PAG LIN 1 1 Section 1. NEW SECTION. 15F.1 COMMISSION CREATED 1 2 MEMBERSHIP. 1 3 1. An Iowa products of high quality commission is created. 1 4 2. The membership of the commission shall consist of the 1 5 following eleven members: 1 6 a. The director of the department of economic development 1 7 or the director's designee. The director shall serve as the 1 8 chairperson of the commission. 1 9 b. Six persons appointed by the governor, subject to 1 10 confirmation by the senate. The members shall be appointed to 1 11 four-year staggered terms as designated by the governor and 1 12 until their successors are appointed. Vacancies shall be 1 13 filled by appointment by the governor for the unexpired term 1 14 of the original appointee. 1 15 c. Four members of the general assembly, with not more 1 16 than one member from each chamber being from the same 1 17 political party as the other member of that chamber. The two 1 18 senators shall be designated by the president of the senate 1 19 after consultation with the majority and minority leaders of 1 20 the senate. The two representatives shall be designated by 1 21 the speaker of the house of representatives after consultation 1 22 with the majority and minority leaders of the house of 1 23 representatives. Legislative members shall serve in an ex 1 24 officio, nonvoting capacity. Legislative members shall be 1 25 appointed to four-year terms of office, two of which shall 1 26 expire every two years. A legislative commission member's 1 27 position shall be deemed vacant if the member ceases to be a 1 28 member of the general assembly. A vacancy shall be filled by 1 29 appointment in the same manner as the original appointment for 1 30 the unexpired term of the predecessor. A legislative member 1 31 is eligible for per diem and expenses as provided in section 1 32 2.10. 1 33 d. All appointments shall comply with sections 69.16 and 1 34 69.16A. The term of office of each appointive member of the 1 35 commission shall begin and end as provided in section 69.19. 2 1 3. A majority of the members constitutes a quorum. 2 2 Sec. 2. NEW SECTION. 15F.2 POWERS AND DUTIES. 2 3 The commission shall: 2 4 1. Design and establish an "Iowa product of high quality" 2 5 logo. 2 6 2. Adopt rules establishing a procedure for the commission 2 7 to certify a product manufactured or produced in the state as 2 8 a high quality product. 2 9 3. Adopt rules establishing a procedure for the commission 2 10 to regulate the display or advertisement of the "Iowa product 2 11 of high quality" logo on a product certified under this 2 12 chapter. 2 13 4. Adopt rules establishing a procedure for the commission 2 14 to decertify a product certified under this chapter and for a 2 15 manufacturer or producer to appeal the decertification. 2 16 5. Adopt rules pursuant to chapter 17A for administering 2 17 this chapter. 2 18 Sec. 3. NEW SECTION. 15F.3 MEETINGS RECORDS. 2 19 1. The commission shall meet quarterly and at other times 2 20 as necessary. All meetings of the commission at which public 2 21 business is discussed or formal action is taken shall comply 2 22 with the requirements of chapter 21. 2 23 2. The commission shall keep and maintain its records as 2 24 public records pursuant to chapter 22. 2 25 Sec. 4. NEW SECTION. 15F.4 ORGANIZATION LOCATION 2 26 STAFF. 2 27 The commission is attached to the department of economic 2 28 development for organizational purposes and may accept 2 29 technical and operational assistance from the staff of the 2 30 department. The commission shall maintain offices within the 2 31 department's offices. 2 32 Sec. 5. NEW SECTION. 15F.5 REPORTS. 2 33 The commission shall submit an annual report by January 15 2 34 of each year to the governor, the general assembly, and the 2 35 department of economic development. The report shall provide 3 1 a detailed account of commission activities during the 3 2 previous calendar year, a list of all products currently 3 3 certified by the commission, and a list of all products 3 4 decertified by the commission. 3 5 EXPLANATION 3 6 This bill creates an Iowa products of high quality 3 7 commission consisting of 11 members. The bill provides for 3 8 the governor to appoint six members who shall serve four-year 3 9 staggered terms. The bill provides that four members of the 3 10 general assembly, with not more than one member from each 3 11 chamber being from the same political party, shall be 3 12 commission members for four-year terms. The bill provides 3 13 that the director of the department of economic development 3 14 shall be a commission member and shall serve as the 3 15 chairperson of the commission. 3 16 The bill provides that the commission shall design and 3 17 establish a "Iowa product of high quality" logo, adopt rules 3 18 establishing a procedure to certify and decertify a product 3 19 manufactured or produced in the state as a high quality 3 20 product, adopt rules establishing a procedure for appealing a 3 21 decertification, and adopt rules establishing a procedure for 3 22 regulating the display or advertisement of the "Iowa product 3 23 of high quality" logo. 3 24 The bill provides that the commission shall hold quarterly 3 25 meetings and at other times as necessary, shall be attached to 3 26 the department of economic development for organizational 3 27 purposes, shall maintain offices within the department's 3 28 offices, shall be staffed by the department, and shall submit 3 29 an annual report to the governor, the general assembly, and 3 30 the department of economic development regarding the 3 31 activities of the commission, activities during the previous 3 32 calendar year, and all products certified or decertified. 3 33 LSB 2254SS 78 3 34 tm/jw/5
