  1  1    Section 1.  DEPARTMENT OF EDUCATION.  There is appropriated
  1  2 from the general fund of the state to the department of
  1  3 education for the fiscal year beginning July 1, 1999, and
  1  4 ending June 30, 2000, the following amount, or so much thereof
  1  5 as is necessary, to be used for the purposes designated:
  1  6    For allocation to the state library for purposes of the
  1  7 enrich Iowa program as provided in section 256.57:  
  1  8 .................................................. $  1,000,000
  1  9    Notwithstanding section 8.33, moneys appropriated in this
  1 10 section that remain unencumbered or unobligated at the close
  1 11 of the fiscal year shall not revert but shall remain available
  1 12 for expenditure for the purposes designated until the close of
  1 13 the succeeding fiscal year.
  1 14    Sec. 2.  NEW SECTION.  256.57  ENRICH IOWA PROGRAM –
  1 15 INTENT.
  1 16    1.  The general assembly finds and declares that the public
  1 17 library is at the heart of each community, an integral
  1 18 component in this state's education system, and an invaluable
  1 19 source of wisdom and knowledge for this state's lifelong
  1 20 learners.  It is therefore in the interest of the citizens of
  1 21 Iowa that a comprehensive initiative be undertaken to reduce
  1 22 inequities in the provision of library services throughout the
  1 23 state and to provide public libraries with the funds necessary
  1 24 to meet the present and future needs of this state's citizens.
  1 25    2.  If the general assembly appropriates moneys for the
  1 26 enrich Iowa program, the enrich Iowa program is created within
  1 27 the department to be administered by the division.  Funds
  1 28 appropriated for purposes of the enrich Iowa program shall be
  1 29 distributed by the division to eligible public libraries that
  1 30 are in compliance with performance measures adopted by rule by
  1 31 the commission.  The amount distributed to each eligible
  1 32 public library shall be based upon the following:
  1 33    a.  The level of compliance by the eligible public library
  1 34 with the performance measures adopted by the commission as
  1 35 provided in this subsection.
  2  1    b.  The number of people residing within an eligible
  2  2 library's geographic service area for whom the library
  2  3 provides services.
  2  4    c.  The amount of other funding the eligible public library
  2  5 received in the previous fiscal year for providing services to
  2  6 rural residents and to contracting communities.
  2  7    3.  Moneys received by a public library under this section
  2  8 shall supplement, not supplant, any other funding received by
  2  9 the library.
  2 10    4.  For purposes of this section, "eligible public library"
  2 11 means a public library that meets at least all of the
  2 12 following requirements:
  2 13    a.  Submits to the division all of the following:
  2 14    (1)  The report provided for under section 256.51,
  2 15 subsection 1, paragraph "h".
  2 16    (2)  An application and accreditation report, in a format
  2 17 approved by the commission, that provides evidence of the
  2 18 library's compliance with at least one level of the standards
  2 19 established in accordance with section 256.51, subsection 1,
  2 20 paragraph "k".
  2 21    (3)  Any other application or report the division deems
  2 22 necessary for the implementation of the enrich Iowa program.
  2 23    b.  Participates in the library resource and information
  2 24 sharing programs established by the state library.
  2 25    c.  Is a public library established by city ordinance or a
  2 26 county library as provided in chapter 336.
  2 27    5.  Each eligible public library shall maintain a separate
  2 28 listing within their budgets for payments received and
  2 29 expenditures made pursuant to this section, and shall annually
  2 30 submit this listing to the division.
  2 31    6.  By January 15 of each year, the division shall submit a
  2 32 program evaluation report to the general assembly and the
  2 33 governor detailing the uses and the impacts of funds
  2 34 appropriated under this section.
  2 35    Sec. 3.  EMERGENCY RULES.  The commission of libraries
  3  1 shall adopt emergency rules under section 17A.4, subsection 2,
  3  2 and section 17A.5, subsection 2, paragraph "b", adopting the
  3  3 performance measures referred to in 286 IAC 3.6, and the rules
  3  4 shall be effective immediately upon filing unless a later date
  3  5 is specified in the rules.  Any rules adopted in accordance
  3  6 with this section shall also be published as a notice of
  3  7 intended action as provided in section 17A.4.
  3  8    Sec. 4.  EFFECTIVE DATE.  Section 3 of this Act, relating
  3  9 to emergency rules, being deemed of immediate importance,
  3 10 takes effect upon enactment.  
  3 11                           EXPLANATION
  3 12    This bill establishes the enrich Iowa program within the
  3 13 department of education and administered by the division of
  3 14 libraries and information services and appropriates $1,000,000
  3 15 from the general fund of the state for direct distribution to
  3 16 eligible city and county public libraries in compliance with
  3 17 performance measures adopted by the commission of libraries.
  3 18    The amount distributed to a library under the bill shall be
  3 19 based upon compliance, the number of people residing within
  3 20 the library's geographic service area, and the amount of
  3 21 funding the library received in the previous fiscal year for
  3 22 service to rural residents and to contracting communities.
  3 23    Each eligible public library shall maintain a separate
  3 24 listing within its budget for payments received and
  3 25 expenditures under the program, and must annually submit the
  3 26 listing to the division.
  3 27    The bill directs the division to submit, by January 15 of
  3 28 each year, a program evaluation report to the general assembly
  3 29 and the governor detailing the use and the impact of funds
  3 30 appropriated.
  3 31    The bill directs the commission of libraries to adopt
  3 32 emergency rules setting forth the performance measures
  3 33 referred to in 286 IAC 3.6, and the rules shall be effective
  3 34 immediately upon filing unless a later date is specified in
  3 35 the rules.  This provision takes effect upon enactment.
