PAG LIN 1 1 Section 1. NEW SECTION. 455B.282 SURFACE WATER AND 1 2 GROUNDWATER MONITORING. 1 3 1. The commission shall establish and administer a long- 1 4 term surface water monitoring program which includes, at a 1 5 minimum, all of the following elements: 1 6 a. A significant number of fixed monitoring sites selected 1 7 to include a full array of geographical conditions and 1 8 watershed sizes. 1 9 b. Inclusion of lakes, reservoirs, ponds, and wetlands in 1 10 regular surface water monitoring. 1 11 c. High frequency of sampling at a significant number of 1 12 fixed station sites to provide information on contaminant 1 13 concentration and movement. 1 14 d. Analysis of samples for common pesticides at all fixed 1 15 station sites and analysis of pesticide metabolites at all 1 16 fixed station sites located at large river monitoring sites. 1 17 e. Implementation of watershed-based rotational monitoring 1 18 where a portion of the watersheds are intensively monitored on 1 19 a cyclical basis of one out of every five years. 1 20 f. Incorporation of biological monitoring into the 1 21 monitoring for all sites. 1 22 g. Surface water problem assessment and research. 1 23 h. Establishment and administration of a publicly owned 1 24 lake protection program designed to monitor, improve, restore, 1 25 and protect the environmental quality of all publicly owned 1 26 lakes in the state. 1 27 2. The commission shall establish and administer a long- 1 28 term groundwater monitoring program which includes, at a 1 29 minimum, the following elements: 1 30 a. Fixed station, long-term monitoring to collect baseline 1 31 data for trend analysis in six major aquifers and six hundred 1 32 fifteen wells. Water levels at the aquifer and well sites 1 33 shall be monitored and each site shall be regularly sampled 1 34 for inorganics, common herbicides, and selected volatile 1 35 organic compounds. 2 1 b. An ambient rotational groundwater quality monitoring 2 2 program. The program shall be conducted in a manner 2 3 consistent with at least the highest level of monitoring 2 4 conducted by the department prior to 1992. 2 5 c. Identification of groundwater quality issues and 2 6 conducting of research needed to address the issues. The 2 7 issues shall initially include, but not be limited to, all of 2 8 the following: 2 9 (1) Identification of storage and handling of hazardous 2 10 materials and facilities. 2 11 (2) The relative contribution of point and nonpoint 2 12 sources of groundwater contamination. 2 13 (3) The presence of organic chemicals in unsaturated 2 14 zones. 2 15 (4) The effects of large withdrawals on aquifers. 2 16 (5) Identification of recharge zones for all aquifers. 2 17 Sec. 2. BIOLOGICAL MARKER SYSTEM TASK FORCE. The 2 18 department of natural resources shall establish a biological 2 19 marker system task force. The task force shall examine issues 2 20 and provide recommendations to the department regarding the 2 21 creation of a biological marker system for the state. 2 22 Recommendations shall be submitted to the department by 2 23 December 31, 1999. 2 24 Sec. 3. APPROPRIATION. There is appropriated from the 2 25 general fund of the state to the department of natural 2 26 resources for the fiscal year beginning July 1, 1999, and 2 27 ending June 30, 2000, the following amount, or so much thereof 2 28 as is necessary, to be used for the purposes designated: 2 29 For funding a feasibility study for the establishment of 2 30 the surface water and groundwater monitoring programs as 2 31 required by section 455B.282, including salaries, support, 2 32 maintenance, and miscellaneous purposes: 2 33 .................................................. $ 56,000 2 34 Notwithstanding section 8.33, moneys appropriated in this 2 35 section which remain unexpended or unobligated on June 30, 3 1 2000, shall not revert to the general fund of the state but 3 2 shall remain available for the purposes designated for the 3 3 fiscal year beginning July 1, 2000. 3 4 Sec. 4. APPROPRIATION. There is appropriated from the 3 5 general fund of the state to the department of natural 3 6 resources for the fiscal year beginning July 1, 1999, and 3 7 ending June 30, 2000, the following amount, or so much thereof 3 8 as is necessary, to be used for the purposes designated: 3 9 For the surface water and groundwater monitoring programs 3 10 established in section 455B.282, including salaries, support, 3 11 maintenance, and miscellaneous purposes: 3 12 .................................................. $ 1,000,000 3 13 Notwithstanding section 8.33, moneys appropriated in this 3 14 section which remain unexpended or unobligated on June 30, 3 15 2000, shall not revert to the general fund of the state but 3 16 shall remain available for the purposes designated for the 3 17 fiscal year beginning July 1, 2000. 3 18 EXPLANATION 3 19 This bill requires the department of natural resources to 3 20 conduct long-term monitoring programs for surface water and 3 21 groundwater in the state. 3 22 The bill provides that the surface water monitoring program 3 23 shall include a significant number of fixed monitoring sites, 3 24 the inclusion of lakes, reservoirs, ponds, and wetlands in 3 25 monitoring, high frequency sampling at fixed sites, analysis 3 26 for common pesticides and analysis of pesticide metabolites at 3 27 fixed sites at large river monitoring sites, implementation of 3 28 watershed-based rotational monitoring, incorporation of 3 29 biological monitoring into the monitoring of all sites, and 3 30 establishing and administering a publicly owned lake 3 31 protection program. 3 32 The bill provides that the groundwater monitoring program 3 33 shall include long-term fixed station monitoring to collect 3 34 baseline data for trend analysis in six major aquifers and 615 3 35 wells, conduct an ambient rotational groundwater quality 4 1 monitoring program, and identify and research groundwater 4 2 issues. 4 3 The bill requires the department of natural resources to 4 4 establish a biological marker system task force to provide 4 5 recommendations to the department regarding the creation of a 4 6 biological marker system. 4 7 The bill appropriates to the department of natural 4 8 resources $1,056,000 for the surface water and groundwater 4 9 monitoring program and for a feasibility study of the program. 4 10 LSB 1568XS 78 4 11 tm/sc/14
