vehicle to the number of passenger 2 2 safety belts. 2 3 Sec. 2. Section 321.180B, subsection 4, Code 1999, is 2 4 amended to read as follows: 2 5 4. FULL DRIVER'S LICENSE. A full driver's license may be 2 6 issued to a person seventeen years of age who possesses an 2 7 intermediate license issued under subsection 2 or a comparable 2 8 intermediate license issued by another state for a minimum of 2 9 twelve months immediately preceding application, and who 2 10 presents an affidavit signed by a parent or guardian on a form 2 11 to be provided by the department that the intermediate 2 12 licensee has accumulated a total of ten hours of street or 2 13 highway driving of which two hours were conducted after sunset 2 14 and before sunrise and the street or highway driving was with 2 15 the licensee's parent, guardian, instructor, a person 2 16 certified by the department, or a person at least twenty-five 2 17 years of age who had written permission from a parent or 2 18 guardian to accompany the licensee, whose driving privileges 2 19 have not been suspended, revoked, or barred under this chapter 2 20 or chapter 321J during, and who has been accident and 2 21 conviction free continuously for, the twelve-month period 2 22 immediately preceding the application for a full driver's 2 23 license, and who has paid the required fee. 2 24 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 2 25 immediate importance, takes effect upon enactment. 2 26 2 27 2 28 2 29 MARY E.
