1 7 FUNDS ARE MORE OR LESS THAN ANTICIPATED OR IF FEDERAL BLOCK
1 8 GRANTS ARE MORE OR LESS THAN ANTICIPATED.

1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 11
1 12 Section 1. SUBSTANCE ABUSE APPROPRIATION.
1 13 1. There is appropriated from the fund created by section
1 14 8.41 to the Iowa department of public health for the federal
1 15 fiscal year beginning October 1, 1999, and ending September
1 16 30, 2000, the following amount:
1 17 ................................................ $ 11,945,086
1 18 a. Funds appropriated in this subsection are the
1 19 anticipated funds to be received from the federal government
1 20 for the designated federal fiscal year under 42 U.S.C.,
1 21 chapter 6A, subchapter XVII, which provides for the substance
1 22 abuse prevention and treatment block grant. The department
1 23 shall expend the funds appropriated in this subsection as
1 24 provided in the federal law making the funds available and in
1 25 conformance with chapter 17A.
1 26 b. Of the funds appropriated in this subsection, an amount
1 27 not exceeding 5 percent shall be used by the department for
1 28 administrative expenses.
1 29 c. The department shall expend no less than an amount
1 30 equal to the amount expended for treatment services in the
1 31 state fiscal year beginning July 1, 1998, for pregnant women
1 32 and women with dependent children.
1 33 d. Of the funds appropriated in this subsection, an amount
1 34 not exceeding $24,585 shall be used for audits.
1 35 2. The funds remaining from the appropriation made in
2 1 subsection 1 shall be allocated as follows:
2 2 a. At least 20 percent of the allocation shall be for
2 3 prevention programs.
2 4 b. At least 35 percent of the allocation shall be spent on
2 5 drug treatment and prevention activities.
2 6 c. At least 35 percent of the allocation shall be spent on
2 7 alcohol treatment and prevention activities.
2 8 3. The substance abuse block grant funds received from the
2 9 federal government in excess of the amount of the anticipated
2 10 federal fiscal year 1999-2000 award appropriated in subsection
2 11 1 shall be distributed at least 50 percent to treatment
2 12 programs and 50 percent to prevention programs except that,
2 13 based upon federal guidelines, the total amount of the excess
2 14 awarded to prevention programs shall not exceed $1,000,000.
2 15 Sec. 2. COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION.
2 16 1. a. There is appropriated from the fund created by
2 17 section 8.41 to the Iowa department of human services for the
2 18 federal fiscal year beginning October 1, 1999, and ending
2 19 September 30, 2000, the following amount:
2 20 ................................................ $ 2,740,750
2 21 b. Funds appropriated in this subsection are the
2 22 anticipated funds to be received from the federal government
2 23 for the designated federal fiscal year under 42 U.S.C.,
2 24 chapter 6A, subchapter XVII, which provides for the community
2 25 mental health services block grant. The department shall
2 26 expend the funds appropriated in this subsection as provided
2 27 in the federal law making the funds available and in
2 28 conformance with chapter 17A.
2 29 c. The administrator of the division of mental health and
2 30 developmental disabilities of the department of human services
2 31 shall allocate not less than 95 percent of the amount of the
2 32 block grant to eligible community mental health services
2 33 providers for carrying out the plan submitted to and approved
2 34 by the federal substance abuse and mental health services
2 35 administration for the fiscal year involved.
3 1 2. An amount not exceeding 5 percent of the funds
3 2 appropriated in subsection 1 shall be used by the department
3 3 of human services for administrative expenses. From the funds
3 4 set aside by this subsection for administrative expenses, the
3 5 division of mental health and developmental disabilities shall
3 6 pay to the auditor of state an amount sufficient to pay the
3 7 cost of auditing the use and administration of the state's
3 8 portion of the funds appropriated in subsection 1. The
3 9 auditor of state shall bill the division of mental health and
3 10 developmental disabilities for the costs of the audits.
3 11 Sec. 3. MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS.
3 12 1. There is appropriated from the fund created by section
3 13 8.41 to the Iowa department of public health for the federal
3 14 fiscal year beginning October 1, 1999, and ending September
3 15 30, 2000, the following amount:
3 16 ................................................ $ 6,969,580
3 17 The funds appropriated in this subsection are the funds
3 18 anticipated to be received from the federal government for the
3 19 designated federal fiscal year under 42 U.S.C., chapter 7,
3 20 subchapter V, which provides for the maternal and child health
3 21 services block grant. The department shall expend the funds
3 22 appropriated in this subsection as provided in the federal law
3 23 making the funds available and in conformance with chapter
3 24 17A.
3 25 Of the funds appropriated in this subsection, an amount not
3 26 exceeding $45,700 shall be used for audits.
3 27 Funds appropriated in this subsection shall not be used by
3 28 the university of Iowa hospitals and clinics for indirect
3 29 costs.
3 30 2. An amount not exceeding $150,000 of the funds
3 31 appropriated in subsection 1 to the Iowa department of public
3 32 health shall be used by the Iowa department of public health
3 33 for administrative expenses in addition to the amount to be
3 34 used for audits in subsection 1.
3 35 The departments of public health, human services, and
4 1 education and the university of Iowa's mobile and regional
4 2 child health specialty clinics shall continue to pursue to the
4 3 maximum extent feasible the coordination and integration of
4 4 services to women and children.
4 5 3. a. Sixty-three percent of the remaining funds
4 6 appropriated in subsection 1 shall be allocated to supplement
4 7 appropriations for maternal and child health programs within
4 8 the Iowa department of public health. Of these funds,
4 9 $284,548 shall be set aside for the statewide perinatal care
4 10 program.
4 11 b. Thirty-seven percent of the remaining funds
4 12 appropriated in subsection 1 shall be allocated to the
4 13 university of Iowa hospitals and clinics under the control of
4 14 the state board of regents for mobile and regional child
4 15 health specialty clinics. The university of Iowa hospitals
4 16 and clinics shall not receive an allocation for indirect costs
4 17 from the funds for this program. Priority shall be given to
4 18 establishment and maintenance of a statewide system of mobile
4 19 and regional child health specialty clinics.
4 20 4. The Iowa department of public health shall administer
4 21 the statewide maternal and child health program and the
4 22 crippled children's program by conducting mobile and regional
4 23 child health specialty clinics and conducting other activities
4 24 to improve the health of low-income women and children and to
4 25 promote the welfare of children with actual or potential
4 26 handicapping conditions and chronic illnesses in accordance
4 27 with the requirements of Title V of the federal Social
4 28 Security Act.
4 29 Sec. 4. PREVENTIVE HEALTH AND HEALTH SERVICES
4 30 APPROPRIATIONS.
4 31 1. There is appropriated from the fund created by section
4 32 8.41 to the Iowa department of public health for the federal
4 33 fiscal year beginning October 1, 1999, and ending September
4 34 30, 2000, the following amount:
4 35 ................................................ $ 2,128,352
5 1 Funds appropriated in this subsection are the funds
5 2 anticipated to be received from the federal government for the
5 3 designated federal fiscal year under 42 U.S.C., chapter 6A,
5 4 subchapter XVII, which provides for the preventive health and
5 5 health services block grant. The department shall expend the
5 6 funds appropriated in this subsection as provided in the
5 7 federal law making the funds available and in conformance with
5 8 chapter 17A.
5 9 Of the funds appropriated in this subsection, an amount not
5 10 exceeding $5,522 shall be used for audits.
5 11 2. Of the funds appropriated in subsection 1, the specific
5 12 amount of funds stipulated by the notice of block grant award
5 13 shall be allocated for services to victims of sex offenses and
5 14 for rape prevention education.
5 15 3. An amount not exceeding $94,670 of the remaining funds
5 16 appropriated in subsections 1 and 2 shall be used by the Iowa
5 17 department of public health for administrative expenses in
5 18 addition to the amount to be used for audits in subsection 1.
5 19 4. After deducting the funds allocated in subsections 1,
5 20 2, and 3, the remaining funds appropriated in subsection 1
5 21 shall be used by the department for healthy people 2000 and
5 22 2010/healthy Iowans 2000 and 2010 program objectives,
5 23 preventive health advisory committee, and risk reduction
5 24 services, including nutrition programs, health incentive
5 25 programs, chronic disease services, emergency medical
5 26 services, monitoring of the fluoridation program and start-up
5 27 fluoridation grants, and acquired immune deficiency syndrome
5 28 services. The moneys specified in this subsection shall not
5 29 be used by the university of Iowa hospitals and clinics or by
5 30 the state hygienic laboratory for the funding of indirect
5 31 costs. Of the funds used by the department under this
5 32 subsection, an amount not exceeding $90,000 shall be used for
5 33 the monitoring of the fluoridation program and for start-up
5 34 fluoridation grants to public water systems, and at least
5 35 $50,000 shall be used to provide chlamydia testing.
6 1 Sec. 5. DRUG CONTROL AND SYSTEM IMPROVEMENT GRANT PROGRAM
6 2 APPROPRIATION.
6 3 1. There is appropriated from the fund created in section
6 4 8.41 to the office of the governor for the drug enforcement
6 5 and abuse prevention coordinator for the federal fiscal year
6 6 beginning October 1, 1999, and ending September 30, 2000, the
6 7 following amount:
6 8 ................................................ $ 5,865,000
6 9 Funds appropriated in this subsection are the anticipated
6 10 funds to be received from the federal government for the
6 11 designated fiscal year under 42 U.S.C., chapter 46, subchapter
6 12 V, which provides for the drug control and system improvement
6 13 grant program. The drug enforcement and abuse prevention
6 14 coordinator shall expend the funds appropriated in this
6 15 subsection as provided in the federal law making the funds
6 16 available and in conformance with chapter 17A.
6 17 2. An amount not exceeding 7 percent of the funds
6 18 appropriated in subsection 1 shall be used by the drug
6 19 enforcement and abuse prevention coordinator for
6 20 administrative expenses. From the funds set aside by this
6 21 subsection for administrative expenses, the drug enforcement
6 22 and abuse prevention coordinator shall pay to the auditor of
6 23 state an amount sufficient to pay the cost of auditing the use
6 24 and administration of the state's portion of the funds
6 25 appropriated in subsection 1.
6 26 Sec. 6. STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM
6 27 APPROPRIATION.
6 28 1. There is appropriated from the fund created in section
6 29 8.41 to the office of the governor for the drug enforcement
6 30 and abuse prevention coordinator for the federal fiscal year
6 31 beginning October 1, 1999, and ending September 30, 2000, the
6 32 following amount:
6 33 ................................................ $ 1,647,000
6 34 Funds appropriated in this subsection are the anticipated
6 35 funds to be received from the federal government for the
7 1 designated fiscal year under 42 U.S.C., chapter 46, subchapter
7 2 XII-H, which provides for grants to combat violent crimes
7 3 against women. The drug enforcement and abuse prevention
7 4 coordinator shall expend the funds appropriated in this
7 5 subsection as provided in the federal law making the funds
7 6 available and in conformance with chapter 17A.
7 7 2. An amount not exceeding 5 percent of the funds
7 8 appropriated in subsection 1 shall be used by the drug
7 9 enforcement and abuse prevention coordinator for
7 10 administrative expenses. From the funds set aside by this
7 11 subsection for administrative expenses, the drug enforcement
7 12 and abuse prevention coordinator shall pay to the auditor of
7 13 the state an amount sufficient to pay the cost of auditing the
7 14 use and administration of the state's portion of the funds
7 15 appropriated in subsection 1.
7 16 Sec. 7. LOCAL LAW ENFORCEMENT BLOCK GRANT APPROPRIATION.
7 17 1. There is appropriated from the fund created in section
7 18 8.41 to the office of the governor for the drug enforcement
7 19 and abuse prevention coordinator for the federal fiscal year
7 20 beginning October 1, 1999, and ending September 30, 2000, the
7 21 following amount:
7 22 ................................................ $ 322,049
7 23 Funds appropriated in this subsection are the funds
7 24 anticipated to be received from the federal government for the
7 25 designated federal fiscal year under annual federal
7 26 appropriations which provide for grants to reduce crime and
7 27 improve public safety. The drug enforcement and abuse
7 28 prevention coordinator shall expend the funds appropriated in
7 29 this subsection as provided in the federal law making the
7 30 funds available and in conformance with chapter 17A.
7 31 2. An amount not exceeding 3 percent of the funds
7 32 appropriated in subsection 1 shall be used by the drug
7 33 enforcement and abuse prevention coordinator for
7 34 administrative expenses. From the funds set aside by this
7 35 subsection for administrative expenses, the drug enforcement
8 1 and abuse prevention coordinator shall pay to the auditor of
8 2 state an amount sufficient to pay the cost of auditing the use
8 3 and administration of the state's portion of the funds
8 4 appropriated in subsection 1.
8 5 Sec. 8. RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE
8 6 PRISONERS FORMULA GRANT PROGRAM. There is appropriated from
8 7 the fund created in section 8.41 to the office of the governor
8 8 for the drug enforcement and abuse prevention coordinator for
8 9 the federal fiscal year beginning October 1, 1999, and ending
8 10 September 30, 2000, the following amount:
8 11 ................................................ $ 514,497
8 12 Funds appropriated in this section are the funds
8 13 anticipated to be received from the federal government for the
8 14 designated federal fiscal year under 42 U.S.C., chapter 136,
8 15 which provides grants for substance abuse treatment programs
8 16 in state and local correctional facilities. The drug
8 17 enforcement and abuse prevention coordinator shall expend the
8 18 funds appropriated in this section as provided in the federal
8 19 law making the funds available and in conformance with chapter
8 20 17A.
8 21 Sec. 9. COMMUNITY SERVICES APPROPRIATIONS.
8 22 1. a. There is appropriated from the fund created by
8 23 section 8.41 to the division of community action agencies of
8 24 the department of human rights for the federal fiscal year
8 25 beginning October 1, 1999, and ending September 30, 2000, the
8 26 following amount:
8 27 ................................................ $ 5,378,447
8 28 Funds appropriated in this subsection are the funds
8 29 anticipated to be received from the federal government for the
8 30 designated federal fiscal year under 42 U.S.C., chapter 106,
8 31 which provides for the community services block grant. The
8 32 division of community action agencies of the department of
8 33 human rights shall expend the funds appropriated in this
8 34 subsection as provided in the federal law making the funds
8 35 available and in conformance with chapter 17A.
9 1 b. The administrator of the division of community action
9 2 agencies of the department of human rights shall allocate not
9 3 less than 96 percent of the amount of the block grant to
9 4 eligible community action agencies for programs benefiting
9 5 low-income persons. Each eligible agency shall receive a
9 6 minimum allocation of not less than $100,000. The minimum
9 7 allocation shall be achieved by redistributing increased funds
9 8 from agencies experiencing a greater share of available funds.
9 9 The funds shall be distributed on the basis of the poverty-
9 10 level population in the area represented by the community
9 11 action areas compared to the size of the poverty-level
9 12 population in the state.
9 13 2. An amount not exceeding 4 percent of the funds
9 14 appropriated in subsection 1 shall be used by the division of
9 15 community action agencies of the department of human rights
9 16 for administrative expenses. From the funds set aside by this
9 17 subsection for administrative expenses, the division of
9 18 community action agencies of the department of human rights
9 19 shall pay to the auditor of state an amount sufficient to pay
9 20 the cost of auditing the use and administration of the state's
9 21 portion of the funds appropriated in subsection 1. The
9 22 auditor of state shall bill the division of community action
9 23 agencies for the costs of the audits.
9 24 Sec. 10. COMMUNITY DEVELOPMENT APPROPRIATIONS.
9 25 1. There is appropriated from the fund created by section
9 26 8.41 to the department of economic development for the federal
9 27 fiscal year beginning October 1, 1999, and ending September
9 28 30, 2000, the following amount:
9 29 ................................................ $ 29,939,000
9 30 Funds appropriated in this subsection are the funds
9 31 anticipated to be received from the federal government for the
9 32 designated federal fiscal year under 42 U.S.C., chapter 69,
9 33 which provides for community development block grants. The
9 34 department of economic development shall expend the funds
9 35 appropriated in this subsection as provided in the federal law
10 1 making the funds available and in conformance with chapter
10 2 17A.
10 3 2. An amount not exceeding $1,397,560 for the federal
10 4 fiscal year beginning October 1, 1999, shall be used by the
10 5 department of economic development for administrative expenses
10 6 for the community development block grant. The total amount
10 7 used for administrative expenses includes $698,780 for the
10 8 federal fiscal year beginning October 1, 1999, of funds
10 9 appropriated in subsection 1 and a matching contribution from
10 10 the state equal to $698,780 from the appropriation of state
10 11 funds for the community development block grant and state
10 12 appropriations for related activities of the department of
10 13 economic development. From the funds set aside for
10 14 administrative expenses by this subsection, the department of
10 15 economic development shall pay to the auditor of state an
10 16 amount sufficient to pay the cost of auditing the use and
10 17 administration of the state's portion of the funds
10 18 appropriated in subsection 1. The auditor of state shall bill
10 19 the department for the costs of the audit.
10 20 Sec. 11. LOW-INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS.
10 21 1. There is appropriated from the fund created by section
10 22 8.41 to the division of community action agencies of the
10 23 department of human rights for the federal fiscal year
10 24 beginning October 1, 1999, and ending September 30, 2000, the
10 25 following amount:
10 26 ................................................ $ 19,951,229
10 27 The funds appropriated in this subsection are the funds
10 28 anticipated to be received from the federal government for the
10 29 designated federal fiscal year under 42 U.S.C., chapter 94,
10 30 subchapter II, which provides for the low-income home energy
10 31 assistance block grants. The division of community action
10 32 agencies of the department of human rights shall expend the
10 33 funds appropriated in this subsection as provided in the
10 34 federal law making the funds available and in conformance with
10 35 chapter 17A.
11 1 2. An amount not exceeding $1,995,122 or 10 percent of the
11 2 funds appropriated in subsection 1, whichever is less, may be
11 3 used for administrative expenses for the low-income home
11 4 energy assistance program. Not more than $290,000 shall be
11 5 used for administrative expenses of the division of community
11 6 action agencies of the department of human rights. From the
11 7 total funds set aside in this subsection for administrative
11 8 expenses for the low-income home energy assistance program, an
11 9 amount sufficient to pay the cost of an audit of the use and
11 10 administration of the state's portion of the funds
11 11 appropriated is allocated for that purpose. The auditor of
11 12 state shall bill the division of community action agencies for
11 13 the costs of the audits.
11 14 3. The remaining funds appropriated in subsection 1 shall
11 15 be allocated to help eligible households, as defined under 42
11 16 U.S.C., chapter 94, subchapter II, to meet the costs of home
11 17 energy. After reserving a reasonable portion of the remaining
11 18 funds not to exceed 10 percent of the funds appropriated in
11 19 subsection 1, to carry forward into the federal fiscal year
11 20 beginning October 1, 2000, at least 15 percent of the funds
11 21 appropriated in subsection 1 shall be used for low-income
11 22 residential weatherization or other related home repairs for
11 23 low-income households. Of this amount, an amount not
11 24 exceeding 10 percent may be used for administrative expenses.
11 25 4. An eligible household must be willing to allow
11 26 residential weatherization or other related home repairs in
11 27 order to receive home energy assistance. If the eligible
11 28 household resides in rental property, the unwillingness of the
11 29 landlord to allow residential weatherization or other related
11 30 home repairs shall not prevent the household from receiving
11 31 home energy assistance.
11 32 5. Not more than 5 percent of the funds appropriated in
11 33 subsection 1 shall be used for assessment and resolution of
11 34 energy problems.
11 35 Sec. 12. SOCIAL SERVICES APPROPRIATIONS.
12 1 1. There is appropriated from the fund created by section
12 2 8.41 to the department of human services for the federal
12 3 fiscal year beginning October 1, 1999, and ending September
12 4 30, 2000, the following amount:
12 5 ................................................ $ 20,408,465
12 6 Funds appropriated in this subsection are the funds
12 7 anticipated to be received from the federal government for the
12 8 designated federal fiscal year under 42 U.S.C., chapter 7,
12 9 subchapter XX, which provides for the social services block
12 10 grant. The department of human services shall expend the
12 11 funds appropriated in this subsection as provided in the
12 12 federal law making the funds available and in conformance with
12 13 chapter 17A.
12 14 2. Not more than $1,297,725 of the funds appropriated in
12 15 subsection 1 shall be used by the department of human services
12 16 for general administration. From the funds set aside in this
12 17 subsection for general administration, the department of human
12 18 services shall pay to the auditor of state an amount
12 19 sufficient to pay the cost of auditing the use and
12 20 administration of the state's portion of the funds
12 21 appropriated in subsection 1.
12 22 3. In addition to the allocation for general
12 23 administration in subsection 2, the remaining funds
12 24 appropriated in subsection 1 shall be allocated in the
12 25 following amounts to supplement appropriations for the federal
12 26 fiscal year beginning October 1, 1999, for the following
12 27 programs within the department of human services:
12 28 a. Field operations:

12 30 b. Child and family services:

12 32 c. Local administrative costs
12 33 and other local services:
12 34 ................................................ $ 823,166
12 35 d. Volunteers:

13 4 f. MH/MR/DD/BI community service (local purchase):
13 5 ................................................ $ 9,171,362
13 6 Sec. 13. SOCIAL SERVICES BLOCK GRANT PLAN. The department
13 7 of human services during each state fiscal year shall develop
13 8 a plan for the use of federal social services block grant
13 9 funds for the subsequent state fiscal year.
13 10 The proposed plan shall include all programs and services
13 11 at the state level which the department proposes to fund with
13 12 federal social services block grant funds, and shall identify
13 13 state and other funds which the department proposes to use to
13 14 fund the state programs and services.
13 15 The proposed plan shall also include all local programs and
13 16 services which are eligible to be funded with federal social
13 17 services block grant funds, the total amount of federal social
13 18 services block grant funds available for the local programs
13 19 and services, and the manner of distribution of the federal
13 20 social services block grant funds to the counties. The
13 21 proposed plan shall identify state and local funds which will
13 22 be used to fund the local programs and services.
13 23 The proposed plan shall be submitted with the department's
13 24 budget requests to the governor and the general assembly.
13 25 Sec. 14. PROJECTS FOR ASSISTANCE IN TRANSITION FROM
13 26 HOMELESSNESS. Upon receipt of the minimum formula grant from
13 27 the federal alcohol, drug abuse, and mental health
13 28 administration to provide mental health services for the
13 29 homeless, the division of mental health and developmental
13 30 disabilities of the department of human services shall assure
13 31 that a project which receives funds under the formula grant
13 32 from either the federal or local match share of 25 percent in
13 33 order to provide outreach services to persons who are
13 34 chronically mentally ill and homeless or who are subject to a
13 35 significant probability of becoming homeless shall do all of
14 1 the following:
14 2 1. Provide community mental health services, diagnostic
14 3 services, crisis intervention services, and habilitation and
14 4 rehabilitation services.
14 5 2. Refer clients to medical facilities for necessary
14 6 hospital services, and to entities that provide primary health
14 7 services and substance abuse services.
14 8 3. Provide appropriate training to persons who provide
14 9 services to persons targeted by the grant.
14 10 4. Provide case management to homeless persons.
14 11 5. Provide supportive and supervisory services to certain
14 12 homeless persons living in residential settings which are not
14 13 otherwise supported.
14 14 6. Projects may expend funds for housing services
14 15 including minor renovation, expansion and repair of housing,
14 16 security deposits, planning of housing, technical assistance
14 17 in applying for housing, improving the coordination of housing
14 18 services, the costs associated with matching eligible homeless
14 19 individuals with appropriate housing, and one-time rental
14 20 payments to prevent eviction.
14 21 Sec. 15. CHILD CARE AND DEVELOPMENT FUND. There is
14 22 appropriated from the fund created by section 8.41 to the
14 23 department of human services for the federal fiscal year
14 24 beginning October 1, 1999, and ending September 30, 2000, the
14 25 following amount:
14 26 ................................................ $ 27,142,057
14 27 Funds appropriated in this section are the funds
14 28 anticipated to be received from the federal government under
14 29 42 U.S.C., chapter 105, subchapter II-B, which provides for
14 30 the child care and development fund. The department shall
14 31 expend the funds appropriated in this section as provided in
14 32 the federal law making the funds available and in conformance
14 33 with chapter 17A.
14 34 Sec. 16. PROCEDURE FOR REDUCED FEDERAL FUNDS.
14 35 1. If the funds received from the federal government for
15 1 the block grants specified in this Act are less than the
15 2 amounts appropriated, the funds actually received shall be
15 3 prorated by the governor for the various programs, other than
15 4 for the services to victims of sex offenses and for rape
15 5 prevention education under section 4, subsection 2, of this
15 6 Act, for which each block grant is available according to the
15 7 percentages that each program is to receive as specified in
15 8 this Act. However, if the governor determines that the funds
15 9 allocated by the percentages will not be sufficient to effect
15 10 the purposes of a particular program, or if the appropriation
15 11 is not allocated by percentage, the governor may allocate the
15 12 funds in a manner which will effect to the greatest extent
15 13 possible the purposes of the various programs for which the
15 14 block grants are available.
15 15 2. Before the governor implements the actions provided for
15 16 in subsection 1, the following procedures shall be taken:
15 17 a. The chairpersons and ranking members of the senate and
15 18 house standing committees on appropriations, the appropriate
15 19 chairpersons and ranking members of subcommittees of those
15 20 committees, the director of the legislative service bureau,
15 21 and the director of the legislative fiscal bureau shall be
15 22 notified of the proposed action.
15 23 b. The notice shall include the proposed allocations, and
15 24 information on the reasons why particular percentages or
15 25 amounts of funds are allocated to the individual programs, the
15 26 departments and programs affected, and other information
15 27 deemed useful. Chairpersons notified shall be allowed at
15 28 least two weeks to review and comment on the proposed action
15 29 before the action is taken.
15 30 3. If the amount of moneys received from the federal
15 31 government for a specific grant number specified in this Act
15 32 is less than the amount appropriated, the amount appropriated
15 33 shall be reduced accordingly. An annual report listing any
15 34 such appropriation reduction shall be submitted to the fiscal
15 35 committee of the legislative council.
16 1 Sec. 17. PROCEDURE FOR INCREASED FEDERAL FUNDS.
16 2 1. If funds received from the federal government in the
16 3 form of block grants exceed the amounts appropriated in
16 4 sections 1, 2, 3, 4, 5, 7, 10, and 12 of this Act, the excess
16 5 shall be prorated to the appropriate programs according to the
16 6 percentages specified in those sections, except additional
16 7 funds shall not be prorated for administrative expenses.
16 8 2. If funds received from the federal government from
16 9 block grants exceed the amount appropriated in section 11 of
16 10 this Act for the low-income home energy assistance program, 15
16 11 percent of the excess shall be allocated to the low-income
16 12 residential weatherization program.
16 13 3. If funds received from the federal government from
16 14 community services block grants exceed the amount appropriated
16 15 in section 9 of this Act, 100 percent of the excess is
16 16 allocated to the community services block grant program.
16 17 4. If the amount of moneys received from the federal
16 18 government for a specific grant number specified in this Act
16 19 exceeds the amount appropriated, the excess amount is
16 20 appropriated for the purpose designated in the specific
16 21 grant's appropriation. An annual report listing any such
16 22 excess appropriations shall be submitted to the fiscal
16 23 committee of the legislative council.
16 24 Sec. 18. PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL
16 25 FUNDS. If other federal grants, receipts, and funds and other
16 26 nonstate grants, receipts, and funds become available or are
16 27 awarded which are not available or awarded during the period
16 28 in which the general assembly is in session, but which require
16 29 expenditure by the applicable department or agency prior to
16 30 March 15 of the fiscal year beginning July 1, 1999, and ending
16 31 June 30, 2000, these grants, receipts, and funds are
16 32 appropriated to the extent necessary, provided that the fiscal
16 33 committee of the legislative council is notified within thirty
16 34 days of receipt of the grants, receipts, or funds and the
16 35 fiscal committee of the legislative council has an opportunity
17 1 to comment on the expenditure of the grants, receipts, or
17 2 funds.

41 8 Sec. 58. LIHEAP FUNDING – DISCONNECTION PROHIBITION. It
41 9 is the intent of the general assembly that if the governor
41 10 determines federal funds are insufficient to adequately
41 11 provide for certification of eligibility for the low-income
41 12 home energy assistance program by the community action
41 13 agencies during the federal fiscal year which commences
41 14 October 1, 1999, the Iowa utilities board shall issue an order
41 15 prohibiting disconnection of service from November 1 through
41 16 April 1 by a regulated public utility furnishing gas or
41 17 electricity to households whose income falls at or below one
41 18 hundred fifty percent of the federal poverty level as
41 19 established by the United States office of management and
41 20 budget. The board shall promptly adopt rules in accordance
41 21 with section 17A.4, subsection 2, and section 17A.5,
41 22 subsection 2, paragraph "b", to implement this requirement.
41 23 The energy assistance bureau of the department of human
41 24 rights, in consultation with the community action agencies,
41 25 shall certify to the utilities, households that are eligible
41 26 for moratorium protection utilizing the agency's existing
41 27 electronic database. Rules adopted under this section shall
41 28 also be published as a notice of intended action as provided
41 29 in section 17A.4.
