  1  1    Section 1.  Section 282.26, Code 1999, is amended to read
  1  2 as follows:
  1  3    282.26  HIGH SCHOOL STUDENTS ATTENDING ADVANCED COURSES.
  1  4    1.  The board of any community college may, by mutual
  1  5 agreement with any college or university, permit any specially
  1  6 qualified high school student to attend advanced courses of
  1  7 academic instruction at the college or university.
  1  8    The state board of regents and the state board of education
  1  9 may by rule permit such students to attend any institution of
  1 10 higher learning under their jurisdiction.  Credit earned in
  1 11 any such course at a college or university may be applied
  1 12 toward credit for high school graduation.  Public school funds
  1 13 shall not be expended for payment of tuition or other costs
  1 14 for such attendance at a college or university, unless the
  1 15 payment is expressly permitted or required by law.
  1 16    The foregoing provisions shall also apply to colleges and
  1 17 universities in adjacent states when the institutions are
  1 18 located nearer to the homes or schools of the school district
  1 19 than the closest college or university within the state.
  1 20    2.  The board of directors of a school district may enter
  1 21 into a contract with a community college as defined in section
  1 22 260C.2, an institution of higher learning under the control of
  1 23 the state board of regents, or an accredited private
  1 24 institution as defined in section 261.9, for instruction to be
  1 25 provided to high school students at a secondary school
  1 26 attendance center by instructional staff employed by the
  1 27 postsecondary institution, or for instruction via the Iowa
  1 28 communications network by instructional staff employed by the
  1 29 postsecondary institution.  Secondary school students who
  1 30 successfully complete postsecondary-level instruction through
  1 31 such an arrangement shall receive high school credit and may
  1 32 also receive college credit if the student enrolls in and is
  1 33 accepted by the postsecondary institution and pays a tuition
  1 34 amount set by the postsecondary institution.  If a
  1 35 postsecondary institution accepts a student for enrollment in
  2  1 accordance with this section, the postsecondary institution
  2  2 shall send written notice to the student listing the course,
  2  3 the clock hours the student will be attending the course, and
  2  4 the number of hours of postsecondary academic or vocational-
  2  5 technical credit that the student will receive from the
  2  6 postsecondary institution upon successful completion of the
  2  7 course.  A student who receives postsecondary academic or
  2  8 vocational-technical credit from a community college in
  2  9 accordance with this section shall not be included in the
  2 10 full-time equivalent enrollment of the community college for
  2 11 the purpose of computing general aid to the community college.
  2 12 The provisions of chapter 261C shall not apply to instruction
  2 13 provided in accordance with this subsection.  
  2 14                           EXPLANATION
  2 15    This bill permits the board of directors of a school
  2 16 district to enter into a contract with a community college,
  2 17 regents university, or an accredited private institution, for
  2 18 instruction to be provided to high school students at a
  2 19 secondary school attendance center by instructional staff
  2 20 employed by the postsecondary institution, or for instruction
  2 21 via the Iowa communications network by instructional staff
  2 22 employed by the postsecondary institution.
  2 23    Secondary school students who successfully complete
  2 24 postsecondary-level instruction through the arrangement shall
  2 25 receive high school credit and may also receive college credit
  2 26 if the student enrolls in and is accepted by the postsecondary
  2 27 institution and pays a tuition amount set by the postsecondary
  2 28 institution.  If a postsecondary institution accepts a student
  2 29 for enrollment in accordance with this section, the
  2 30 postsecondary institution shall send written notice to the

  2 32 be attending the course, and the number of hours of
  2 33 postsecondary academic or vocational-technical credit that the
