  1  1    Section 1.  Section 321.288, subsection 5, Code 1999, is
  1  2 amended to read as follows:
  1  3    5.  When approaching and passing a slow moving vehicle
  1  4 displaying a reflective device or alternative reflective
  1  5 device as provided by section 321.383.
  1  6    Sec. 2.  Section 321.383, subsections 2 and 3, Code 1999,
  1  7 are amended to read as follows:
  1  8    2.  When operated on a highway in this state at a speed of
  1  9 thirty miles per hour or less, every farm tractor, or tractor
  1 10 with towed equipment, self-propelled implement of husbandry,
  1 11 road construction or maintenance vehicle, road grader, horse-
  1 12 drawn vehicle, or any other vehicle principally designed for
  1 13 use off the highway and any such tractor, implement, vehicle,
  1 14 or grader when manufactured for sale or sold at retail after
  1 15 December 31, 1971, shall be identified with a reflective
  1 16 device in accordance with the standards of the American
  1 17 society of agricultural engineers; however, this provision
  1 18 shall not apply to such vehicles when traveling in any an
  1 19 escorted parade.  If a person operating a vehicle specified in
  1 20 this section objects to using a reflective device that
  1 21 complies with the standards of the American society of
  1 22 agricultural engineers for religious reasons, the vehicle may
  1 23 be identified by an alternative reflective device that is in
  1 24 the shape of a circle and is not less than twelve inches in
  1 25 diameter.  The reflective device or alternative reflective
  1 26 device shall be visible from the rear.  A vehicle other than
  1 27 those specified in this section shall not display a reflective
  1 28 device or an alternative reflective device.  On vehicles
  1 29 operating at speeds above thirty miles per hour, the
  1 30 reflective device or alternative reflective device shall be
  1 31 removed or hidden from view.
  1 32    3.  Garbage collection vehicles, when operated on the
  1 33 streets or highways of this state at speeds of thirty miles
  1 34 per hour or less, may display a reflective device that
  1 35 complies with the standards of the American society of
  2  1 agricultural engineers or with the requirements specified in
  2  2 subsection 2 for alternative reflective devices.  At speeds in
  2  3 excess of thirty miles per hour the device shall not be
  2  4 visible.  
  2  5                           EXPLANATION 
  2  6    This bill amends Code section 321.383 to provide that a
  2  7 slow-moving vehicle may be equipped with an alternative
  2  8 reflective device that is circular and not less than 12 inches
  2  9 in diameter if the person operating the vehicle objects for
  2 10 religious reasons to using a reflective device that complies
  2 11 with the standards of the American society of agricultural
  2 12 engineers.  Currently, rules adopted by the department of
  2 13 transportation require that a reflective device on a slow-
  2 14 moving vehicle comply with a designated standard of the
  2 15 American society of agricultural engineers.  The standard
  2 16 specifies that the device be triangular.  Persons who violate
  2 17 the requirements pertaining to reflective devices on slow-
  2 18 moving vehicles are subject to a scheduled fine of $20 under
  2 19 Code section 805.8.
  2 20    The bill also makes a corresponding amendment to a
  2 21 provision in Code section 321.288 which requires persons
  2 22 operating motor vehicles to reduce their speed when
  2 23 approaching and passing a slow-moving vehicle.
